Recommendations For A United States Position Regarding Delimitation Of The Outer Boundary Of The "Legal" Continental Shelves, Brian K. Hannula
Recommendations For A United States Position Regarding Delimitation Of The Outer Boundary Of The "Legal" Continental Shelves, Brian K. Hannula
Marine Affairs Theses and Major Papers
The Convention on the Continental Shelf has come under attack because it does not establish a precise outer boundary for the "legal" continental shelf. It is the author's opinion that the United States should propose or support a revision of the Convention which would rectify this situation. A suitable delimitation proposal must have considerable domestic support and should represent the best compromise between opposing domestic views. A proposed revision of the Convention must, also, have strong international support if it is to be adopted. Each nation will determine a preferred delimitation which depends on the configuration of its own continental …

Insider Trading And The Law Professors, Henry G. Manne
Insider Trading And The Law Professors, Henry G. Manne
Vanderbilt Law Review
When Insider Trading and the Stock Market' appeared in November, 1966, I was fully prepared for a goodly amount of disagreement. I was not prepared however for the emotional, almost hostile response my book received from some members of the academic community. This is not to say that all the reviews by law professors were unsympathetic and emotional in tone. Indeed the majority of them were not, and while critical reviews outnumbered favorable ones, most were in some degree mixed, and the tone was generally scholarly, impersonal, and in many cases constructive But the response to my book in the …

Between 1900 and 1968, the Senate had refused to confirm an appointee to the Supreme Court on only one occasion. Then, within a two year period, the Senate twice refused to confirm an appointment: Associate Justice Abe Fortas, nominated as Chief Justice in 1968, was never acted upon because of a Senate filibuster, and his name was withdrawn; and Judge Clement Haynsworth, whose nomination provoked a great deal of debate and controversy, was ultimately rejected by the Senate by a vote of 55 to 45. These two incidents marked a distinct change from the traditional custom of Senatorial acquiescence to Presidential …

The subway fare in New York City was recently raised to thirty cents. Incensed citizens immediately declared they would go to court and have the increase declared unconstitutional. "Unconstitutional" and "constitutional rights" have become the watchwords of political protestors and reformers. Moreover, their political forum is often a court of law. Who taught the nation this rhetoric, this mode of action, and this attitude toward law, law reform, and politics? The Supreme Court of the United States. Has the Court deliberately taught this doctrine? No, nor is it apparently even conscious of what it has unwittingly done. It is important …

Economic And Legal Philosophies Relating To Conglomerate Mergers, Robert Broughton, Ronald P. Tarullo
Economic And Legal Philosophies Relating To Conglomerate Mergers, Robert Broughton, Ronald P. Tarullo
Duquesne Law Review
The topic of this paper' originally entitled "Recent and Dynamic Changes In Economic and Legal Philosophies Relating to Mergers," has many facets. We shall try to identify the current merger trends, relying on legal and economic analysis. Our theme is a thin trail through an incredibly ovegrown thicket. We seek to identify: (1) the existence of a merger problem; (2) the change in this movement starting in 1968; (3) the legal framework under which existing regulating policy is directed; (4) current interpretations of Section 7 of the Clayton Act as it relates to the conglomerate movement; (5) actions taken by …

Constitutional Law - The Maximum Welfare Grant, Thomas Nelson Silverman
Duquesne Law Review
The Supreme Court of the United States has held that the State of Maryland may, pursuant to its maximum grant regulation, limit the amount of AFDC public assistance to large-member welfare families without violation of the Equal Protection Clause.
Dandridge v. Williams, 90 S. Ct. 1153 (1970).
In conjunction with the federal Aid to Families with Dependent Children program, the State of Maryland adopted a "maximum grant" regulation which provided-for a ceiling on the amount of AFDC public assistance available to any single family unit. Appellees, AFDC recipients, brought suit to enjoin the application of the Maryland maximum grant …
