Religious Discrimination And The Role Of Arbitration Under Title Vii, Harry T. Edwards, Joel H. Kaplan
Michigan Law Review
One of the major thrusts of the Civil Rights Act of 1964, passed by the 88th Congress of the United States after much procrastination and debate, is title VII, the Equal Employment Opportunity Act, which prohibits selected forms of employment discrimination.
In drafting title VII, the proponents of the Act were chiefly concerned with racial discrimination in employment. In fact, the entire Civil Rights Act was written with an eye toward the elimination of the "glaring ... discrimination against Negroes which exists throughout our nation." Given this intent, it is not surprising that, during the hearings and debates preceding the …

A Modern Proposal For State Regulation Of Consumptive Uses Of Water, Richard C. Ausness, Frank E. Maloney
A Modern Proposal For State Regulation Of Consumptive Uses Of Water, Richard C. Ausness, Frank E. Maloney
Law Faculty Scholarly Articles
As a nation, the United States is in the early stages of a developing water crisis. With an exploding population accompanied by great technological advances in industry and agriculture, America is using progressively more water each day; the increasing use threatens to exceed available supplies in the future unless available resources are properly managed.
As the demand for water grows, problems related to the equitable allocation of this important resource will likewise increase. The need that presently exists for an integrated and balanced approach to the problems of water consumption, pollution, navigation and recreation will become even more acute in …

Civil Rights - Housing Law - Effects Of Racial Concentration In Renewal Area, Thomas A. Koza
Civil Rights - Housing Law - Effects Of Racial Concentration In Renewal Area, Thomas A. Koza
Duquesne Law Review
The United States Court of Appeals for the Third Circuit has held that the Department of Housing and Urban Development's approval of an urban renewal plan, by concentrating on land use factors without inquiry into the effects of the type of housing on racial concentration, does not comply with the Housing Act of 1949 and the Civil Rights Acts of 1964 and 1968.

How Does The Law Change? The Case For Legal Research, Jeanne W. Halpern
How Does The Law Change? The Case For Legal Research, Jeanne W. Halpern
Miscellaneous Law School History & Publications
Legal research, once synonymous with pretrial investigations, courtroom proceedings, and a rather slavish application of precedent has, since the turn of the century, moved increasingly into university law schools. In so doing, legal research has expanded to include reform, innovation, and vigorous inquiries into the relation of law to the social forces that create it. In the satiric lithograph on the cover, "Les gens de justice" (courtesy of the University of Michigan Museum of Art), Honoré Daumier depicts 19th century lawyers and their "research" as pompous and self-serving. The frontispiece shows the William W. Cook Legal Research Building at the …

Careful communication is frequently of central importance in law. The language used to communicate even with oneself in private thought profoundly influences the quality of that effort; but when one attempts to transmit an idea to another, language assumes even greater significance because of the possibilities for enormously distorting the idea. Word-skill is to be prized. Few have expressed this more aptly or succinctly than Wesley N. Hohfeld: ...[I]n any closely reasoned problem, whether legal or nonlegal, chameleon-hued words are a peril both to clear thought and to lucid expression.

The Area Of Origin And A Columbia River Diversion, Ralph W. Johnson
The Area Of Origin And A Columbia River Diversion, Ralph W. Johnson
Washington Law Review
A major Columbia River water diversion is an option available to meet the future long-range water needs of the rapidly growing but arid Southwest. Without taking a position on the ultimate issue of diversion, Professor Johnson examines numerous precedents and current proposals for protecting the water rights of the area of origin. Since authority for determining whether and on what terms a diversion will take place rests with Congress, the political interests involved in a major diversion project are discussed and proposals are advanced for protecting areas of origin in light of past experience and political reality.

The Problems And Promise Of Black Men Of Law, Henry Mcgee
The Problems And Promise Of Black Men Of Law, Henry Mcgee
Faculty Articles
Professor McGee discusses the Black legal community's fight from the 1930s through the 1950s that eliminated the constitutional support of racial segregation and discrimination. Given the monumental obstacles which historically have plagued black lawyers, it is remarkable how many have succeeded despite the discrimination. While this article touches on some of the difficulties and limitations of the black bar, it must be stressed that there is a tradition of leadership and service among black lawyers that provides a solid foundation for the relatively large numbers of advocates that return to their communities. Building on this tradition of leadership, there are …
