Underwater Search And Rescue For Non-Military Submersibles, Peter A. Joseph
Underwater Search And Rescue For Non-Military Submersibles, Peter A. Joseph
Marine Affairs Theses and Major Papers
A system of underwater search and rescue for non-military submersibles utilizing a helicopter delivered rescue submersible is proposed. In the last 10 years there has been a substantial increase in manned underwater endeavors. This expansion is expected to continue with increasingly greater emphasis in the recreational field. The necessity to overcome the relatively short iife support of the small recreation submersible dictates a rapid response. This system should be capable of providing the lift necessary to rescue the entrapped personnel by bringing the submersible to the surface. At the present time the Coast Guard must rely on other submersible operators …

Evidence Of Producer's Due Care In A Products Liability Action, Robert A. Bernstein
Evidence Of Producer's Due Care In A Products Liability Action, Robert A. Bernstein
Vanderbilt Law Review
In a products liability case, evidence of defendant's due care in the manufacturing or processing operation can be a potent and sometimes critical factor in the decision of a judge or jury.' The question remains, however, whether such evidence is properly admissible under contemporary versions of the implied warranty and strict liability theories that have fashioned the recent revolution in consumer product law. The leading chronicler of the revolution, Dean Prosser, has noted the practical importance of the issue and has concluded, apparently without reservation, that in the ordinary case evidence of the defendant's due care is immaterial. The reasoning is …

The National Industrial Pollution Control Council: Advise Or Collude?, William H. Rodgers, Jr.
The National Industrial Pollution Control Council: Advise Or Collude?, William H. Rodgers, Jr.
Articles
This article analyzes three aspects of the National Industrial Pollution Countrol Coucil's performance: (1) the promise and risks it has presented; (2) its procedural performance, as tested by governing law; and (3) its accomplishments, both on the record and sub rosa, as measured by the expectations. In brief, NIPCC is portrayed as a dangerously anticompetitive institution occasionally doing business in violation of the law. The Council has published both public relations material and some useful data, but it has served more importantly as a lobbying forum for industries chafing under the regulatory bit. The experience of NIPCC forms the basis …

The Use Of Public Funds By Private Schools Via Educational Vouchers: Some Constitutional Problems, Steven R. Van Sicklen
The Use Of Public Funds By Private Schools Via Educational Vouchers: Some Constitutional Problems, Steven R. Van Sicklen
McGeorge Law Review
The 1971 California Legislature considered a bill which would have given an educational voucher to the parents of school children; the voucher would have been utilized to pay for the secular education of the child. The child's education could have been received at a private or parochial school as well as a public school. The question of a violation of the first amendment to the U.S. Constitution is immediately raised when public funds are given to religious schools. This comment discusses the educational voucher system as it would have been established by Assembly Bill 150. In addition to the problem …

Reflections On Appointive Local Government Bodies And A Right To An Election, Sheldon H. Nahmod
Duquesne Law Review
While few would dispute the importance in a representative democracy of the right to vote for government officials, there appears to be relatively little discussion of what might be termed an individual's constitutional right to an election. Granted, the reapportionment cases and other voting rights cases direct attention to vote dilution and voters qualifications, but they involve situations where elections have already been provided. Suppose, however, that elected officials of a properly apportioned municipality are permitted by statute to appoint members of a school board which will be exercising important governmental powers, such as the power to levy and collect …

Broadcasting, The Reluctant Dragon: Will The First Amendment Right Of Access End The Suppressing Of Controversial Ideas?, Donald M. Malone
University of Michigan Journal of Law Reform
The scope of this article will be limited to one aspect of electronic media programming-the extent to which the public is and should be exposed to an accurate cross section of public opinion and a broad range of controversial ideas. Many people, including the Federal Communications Commission (FCC), have acknowledged that a desirable goal for the broadcast media, particularly television, is to provide a marketplace for controversial ideas. Part II of this article will identify the principal reasons why that goal has not been achieved. Part III will examine the fairness doctrine, the antecedents of which have been traced back …
