Sex Discrimination: Female Participation In Little League Baseball, Terry Miller
University of Dayton Law Review
King v. Little League Baseball, Inc., 505 F.2d 264 (6th Cir. 1974).
Do girls have the constitutional right to participate on an equal basis with boys in Little League baseball? According to King v. Little League Baseball, Inc., girls do not even possess the right to have this question answered by a federal court. This suggests that the paramount consideration in cases challenging sexual discrimination by private athletic organizations is not the presence of a right, but the existence of a remedy.

The Exercise Of Administrative Discretion Under The Immigration Laws, Maurice A. Roberts
The Exercise Of Administrative Discretion Under The Immigration Laws, Maurice A. Roberts
San Diego Law Review
This Article examines the exercise of administrative discretion under the immigration laws under practical considerations. In terms of human misery, the potential impact of our immigration laws can hardly be overstated. With minor exceptions, the immigration laws operate directly and exclusively upon human beings whose hopes for future happiness in a realistic sense frequently depend on their ability to enter, or remain in, this land of freedom and opportunity. The statutes themselves contain a built-in potential for hardship which is to some extent unavoidable. To afford some opportunity for relief from the hardships that inevitably result from the application of …

Preferential Remedies For Employment Discrimination, Harry T. Edwards, Barry L. Zaretsky
Preferential Remedies For Employment Discrimination, Harry T. Edwards, Barry L. Zaretsky
Michigan Law Review
A basic thesis of this article is that much of the current concern about alleged "reverse discrimination" in employment ignores the reality of the situation. In Part I it will be contended that although color blindness is a laudable long-run objective, it alone will not end discrimination; thus, it will be argued that some form of "color conscious" affirmative action must be employed in order to achieve equal employment opportunity for minorities and women. The most effective form of affirmative action is temporary preferential treatment, and it will be asserted in Part II that such relief can be justified under …
The Flood Disaster Protection Act Of 1973: A Rational Approach To Flood Damage Prevention, Larry J. Wilson
The Flood Disaster Protection Act Of 1973: A Rational Approach To Flood Damage Prevention, Larry J. Wilson
IUSTITIA
Throughout history, man has utilized rivers for water supply, transportation, power generation, and waste disposal. This strong relationship has encouraged the location of human settlements near rivers and streams despite the risk of periodic flooding. The modern technology of transportation and public services has reduced the necessity for riverside locations, but the development of flood plains in urban areas has continued, resulting in the periodic loss of human life and property when flooding has occurred. Within the United States, flooding has taken over 5000 lives in the last fifty years and causes an estimated $1.25 billion in property damages annually.' …
