An Examination Of New England's Coastal Wetlands Legislation, Joseph M. D'Eugenio
Marine Affairs Theses and Major Papers
This paper will examine the different legislative schemes that have been created in New England for the protection of coastal wetlands. It will assess how they have worked in practice, both with respect to their administration and the judicial response to them, and will outline the arguments for and against upholding restrictions on the use of wetlands under the legislation.

Jurisdiction And Control Over The Multinational Enterprise: De Maximis Non Curat Lex, J. Shand Watson
Jurisdiction And Control Over The Multinational Enterprise: De Maximis Non Curat Lex, J. Shand Watson
Mercer Law Review
The current flurry in the legal literature caused by multinational enterprises is yet another indication that the existing systems of control in the domestic and international spheres are either stretched to their limits or else completely inadequate to their assigned tasks. Most writers indicate that the multinational enterprise (MNE),' however defined, is a strong force for good or evil and, consequently, must be subject to some degree of control; yet when that conclusion is discussed, the schools of thought that emerge are as numerous as the commentators.2 This article does not endeavor to provide answers to the current fetish, but …

Section 12 Of The Canada Evidence Act And The Deliberations Of Simulated Juries, Valerie P. Hans, Anthony N. Doob
Cornell Law Faculty Publications
In the past, there have been three major approaches to the experimental investigation of the jury. First, juror selection research involves the study of the relation between verdicts or leniency toward certain classes of defendants and the characteristics of potential jurors. The second class of research is group study, in which the amount and style of individual participation is observed within the context of simulated jury deliberations (e.g., Strodtbeck, James and Hawkins, 1957). Finally, experimental psychology has made another contribution to the study of the jury; numerous researchers have conducted experimental studies employing legal stimulus materials. Typically, in such a …
Direct Election Of The President Without A Constitutional Amendment: A Call For State Action, Dale Read, Jr.
Direct Election Of The President Without A Constitutional Amendment: A Call For State Action, Dale Read, Jr.
Washington Law Review
This article will suggest that this focus on the constitutional amendment process for changing the electoral college has been misdirected. The states, without federal action, possess the capability of implementing the direct popular election of the President. This article will examine the background of electoral college reform and will propose a "National Vote Plan" to achieve direct popular presidential election independently of the constitutional amendment process.

Duquesne Law Review
The Supreme Court of the United States has held that unless there is adequate justification, a federal court-ordered plan for reapportionment of a state legislature must avoid use of multimember districts and achieve population equality with only de minimis variation.
