Home For Good: How The Opt-In Element Added To Hb 547 Negatively Impacts Low-Income Homeschool Students In Texas, Nadine Cox
The Scholar: St. Mary's Law Review on Race and Social Justice
This comment addresses the relationship between a parent’s constitutional right to educate their child as they see fit and a child’s interest in receiving a robust education. The idea of a parent’s right to raise their child is a fundamental and long established one. However, activist have also raised concern regarding children who are educated at home. The concern centers around the idea that children have little to no access to extra-curricular activities, socialization, or other educational opportunities. Access to extra-curricular activities leads to a well-balanced education that prepares the child for whatever career the child desires. A child does …

Effect Of Social Media On Shaping The Agenda Of The Communicator In The Jordanian Tv Channels, Amer Khaled Ahmad, Hamza Mohammad Nahar, Maram Mohammad Naji Manajreh
Middle East Journal of Communication Studies
The study aimed to assess the extent to which communicators at Jordanian television channels use social media platforms as an information source, and the impact of these platforms on their news and information selection priorities. This was achieved using a survey tool distributed on an equal quota sample of (150) communicators from Jordanian television channels (Jordan TV, AlMamlaka TV, Roya TV). The study found that all the study subjects used social media platforms as a source of information, with the "X platform (formerly Twitter)" being the most used platform. The statement "understanding the audience's interests and preferences to produce tailored …
Privacy’S Commodification And The Limits Of Antitrust, Jeffrey L. Vagle
Privacy’S Commodification And The Limits Of Antitrust, Jeffrey L. Vagle
Arkansas Law Review
This Article argues that the buying and selling of personal data forms what Debra Satz calls a “noxious market,” and, thus, any regulation of information privacy should not accept or depend upon its commodification but should stand on its own. This Article proceeds in three parts. Part I first lays out the history and effects of data commodification, arguing that the market created by this commodification is noxious and undesirable. Part II examines the renewal of antitrust’s purpose as a regulatory tool, especially in the context of its use in the regulation of large technology firms. Finally, Part III argues …

Preference Conflict And Peace Studies: The Line Between Disagreement And Violence, Frederic R. Kellogg
Preference Conflict And Peace Studies: The Line Between Disagreement And Violence, Frederic R. Kellogg
Peace and Conflict Studies
Broadening the definition of conflict defines more comprehensively the condition of peace, focusing on how unresolved shared disagreements can lead to, or avoid, polarization and violence. The line between general disagreement and violent conflict lies in the adjustment of shared preferences. Matters like reproductive rights, medically assisted death, race and gender discrimination, while subject to political polarization, are open to peaceful redress through what John Dewey called the transformative continuum of inquiry, in which the crucial social response to shared problems includes dispute and conflict. Resolution of controversial social problems requires preference adjustment and habit change, often, if not always, …

Virtual Confessions: Examining The Clergy Privilege’S Extension To Artificially Intelligent Religious Robots, Samuel N. Dick
Virtual Confessions: Examining The Clergy Privilege’S Extension To Artificially Intelligent Religious Robots, Samuel N. Dick
The University of Cincinnati Intellectual Property and Computer Law Journal
Artificial Intelligence (AI) is fundamentally changing the world. AI’s rapid development is driving its integration into every industry, including those traditionally untouched by technology—such as religion. Today, faith groups in America and globally, are integrating AI-driven robots in roles traditionally held by human priests, clergy, or pastors. AI robots have begun giving sermons, conducting funerals/weddings, providing spiritual counseling, and conducting the sacrament of confession. Some faith groups have gone further claiming the worship of AI as an independent religion, and have received § 501(c)(3) tax-exempt status as a church. Whether thoughts of sacrileges, inevitability, or a science-fiction novel emerge, AI’s …

Kohlhaas V. State: Encouraging Democratic Reform Through Constitutional Flexibility, Allyson Barkley, Connor Sakati
Kohlhaas V. State: Encouraging Democratic Reform Through Constitutional Flexibility, Allyson Barkley, Connor Sakati
Alaska Law Review
In the spirit of democracy reform, Alaska recently adopted a jungle primary and ranked choice voting electoral system for all state-wide elections. In Kohlhaas v. State, the Alaska Supreme Court upheld this reform against numerous state and federal constitutional challenges. While doing so, the court avoided rigid constitutional interpretations that would have frozen the electoral system in its current first-past-the-post state. Moreover, the court refused to credit the plaintiff's speculation about the hypothetical malign effects of ranked-choice voting, placing the burden to produce hard evidence of their critiques on RCV's opponents. Alaska can serve as a model for other …

The Challenges Of Meeting The Needs Of Virginia Students With Disabilities Through Individualized Education Programs, Hank Bostwick, Courtney Pugh, Latonya Slade, Sara Platenberg, Melissa Waugh
Richmond Public Interest Law Review
The authors were honored to participate in a panel on “Understanding the IEP” at the Richmond Public Interest Law Review’s Symposium on October 27, 2023. The recommendations and strategies in this article are rooted in decades of combined experience and anecdotal observations from two special education attorneys and three special education advocates who serve Virginia’s children and families and help to develop appropriate Individualized Education Programs (“IEPs”) pursuant to the Individuals with Disabilities Education Act (“IDEA”). Recent criticism of Virginia’s system of special education and related services by state and federal agencies has laid bare deep-seated inconsistencies in how schools …

Navigating The Intersection Of Mckinney-Vento And Idea, Patricia A. Popp, Martha Crockett
Richmond Public Interest Law Review
Students with disabilities who are also experiencing homelessness face compounded challenges related to attending and participating in school. These children and youth are provided educational protection through two federal laws: the 2004 “Individuals with Disabilities Education Act” (IDEA) and the McKinney-Vento (MV) Education of Homeless Children and Youth (EHCY) program. It is the responsibility of educators, school personnel, and families to carefully navigate the dual mandates in order to ensure equitable educational opportunities, while also meeting the unique needs of each student. The purpose of this article is to offer a foundation for understanding the intersection of the two laws …

The Palestinian Feature Film "200 Meters" Addresses The Issue Of The Apartheid Wall, Samar Abd Al Karim Farahat
Middle East Journal of Communication Studies
This study aimed to explain the methods of processing the Palestinian feature film" 200 meters " to the issue of the apartheid wall, using sub-objectives highlighting political, social and psychological issues and topics in addition to the characters and cinematic elements, to identify the form of processing carried out by the film in an integrated manner. Given the nature of this study, which aimed to find out how the 200-meter film dealt with the issue of the apartheid wall, the researcher adopted the most appropriate approach to studying this type of phenomena, which is the analytical approach. The results of …

To Essa And Beyond: Arc Of Education Policy Bends Toward Local Authorities & Holistic Approaches, Adam Tanielian
St. Mary's Law Journal
This Article presents a mixed-methods, interdisciplinary study on educational policy and practice to offer solutions to fossilized problems extant across the United States’ elementary and secondary schools. Analysis of historic Supreme Court decisions and statutes unveil compelling trends that have shaped the legal landscape over the latter half of the twentieth century. Linguistic comparisons of two milestone revisions of the 1965 Elementary and Secondary Education Act—No Child Left Behind (NCLB) and Every Student Succeeds Act (ESSA)—show Congress granted more flexibility and authority to local districts and states under ESSA, which reflected trends in Supreme Court opinions over several decades.

Computationally Assessing Suspicion, Wesley M. Oliver, Morgan A. Gray, Jaromir Savelka, Kevin D. Ashley
Computationally Assessing Suspicion, Wesley M. Oliver, Morgan A. Gray, Jaromir Savelka, Kevin D. Ashley
University of Cincinnati Law Review
Law enforcement officers performing drug interdiction on interstate highways have to decide nearly every day whether there is reasonable suspicion to detain motorists until a trained dog can sniff for the presence of drugs. The officers’ assessments are often wrong, however, and lead to unnecessary detentions of innocent persons and the suppression of drugs found on guilty ones. We propose a computational method of evaluating suspicion in these encounters and offer experimental results from early efforts demonstrating its feasibility. With the assistance of large language and predictive machine learning models, it appears that judges, advocates, and even police officers could …

America's Next Top Ej Model: Assessing The Role Of Food Access In Environmental Justice Models, Allyson Barry
Department of Environmental Studies: Undergraduate Student Theses
Disruptions to weather patterns and ecosystems due to climate change are a global challenge. However, previous research has found that communities of color, traditionally underprivileged communities, and socioeconomically disadvantaged communities are disproportionately burdened with adverse health outcomes, higher propensities of exposure to weather disasters and pollution, and well-being inequalities. The field of environmental justice (EJ) seeks to eliminate such disparities through environmental laws, regulations, and policies. Published in 2022, the Centers for Disease Control and Prevention (CDC) and the Agency for Toxic Substances and Disease Registry (ATSDR) formulated the Environmental Justice Index (EJI) as a data tool to identify communities …

Unrestricted Versus Regulated Open Data Governance: A Bibliometric Comparison Of Sars-Cov-2 Nucleotide Sequence Databases, Nathanael Sheehan, Federico Botta, Sabina Leonelli
Copyright, Fair Use, Scholarly Communication, etc.
Two distinct modes of data governance have emerged in accessing and reusing viral data pertaining to COVID-19: an unrestricted model, espoused by data repositories part of the International Nucleotide Sequence Database Collaboration and a regulated model promoted by the Global Initiative on Sharing All Influenza data. In this paper, we focus on publications mentioning either infrastructure in the period between January 2020 and January 2023, thus capturing a period of acute response to the COVID-19 pandemic. Through a variety of bibliometric and network science methods, we compare the extent to which either data infrastructure facilitated collaboration from different countries around …

Evaluation Of Us Immigration Policies For Technology Professionals, Angel Contreras Cruz
Evaluation Of Us Immigration Policies For Technology Professionals, Angel Contreras Cruz
Student Research Symposium
The U.S. Immigration System is complex for technology professionals seeking to relocate to the United States for employment or education. The United States relies on its employment-based immigration to attract and select the best talent to fill the shortage of skilled jobs. Technology professionals, a stream of highly skilled immigrants, tend to contribute and be more beneficial to the U.S. economy, which is one of the principles of U.S. immigration policies. Although U.S. immigration policies are constantly updating, policymakers, experts, and scholars suggest that the United States needs significant immigration reform to solve current issues, such as improving technological capabilities …

Using Digital Twins To Protect Biomanufacturing From Cyberattacks, Brenden Fraser-Hevlin, Alec W. Schuler, B. Arda Gozen, Bernard J. Van Wie
Military Cyber Affairs
Understanding of the intersection of cyber vulnerabilities and bioprocess regulation is critical with the rise of artificial intelligence and machine learning in manufacturing. We detail a case study in which we model cyberattacks on network-mediated signals from a novel bioreactor, where it is important to control medium feed rates to maintain cell proliferation. We use a digital twin counterpart reactor to compare glucose and oxygen sensor signals from the bioreactor to predictions from a kinetic growth model, allowing discernment of faulty sensors from hacked signals. Our results demonstrate a successful biomanufacturing cyberattack detection system based on fundamental process control principles.

Characterizing Advanced Persistent Threats Through The Lens Of Cyber Attack Flows, Logan Zeien, Caleb Chang, Ltc Ekzhin Ear, Dr. Shouhuai Xu
Military Cyber Affairs
Effective cyber defense must build upon a deep understanding of real-world cyberattacks to guide the design and deployment of appropriate defensive measures against current and future attacks. In this abridged paper (of which the full paper is available online), we present important concepts for understanding Advanced Persistent Threats (APTs), our methodology to characterize APTs through the lens of attack flows, and a detailed case study of APT28 that demonstrates our method’s viability to draw useful insights. This paper makes three technical contributions. First, we propose a novel method of constructing attack flows to describe APTs. This abstraction allows technical audiences, …

Commercial Enablers Of China’S Cyber-Intelligence And Information Operations, Ethan Mansour, Victor Mukora
Military Cyber Affairs
In a globally commercialized information environment, China uses evolving commercial enabler networks to position and project its goals. They do this through cyber, intelligence, and information operations. This paper breaks down the types of commercial enablers and how they are used operationally. It will also address the CCP's strategy to gather and influence foreign and domestic populations throughout cyberspace. Finally, we conclude with recommendations for mitigating the influence of PRC commercial enablers.
