India’S Removal Of Kashmir’S Special Protection Status: An Internationally Wrongful Act?, Gita Howard May 2021

India’S Removal Of Kashmir’S Special Protection Status: An Internationally Wrongful Act?, Gita Howard

University of Miami International and Comparative Law Review

India abrogated Articles 370 and 35A of its Constitution in August of 2019, effectively removing Kashmir’s longstanding special protection status. Kashmir’s special protection status provided Kashmiris with an additional degree of autonomy than India’s states, and its revocation left Kashmir under greater control of Delhi.1 Several organizations flagged human rights concerns regarding the sudden revocation of the region’s special protection status and the subsequent lockdown. This article seeks to narrowly address whether the removal of Kashmir’s special protection status was a violation of international law. This article demonstrates that although Kashmiris’ internal right to self-determination may serve as a theory …

Memory And Identity: Inter-Generational Resilience And Construction Of Diasporic Identities Among Somali Refugees, Hamida Dahir Sheikh Ahmed May 2021

Memory And Identity: Inter-Generational Resilience And Construction Of Diasporic Identities Among Somali Refugees, Hamida Dahir Sheikh Ahmed

Master's Theses

The violence and displacement many refugees face often create a lifelong trauma that manifests in many ways within themselves, their families, and communities. The Somali refugee community in the United States is no different. Since their resettlement in America started in the 1990s following the civil war, the community has struggled with different manifestations of that trauma; substance abuse and gang violence among the youth, prominence of depression and suicide rates, rise of domestic violence, as well as other direct and indirect results associated with mental health. This is the reality of many refugee and immigrant communities, coming directly from …

Coin Doctrine Is Wrong, M. Chris Mason May 2021

Coin Doctrine Is Wrong, M. Chris Mason

The US Army War College Quarterly: Parameters

Counterinsurgency does not increase the legitimacy of, or support for, central governments engaged in internal conflicts. Recent research shows quantifiable degrees of government legitimacy, national identity, and population security are necessary precursors and accurate predictors of a government’s ability to outlast a civil uprising. Because the first two predictors—government legitimacy and national identity—can be measured and do not increase during a conflict, the probability of government failure in most cases can be accurately predicted when the conflict starts.

Overruling Rostker V. Goldberg: Toward An Equal Obligation To Register For Selective Service, Tom James May 2021

Overruling Rostker V. Goldberg: Toward An Equal Obligation To Register For Selective Service, Tom James

Nebraska Law Bulletin (Selected Issues)

The Military Selective Service Act (MSSA) is one of the few remaining laws from an era when unequal rights were granted and unequal obligations were imposed solely on the basis of sex. It assigns exclusively to men the obligations to involuntarily leave one’s home, family, and employment if called up to serve and to place themselves at risk of being required to kill or be killed. It also imposes other significant burdens on men that go far beyond merely providing a name and address to a government agency. Men are under a continuing obligation to update that information until they …

Reinterpreting The Reinterpretation: Collective Self-Defense As Constitutional Fidelity, C.D.A Evans, Aviel Menter May 2021

Reinterpreting The Reinterpretation: Collective Self-Defense As Constitutional Fidelity, C.D.A Evans, Aviel Menter

Penn State Journal of Law & International Affairs (2012 - Present)

As currently interpreted, Article 9 of the Japanese Constitution requires Japan’s Self-Defense Forces (JSDF) to operate in a purely defensive capacity. Recently, however, the United States has increasingly asked Japan to participate in joint military operations, in which Japanese forces would defend not only themselves, but also their American allies. This raises an important legal question: does Article 9 permit the JSDF engage in this kind of collective self-defense? Former Prime Minister Abe Shinzo believed so. After a government panel of legal experts found that collective self-defense was consistent with Article 9, the Abe administration adopted the panel’s conclusion. However, …

Automated Analysis Of Rfps Using Natural Language Processing (Nlp) For The Technology Domain, Sterling Beason, William Hinton, Yousri A. Salamah, Jordan Salsman

SMU Data Science Review

Much progress has been made in text analysis, specifically within the statistical domain of Term Frequency (TF) and Inverse Document Frequency (IDF). However, there is much room for improvement especially within the area of discovering Emerging Trends. Emerging Trend Detection Systems (ETDS) depend on ingesting a collection of textual data and TF/IDF to identify new or up-trending topics within the Corpus. However, the tremendous rate of change and the amount of digital information presents a challenge that makes it almost impossible for a human expert to spot emerging trends without relying on an automated ETD system. Since the U.S. Government …

Intangible Cultural Heritage: A Benefit To Climate-Displaced And Host Communities, Gül Aktürk, Martha B. Lerski May 2021

Intangible Cultural Heritage: A Benefit To Climate-Displaced And Host Communities, Gül Aktürk, Martha B. Lerski

Publications and Research

Climate change is borderless, and its impacts are not shared equally by all communities. It causes an imbalance between people by creating a more desirable living environment for some societies while erasing settlements and shelters of some others. Due to floods, sea level rise, destructive storms, drought, and slow-onset factors such as salinization of water and soil, people lose their lands, homes, and natural resources. Catastrophic events force people to move voluntarily or involuntarily. The relocation of communities is a debatable climate adaptation measure which requires utmost care with human rights, ethics, and psychological well-being of individuals upon the issues …

The Right Against Self-Incrimination Under Indian Constitution & The Admissibility Of Custodial Statements Under The Indian Evidence Act, 1872, Khagesh Gautam May 2021

The Right Against Self-Incrimination Under Indian Constitution & The Admissibility Of Custodial Statements Under The Indian Evidence Act, 1872, Khagesh Gautam

Maurer Theses and Dissertations

This work argues that the constitutional validity of section 27 of the Indian Evidence Act, 1872 is highly suspect on the ground that it violates the right against self-incrimination protected by article 20(3) of the Indian Constitution. Section 27 codifies the doctrine of confirmation by subsequent recovery, an old British rule of admission according to which self-incriminatory custodial statements and/or confessions obtained by the police or the investigation agency are admissible into evidence on the ground that contents of such statement have been confirmed by recovery of incriminating physical evidence. Chapter I locates the Indian criminal justice system within the …

Constitutional Structure, Institutional Relationships And Text: Revisiting Charles Black’S White Lectures, Richard C. Boldt May 2021

Constitutional Structure, Institutional Relationships And Text: Revisiting Charles Black’S White Lectures, Richard C. Boldt

Loyola of Los Angeles Law Review

Fundamental questions about constitutional interpretation and meaning invite a close examination of the complicated origins and the subsequent elaboration of the very structure of federalism. The available records of the Proceedings in the Federal Convention make clear that the Framers entertained two approaches to delineating the powers of the central government relative to those retained by the states. The competing approaches, one reliant on a formalist enumeration of permissible powers, the other operating functionally on the basis of a broad dynamic concept of state incompetence and national interest, often are presented as mutually inconsistent narratives. In fact, these two approaches …

The E-Banknote As A ‘Banknote’: A Monetary Law Interpreted, Benjamin Geva, Seraina Neva Grünewald, Corinne Zellweger-Gutknecht May 2021

The E-Banknote As A ‘Banknote’: A Monetary Law Interpreted, Benjamin Geva, Seraina Neva Grünewald, Corinne Zellweger-Gutknecht

Articles & Book Chapters

This article discusses whether electronic banknotes can properly be characterised as ‘banknotes’, their design as such and what architectural models are available for their issuance by central banks. Issues are addressed under general principles governing the interpretation of monetary laws in the context of evolving technologies and institutional arrangements. The article proposes a clear terminology to address the concepts underlying digital currencies and access to central bank money, and argues that a banknote may be ‘written’ electronically. The stance adopted in the article is critical of both account-based retail central bank digital currency and cryptocurrencies, and highlights the salient features …

Quantitative Legal Research In Germany, Dirk Hartung May 2021

Quantitative Legal Research In Germany, Dirk Hartung

Research Collection Yong Pung How School Of Law

This chapter positions quantitative legal research in Germany, where it is a relatively new discipline, within the country’s greater legal academic landscape. The early stage of the discipline makes Germany particularly interesting for international scholars and open to a global academic dialogue. In addition, as the discipline is still young, the discourse is still open to influence from a global community. The following discussion argues for better access to legal data and tries to save researchers from pitfalls such as high fees for or dubious providers of legal data. It encourages the compilation of comprehensive, rich, well-documented and open source …

Measuring Law Over Time: A Network Analytical Framework With An Application To Statutes And Regulations In The United States And Germany, Corinna Coupette, Janis Beckedorf, Dirk Hartung, Michael Bommarito, Daniel Martin Katz May 2021

Measuring Law Over Time: A Network Analytical Framework With An Application To Statutes And Regulations In The United States And Germany, Corinna Coupette, Janis Beckedorf, Dirk Hartung, Michael Bommarito, Daniel Martin Katz

Research Collection Yong Pung How School Of Law

How do complex social systems evolve in the modern world? This question lies at the heart of social physics, and network analysis has proven critical in providing answers to it. In recent years, network analysis has also been used to gain a quantitative understanding of law as a complex adaptive system, but most research has focused on legal documents of a single type, and there exists no unified framework for quantitative legal document analysis using network analytical tools. Against this background, we present a comprehensive framework for analyzing legal documents as multi-dimensional, dynamic document networks. We demonstrate the utility of …

Persistent Inequalities, The Pandemic, And The Opportunity To Compete, Rachel F. Moran May 2021

Persistent Inequalities, The Pandemic, And The Opportunity To Compete, Rachel F. Moran

Faculty Scholarship

Even before the recent coronavirus pandemic, race, ethnicity, and socioeconomic status played a powerful role in allocating opportunity—in the public schools and elsewhere. The pandemic laid bare the dimensions of this inequality with a new and alarming clarity. In this essay, I first focus on the landscape of educational inequity that existed before the coronavirus forced public schools to shut down. In particular, I explore patterns of racial and ethnic segregation in America’s schools and evaluate how those patterns relate to additional challenges based on socioeconomic isolation. In addition, I consider the role of language and immigration status in shaping …

The literature study involved data collection triangulation to determine the extant Jātakamālā and pāramitā texts closest to the sources. Content analysis on the Jātakamālā texts and observation of its corresponding reliefs were carried out to identify the message and substantial points of each allegory. Both the actions and the motivation driving the character to perform such actions are considered. Using thematic analysis, …

How To Do Things With Signs: Semiotics In Legal Theory, Practice, And Education, Harold Anthony Lloyd May 2021

How To Do Things With Signs: Semiotics In Legal Theory, Practice, And Education, Harold Anthony Lloyd

University of Richmond Law Review

This Article therefore broadly explores semiotics through a lawyer’s lens, hopefully simplifying as much as possible much of the complex, divergent, and, frankly, sometimes baffling terminology used by those who explore semiotics. This Article will first continue below with a general definition of signs and the related notion of intentionality. It will then address the structure and concomitants of signs, the nature of speech acts that are of interest to lawyers, the sign classifications used in legal analysis and rhetoric, the role of signs in careful legal thought and good legal rhetoric, the unfolding of the signified and the fixation …

Protecting Pregnancy, Jennifer B. Shinall May 2021

Protecting Pregnancy, Jennifer B. Shinall

Vanderbilt Law School Faculty Publications

Laws to assist pregnant women in the workplace are gaining legislative momentum, both at the state and federal levels. Last year alone, four such laws went into effect at the state level, and federal legislation advanced farther than ever before in the House of Representatives. Four types of legislative protections for pregnant workers currently exist-pregnancy accommodation laws, pregnancy transfer laws, paid family leave laws, and state disability insurance programs but very little is known about how each type of legislation performs relative to the others. This Essay provides empirical insight into this question, which is important for setting legislative priorities. …

The Meaning Of Sex: Dynamic Words, Novel Applications, And Original Public Meaning, William N. Eskridge Jr., Brian G. Slocum, Stefan Th. Gries May 2021

The Meaning Of Sex: Dynamic Words, Novel Applications, And Original Public Meaning, William N. Eskridge Jr., Brian G. Slocum, Stefan Th. Gries

Michigan Law Review

The meaning of sex matters. The interpretive methodology by which the meaning of sex is determined matters Both of these were at issue in the Supreme Court’s recent landmark decision in Bostock v. Clayton County, where the Court held that Title VII protects lesbians, gay men, transgender persons, and other sexual and gender minorities against workplace discrimination. Despite unanimously agreeing that Title VII should be interpreted in accordance with its original public meaning in 1964, the opinions in Bostock failed to properly define sex or offer a coherent theory of how long-standing statutes like Title VII should be interpreted over …
