Law's Body, Matt Saleh, Hannah Potter, Kendall Foley
Law's Body, Matt Saleh, Hannah Potter, Kendall Foley
Mercer Law Review
How do law’s narratives construct one of its central objects: the human body? This essay explores legal constructions of the human body: both in its idealized form, and in the negative ontological spaces of injury, disability, death, and dehumanization that surround that ideal.
Bodies are “the very ‘stuff’ of law.” There are few areas of law where the human body does not, somewhere, require definition. For instance, without a concept of the body, there can be no consequent constructions of personhood, nakedness, state intrusion, injury, disability, duty of care, aging, or the moment of death, to name only a few.

Even Lawyers Do Not Like Legalese, Eric H. Martinez, Francis Mollica, Edward Gibson

Significance
Why do lawyers write in such a convoluted manner? Across two preregistered experiments, we find that lawyers a) like laypeople, were less able to understand and recall “legalese” contracts than content of equivalent meaning drafted in a simplified register; and b) rated simplified contracts as equally enforceable as legalese contracts, and rated simplified contracts as preferable to legalese contracts on several important dimensions. Contrary to previous speculation, these results suggest that lawyers who write in a convoluted manner do so as a matter of convenience and tradition as opposed to an outright preference and that simplifying legal documents would …Forum Selection Provisions And The Preclusion Of Derivative Claims Under Section 14(A) Of The Securities Exchange Act: Should Federal Courts Intervene?, Noah P. Forum Selection Provisions And The Preclusion Of Derivative Claims Under Section 14(A) Of The Securities Exchange Act: Should Federal Courts Intervene?, Noah P. Mathews
Fordham Law Review
This Note examines whether a forum selection provision in a corporation’s bylaws that requires shareholders to bring derivative claims in the Delaware Court of Chancery is enforceable when invoked by directors to dismiss derivative claims under the Securities Exchange Act (the “Exchange Act”)—claims over which federal courts have exclusive jurisdiction. In Seafarers Pension Plan ex rel. Boeing Co. v. Bradway, the U.S. Court of Appeals for the Seventh Circuit held that enforcing this type of bylaw would violate the act’s antiwaiver provision, which voids any stipulation that allows a person to waive compliance with the act. In Lee ex …

Stories From The Negative Spaces: United States V. Thind And The Narrative Of (Non)Whiteness, Joy Kanwar
Mercer Law Review
In the years following September 11, 2001, hate crimes and violent incidents against Sikh people in America rose dramatically. Most of these incidents involved individuals who targeted Sikh people—often men—because of their turbans and beards, which the attackers conflated with their own imagined versions of “9/11 terrorists.” Although the Sikh faith had no relationship to whom these attackers thought they were assaulting, very often someone they believed to be from the Islamic faith, the “visual” told the story—the victim was an outsider, someone who did not belong here and someone who was dangerous for America.
One particularly poignant moment resonated …
Polysemy And The Law, Daniel J. Hemel
Polysemy And The Law, Daniel J. Hemel
Vanderbilt Law Review
Polysemy-the existence of multiple related meanings for the same word or phrase-is a frequent phenomenon in legal and lay language. Although polysemy sometimes arises by accident, it also can be strategic: framers of legal rules can advance private and public interests by assigning meanings to terms that are different from-though connected to-the meanings that those terms carry outside the law. Understanding the functions of polysemy can help us design more effective legal rules and can shed light on ways in which legal actors translate language into power.
This Article undertakes a comprehensive analysis of polysemy's origins, uses, and consequences across …

"What's In A [Dead] Name?": Title Vii Protections Against Misgendering And Deadnaming Of Gender Diverse Individuals, Mackenzie O'Connell
University of Florida Journal of Law & Public Policy
The Supreme Court’s 2020 holding in Bostock v. Clayton County monumentally altered the availability of employment discrimination claims under Title VII to individuals identifying as members of the LGBTQ+ community. The Court did so by finding that the meaning of Title VII’s prohibition of workplace discrimination “because of sex” includes discrimination against individuals on the basis of their homosexual or transgender statuses. The effects of this decision on other aspects of employment litigation are still uncertain.
Pre-Bostock, transgender and non-binary individuals were largely left without a legal remedy under Title VII for hostile work environment sexual harassment claims. …
There's No Such Thing As Independent Creation, And It's A Good Thing, Too, Christopher Buccafusco
There's No Such Thing As Independent Creation, And It's A Good Thing, Too, Christopher Buccafusco
William & Mary Law Review
Independent creation is the foundation of U.S. copyright law. A work is only original and, thus, copyrightable to the extent that it is independently created by its author and not copied from another source. And a work can be deemed infringing only if it is not independently created. Moreover, independent creation provides the grounding for all major theoretical justifications for copyright law. Unfortunately, the doctrine cannot bear the substantial weight that has been foisted upon it. This Article argues that copyright law’s independent creation doctrine rests on a set of discarded psychological assumptions about memory, copying, and creativity. When those …

Which Came First: The Chicken Or The Chick'n? An Fda Amendment Proposal To Reconcile Conflicting Interests In Plant-Based Meat Labeling, Katie Justison
William & Mary Law Review
“The issue is, what is chicken?” As the market for plant-based meats grows, state legislators are left with the question of what the words “chicken” and “burger” mean on food labels. In response to lobbying from the traditional meat industries, states followed suit with the dairy industry and created regulations and restrictions that carve out a meat industry monopoly on meat-related terms. Commercial speech restrictions such as these are guided by the Central Hudson test. Using that test, this Note will argue that while certain state regulations pass constitutional muster, others impose unconstitutional speech restrictions. This Note will draw particularly …

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in …

Use Of Natural Language Processing (Nlp) In Civil Case Management: A Report On Three Proof Of Concept Projects, Paula Hannaford-Agor, Jannet Okazaki

In 2016, the Conference of Chief Justices (CCJ) and the Conference of State Court Administrators (COSCA) endorsed recommendations to leverage technology to improve civil case management. In particular, Natural Language Processing (NLP) and related tools could be used to support two areas of civil case processing: sorting cases at filing based on the anticipated level of judicial involvement in case management, and confirming that essential procedural requirements have been satisfied before entering final judgments in cases.
To explore the feasibility of NLP to support court operations in these two areas, the National Center for State Courts (NCSC) designed three distinct …

Interpretations Of Intent: Sovereignty, The Second Amendment, And Us Gun Culture, Lola I. Brown
Political Science Honors Projects
In this paper, I engage foundational theorists such as Jean Bodin, Thomas Hobbes, and John Locke to examine the philosophies of sovereignty that underpin the US Constitution and the creation of the Second Amendment. I find that the US Founders' reaction to these foundational theories of sovereignty allowed for a breakdown in the system of sovereignty in the country, and made way for the implementation of the Rule of Law. The Rule of Law, in turn, created the conditions of possibility for the psyche of radical individualism that now permeates the US. This radical individualism allowed for the reinterpretation of …

A Study Of Audiovisual Fansubbing Translation Of Abbreviations In English Movies Into Arabic: Angels And Demons Movie As A Model, الاستاذ المساعد ابراهيم طلعت ابراهيم, الاستاذ الدكتور مهدي فالح الغزالي
Midad AL-Adab Refereed Quarterly Journal
Audiovisual Translation (AVT) is defined as process of rendering multimodal product from the source language SL into the target language (TL). In other words, the AVT translator works on transferring the meaning of every mode (aural, visual and written) in the body of the (movie, interview, documentary reports, interview, cartoon, etc.) from one language into another. Besides, both researchers chose abbreviation forms found in the body of the American movie (Angels and Demons) to be analyzed into Arabic. They pinpointed three available fansubbing products of the movie in question online. It is hypothesized that amateur subtitlers whose translations selected for …

The Rise In Anti-Asian Racism And Xenophobia In The Time Of Covid-19, Mitchell Alan Kaplan
Journal of Hate Studies
As the COVID-19 pandemic continues to have a detrimental impact on the health of the American people and those abroad, the social consequences stemming from the spread of the virus have become an international crisis whose effects reach far beyond the medical issues associated with the disease. Racial and xenophobic propaganda about the illness promoted on social media platforms such as Facebook and Twitter and at campaign rallies by former President Trump has spurred a dramatic increase in anti-immigrant sentiments toward Asian Americans. The polarizing effects of the Administration’s anti-Asian rhetoric have become a battle cry that has given renewed …

European Approaches To Stopping Islamophobia Are Inadequate: Lessons For Canadians Combating Anti-Muslim Racism And Hatred, Hassina Alizai
Journal of Hate Studies
The United Kingdom, France, and Spain have in common a large and growing Muslim population. The influx of immigrants and refugees has left many European states fearful of Muslim migrants because they perceive potential increases in terrorism and job insecurity, which would have significant social and economic policy implications. European governments have sought to strengthen security measures and immigration laws, often with consequences that disproportionately and negatively affect Muslims. At the same time, European governments have increased their efforts to address Islamophobia and improve Muslim integration, partly in response to the growth in the reporting of anti-Muslim hate crimes. Each …
