Regulation-Making: The Creative Opportunities Of The Inevitable, Harry W. Arthurs Jan 1970

Regulation-Making: The Creative Opportunities Of The Inevitable, Harry W. Arthurs

Articles & Book Chapters

The lawmaking process has diffused substantially in the past years, resulting in an increasing maze of departmental subordinate legislation. This phenomenon has not been accompanied by a parallel development of controls resulting in complaints about "bureaucracy", red-tape, inaccessability, and poor draftsmanship, and in demands for review and control. Professor Arthurs recognizes the practical inevitability of the system, but discusses the present situation critically, suggesting reforms which might help to make the regulatory process more compatible with "participatory democracy".

Scholarship On Soviet Family Law In Perspective, Whitmore Gray Jan 1970

Scholarship On Soviet Family Law In Perspective, Whitmore Gray

Articles

The radical changes in the norms of Soviet family law over the past fifty years have reflected the convulsions of Soviet society as well as the revisions of Marxism-Leninism-Stalinism. This paper is a commentary on the writing in this field by Americans in particular, and by other non-Soviets in general. In view of the volume of writing in this field, it has been necessary to limit discussion in the text to a few representative articles illustrating a few of the subject matters treated and various typical approaches employed. The topic is a particularly timely one, for new, comprehensive Principles of …

On Lawful Governments, Joseph Raz Jan 1970

On Lawful Governments, Joseph Raz

Faculty Scholarship

What is the meaning of sentences of the form 'X is the lawful government of the country Y,' and what kinds of statements are normally -made by using them? Most answers to these questions can be classified as legalistic, moralistic, or compromise solutions. The gist of the legalistic approach is that the lawful government is that authorized by the positive law of the land. Critics of the legalistic approach point out that disagreement about the lawful government is not always solved when agreement is reached about the positive law of the land. For example, two people may disagree as to …

The Generality Of Neutral Principles: A Game-Theoretic Perspective, Robert L. Birmingham Jan 1970

The Generality Of Neutral Principles: A Game-Theoretic Perspective, Robert L. Birmingham

Articles by Maurer Faculty

Eleven years ago Professor Wechsler first argued that constitutional adjudication should be based on neutral principles of general applicability that transcend the factual contexts of the cases in which they are announced. Since that time, legal scholars have been engaged in a continuing debate over both the meaning and the validity of Wechsler's thesis. Professor Birmingham adds a new perspective to this debate by analyzing neutrality and generality in terms of game theory.

Constitutional Limitations On Firearms Regulation Aug 1969

Constitutional Limitations On Firearms Regulation

Duke Law Journal

The constitutional debate over firearms regulation is centered on the requirements of the fifth and second amendments to the United States Constitution. In discussing the questions that will confront any federal regulatory scheme, this note examines recent fifth amendment decisions and explores the origins of the second amendment, which has been infrequently interpreted. It is concluded that while artfully drawn legislation could avoid the fifth amendment objections posed by Haynes v. United States, the impact of the second amendment is uncertain because of the historical and decisional ambiguity surrounding that provision.

The Legal Problems Of The Rural Poor Jun 1969

The Legal Problems Of The Rural Poor

Duke Law Journal

"Providing equal justice for poor and rich, weak and powerful alike is an age-old problem. People have never ceased to hope and strive to move closer to that goal." Griffin v. Illinois, 351 U. S. 12, 16 (1956). The Duke Law Journal presents this report of its survey study of the legal problems of the rural poor. It is an attempt initially to lend some insight into the kinds of problems, the methods of resolution, the utilization of services, and the perception of legal or other remedies common to the rural poverty group. The second phase of the study is …

The Voiceprint Technique: Its Structure And Reliability, Bernard S. Kamine May 1969

The Voiceprint Technique: Its Structure And Reliability, Bernard S. Kamine

San Diego Law Review

Identification of individuals by the sound of their voices has long been an accepted courtroom practice. It has been accompanied directly both in the courtroom and extra-judicially, as well as indirectly with sound recordings. Voice identifications are essential to authenticating sound recordings for introduction as evidence, and are frequently the most conclusive evidence in certain types of criminal prosecutions such as those involving obscene phone calls. Until recently all voice identifications were made by the human ear, by someone familiar with the sound of the voice being identified. Although generally accepted by the courts, it has been recognized that such …

Jones V. Alfred H. Mayer Co.: Judicial Activism Run Riot, Sam J. Ervin, Jr.

Vanderbilt Law Review

Those who make it their business to follow closely the work of the Supreme Court have noticed its tendency to save the most controversial decisions of the term for the last days in June, just before the Court recesses for the summer. One sometimes gets the impression that the Justices wish to be far away from the summer storms produced by these decisions, returning to Washington in the quieter days of the fall. Thus it was not surprising that the Court saved its decision in Jones v. Alfred H. Mayer Co. until June 17, 1968, and then promptly left town. …

Vietnam And Public International Law, Anthony D'Amato Jan 1969

Vietnam And Public International Law, Anthony D'Amato

Faculty Working Papers

With each international crisis inevitably come the selfstyled "realists" proclaiming that there is no such thing as public international law. The Vietnam war is no exception, although here, due to the unusual complexity of the facts and the controversy over the applicable rules of international law, many of the published replies to the "realist's" positions have themselves been insubstantial and unconvincing. Let us look first, briefly, at the arguments of one of the realists, and then, with equal brevity, at some of the counterclaims. The remainder of this comment will be addressed to the larger issues involved and some suggested …
