Dictionary of Legal Abbreviations Used in American Law Books by Doris Bieber

The proliferation of legal sources and abbreviations poses two related problems--first, the need for standardized citation forms, and second, the need for guides to commonly used abbreviations. The first problem has been difficult to solve, and universal acceptance of standard citations is unlikely to be achieved. A Uniform System of Citation, published by the Harvard Law Review Association, in collaboration with the Columbia Law Review, the University of Pennsylvania Law Review, and the Yale Law Journal, has attained wide acceptance and has become the authoritative guide for legal citations …

Regulation Of Programming Content To Protect Children After Pacifica, Dabney E. Bragg Nov 1979

Regulation Of Programming Content To Protect Children After Pacifica, Dabney E. Bragg

Vanderbilt Law Review

This Note examines the "protect the children" rationale as justification for the regulation of program content to determine if it is likely to withstand future challenges. Initially, the Note reviews the Pacifica decisions to illustrate how the rationale recently has been employed. The Note then considers this rationale in light of traditional first amendment analysis and the interface of that analysis with the rights of children, concluding that the rationale does not justify abridgment of the first amendment. The Note then considers the effect of broadcasting's "unique characteristics" upon this analysis, concluding that this added element does not tip the …

Regulation Of Indecency In Political Broadcasting, Jonathan Golomb Oct 1979

Regulation Of Indecency In Political Broadcasting, Jonathan Golomb

University of Michigan Journal of Law Reform

The article considers both the constitutional and statutory aspects of the regulation of indecency in political broadcasting. The discussion is limited to considering "indecency," a term excluding obscenity or incitement to violence, because the government's power to regulate these types of speech is well established. Indecent speech would be protected if used in the print media, since it does not fall within the established First Amendment exceptions. The basic constitutional question, therefore, is whether the broadcast media are inherently different from the print media, so as to justify different treatment of indecent political speech. This article will contend that they …

The Antitrust Consequences Of Manufacturer-Suggested Retail Prices—The Case For Presumptive Illegality, William R. Andersen Oct 1979

The Antitrust Consequences Of Manufacturer-Suggested Retail Prices—The Case For Presumptive Illegality, William R. Andersen

Washington Law Review

A manufacturer's suggestion of resale prices to dealers is an example of price-affecting conduct which is said to create no antitrust liability despite the fact that liability would result from identical conduct if the parties were horizontally related. This article argues that permitting parties to tamper with the price term in any fashion risks contravention of the policies behind the antitrust laws, and that making the antitrust consequence turn on whether the parties appear to be related vertically or horizontally is not an intelligible way of minimizing that risk. In conclusion it is recommended that suggested prices should be presumptively …

Union Grievance alleging improper filling of job vacancy.

In the summer of 1978, Watters and Miller, traffic agents in Saint John, New Brunswick, applied for inter-base transfers to Montreal. That autumn a permanent vacancy occurred for which both Ms. Miller and Mr. Watters met all requirements except, possibly, the language requirement. Both were given a "test" by the employer and, in the result, neither was given the transfer re-quested. According to Watters' testimony, Ms. Miller initiated the grievance now before me but, as Watters put it, "it was explained to her [presumably by the union] that it would go in …

A Sense Of Proportion And A Sense Of Priorities: Reflections On The Report Of The Task Force On Canadian Unity, J. Stefan Dupré, Paul C. Weiler

Articles & Book Chapters

The elegantly written Report of the Task Force on Canadian Unity is the most recent product of our constitutional reform industry. In many respects it is the most impressive. It deserves attention if for no other reason than the make-up of the group which produced it. The Task Force was composed of both men and women, politicians and scholars, persons with experience in the business community and in the union movement, and representatives of each of our far-flung regions. Its co-chairmen, Jean-Luc Pepin and John Robarts, are two of the most experienced and respected public figures in Canada. The Commissioners …

Taiwan Relations Act: Legislative Re-Recognition, Carl I. Gable Jun 1979

Taiwan Relations Act: Legislative Re-Recognition, Carl I. Gable

Vanderbilt Journal of Transnational Law

The surprise and drama of President Carter's recognition of the People's Republic of China as "the sole legal government of China" have overshadowed the unique legal concepts on which his policy rests. Those concepts impact directly on private trade and investment transactions with Taiwan. They may also sound the death knell for traditional definitions of the term "recognition" in international law and diplomacy.

The recognition of a government such as the People's Republic of China (and the related termination of recognition of the Republic of China government) is a unique hybrid: a political act of the executive branch which directly …

Professor Richards' Unwritten Constitution Of Human Rights: Some Preliminary Observations, Richard B. Saphire May 1979

Professor Richards' Unwritten Constitution Of Human Rights: Some Preliminary Observations, Richard B. Saphire

University of Dayton Law Review

The relationship of moral philosophy to the understanding and development of constitutional law has, until recently, been a relatively neglected issue. Although less evident in contemporary cases in the United States Supreme Court, scholarly attention to the congruence of moral inquiry with the articulation of constitutional values has become more frequent and intense in recent years. Clearly, the moral analysis of constitutional values is often demanding for the lawyer and judge. But even though the use of moral reasoning and adaptation of the values it describes and reveals to constitutional cases is not uncontroversial, it is an inevitable aspect of …

The United States Tax Court-Should Discovery Be Expanded?, William H. Newton Iii

University of Miami Law Review

This article examines the methods and scope of discovery available to the taxpayer involved in tax litigation in the Tax Court, the Court of Claims and the federal district courts. After finding that discovery in the Tax Court is significantly more restricted than in the other two available forums, the author reviews the results of a recent survey of tax practitioners' views of discovery in that court and concludes that expansion is necessary.
