Comparative Constitutional Law: Casebooks For A Developing Discipline, Donald P. Kommers
Comparative Constitutional Law: Casebooks For A Developing Discipline, Donald P. Kommers
Journal Articles
Comparative constitutional law is a developing area of legal scholarship. One sign of this development is the recent appearance of two casebooks, both published in 1979. Comparative Constitutional Law: Cases and Materials by Mauro Cappelletti and William Cohen, focuses primarily on the procedural rights of defendants from the United States and nine European jurisdictions. Comparative Constitutional Law. Cases and Commentaries by Walter F. Murphy and Joseph Tanenhaus, examines the constitutional interpretation of a large number of substantive issues in six contemporary constitutional democracies. Reviewing the two books together provides an opportunity not only to compare them as teaching tools but …

Embedding Policy Statements In Statutes: A Comparative Perspective On The Genesis Of A New Public Law Jurisprudence, R. Grant Hammond
UC Law SF International Law Review
Despite the recent development of embedding policy statements or declarations into statutes, there has been a lack of general commentary on this technique of formulating legislation. This Article draws attention to this development and analyzes its potential significance. By examining some examples in the United States, Canada, and New Zealand, the author attempts to demonstrate how the technique may be a functional vehicle for a large-scale declaration of legislative and public policy objectives.

Rejecting The Theism Test In England And The United States In Property Tax Exemption Cases, John E. Jenkins
Fordham International Law Journal
This Note will examine the tax exemption for property used in religious worship in its English and American settings. Analysis of the scope of the exemption in England will review the history of the exemption and its present application. The discussion of the exemption in the United States will focus on constitutional considerations. The theism test will also be considered in light of the principles underlying the exemption in both countries. The Note will conclude by recommending the analogy test for both England and the United States as an alternative to the theism test.

Legal Aid For The Poor: A Conceptual Analysis, Marshall J. Breger
Legal Aid For The Poor: A Conceptual Analysis, Marshall J. Breger
Scholarly Articles
In this Article Professor Breger examines the competing justifications that have been advanced for the provision of free legal aid to those who cannot afford to engage a private attorney. Professor Breger argues that every citizen has the right to effective access to the courts to resolve disputes in that they aret he only state-sanctionedd ispute resolution mechanism. Because of the complexity of our legal system, effective access to the courts often requires the services of an attorney.
