Procedures For Meetings And Organizations, Innis Christie Jun 1956

Procedures For Meetings And Organizations, Innis Christie

Dalhousie Law Journal

Why would an academic psychologist and an academic engineer write a book about "how to set up organizations" and run their meetings? The authors do not answer that question in their preface so we are free to speculate that this is their escape from the "meeting madness" that threatens every academic. They have attempted not only to bring some order into that omnipresent aspect of their own lives but also to share the fruits of their efforts with the rest of us in this very fine handbook.

Comparative Legal Research, Some Remarks On "Looking Out Of The Cave", Hessel E. Yntema May 1956

Comparative Legal Research, Some Remarks On "Looking Out Of The Cave", Hessel E. Yntema

Michigan Law Review

Despite this risk and without limiting discussion of comparative legal research to a Platonic theory of knowledge-to which I for one would not accede-the text prompts first the inquiry, unavoidable in a constructive discussion of the matter, whether contemporary legal study in the United States is concerned with shadows in an intellectual cave-or in other words, whether it is true, as I was told years ago, partly perhaps in jest, by a late distinguished member of the Supreme Court, then Attorney General, when, encountering me on a visit to the Department of Justice, he kindly asked what I was looking …

Our Inadequate Attorneys' Lien Statutes—A Suggestion, George Neff Stevens Mar 1956

Our Inadequate Attorneys' Lien Statutes—A Suggestion, George Neff Stevens

Washington Law Review

The average attorney has little interest in, nor does he realize the inadequacy of, the attorney's lien laws of his state—until he finds himself personally involved. Yet, a glance at the law reviews and pertinent cases indicates that the organized bar and its individual members should show more than a casual interest in the number and variety of problems arising in this field.

Practice Of Taxation: Accountants Vs. Attorneys, Orville J. Weaver Jan 1956

Practice Of Taxation: Accountants Vs. Attorneys, Orville J. Weaver

Cleveland State Law Review

What constitutes the illegal or unauthorized practice of law by accountants in their tax practice? The popular conception of the practice of law is the appearance in courts by attorneys. This may be a very small part of the average attorney's law practice. he spends most of his time in determining his clients' legal problems other than in court. So the unauthorized practice of law concerns itself with activities of persons, other than lawyers, who give legal advice to clients in connection with the practice of their professions. Accountants have prepared federal income tax returns, and returns for various state …

Unauthorized Practice Of Law In Washington, Phillip Offenbacker Aug 1955

Unauthorized Practice Of Law In Washington, Phillip Offenbacker

Washington Law Review

Unauthorized practice of law is practice by one who has not been admitted to practice by the supreme court and who is not a member in good standing of the state bar association. It is now undisputed that the supreme court has sole jurisdiction over admission to practice and apparently may deal with unauthorized practice as an incident of its power over admission. However, unauthorized practice has also been the subject of legislative enactment. It follows, therefore, that the sanctions which are imposed to prevent the unauthorized practice of law in this state are of both judicial and legislative creation. …

Antitrust Administration And Enforcement, John T. Chadwell Jun 1955

Antitrust Administration And Enforcement, John T. Chadwell

Michigan Law Review

The importance of the nation's antitrust policy requires that administration and enforcement powers and techniques be equal to the huge task of effectively safeguarding competition. The recommendations of the Attorney General's Committee represent a statesmanlike effort to balance the need for effective enforcement with the need for the preservation of fairness and the conservation of time and resources in antitrust litigation. Some of the recommendations will undoubtedly engender heated controversy; others seem relatively uncontroversial.

Many individual topics are dealt with in the Report of the committee and space does not permit comment upon all of them. The following discussion is …

The Merit System -- An Essential Of Good Government, Murray Seasongood Jun 1955

The Merit System -- An Essential Of Good Government, Murray Seasongood

Vanderbilt Law Review

Burke, in the trial of Warren Hastings, observed, "Law and arbitrary power are in eternal enmity." The same irreconcilable conflict exists, in this country, between professional politicians and sponsors of the merit system. This is because the aims of the two camps are completely antagonistic. In no other place where the two party system obtains, is the filling of offices and positions on the basis of vote-getting service and strength and political contributions made or secured for the party,so predominant a part of political activity. Patronage is the backbone in the United States of the political parties in federal, state …
