Unauthorized Practice Of Law: Bank Prohibited From Providing Estate Analysis Service
Unauthorized Practice Of Law: Bank Prohibited From Providing Estate Analysis Service
Duke Law Journal
The Ohio Supreme Court enjoined a national bank from providing "estate analysis" reports to prospective customers on the ground that this program involved the giving of legal advice by a lay institution. The decision affords salutary protection to the relevant public and professional interests which underlie the prohibition against the unauthorized practice of law.

The Uniform Trustee's Powers Act And The Basic Principles Of Fiduciary Responsibility, Robert W. Hallgring
The Uniform Trustee's Powers Act And The Basic Principles Of Fiduciary Responsibility, Robert W. Hallgring
Washington Law Review
Professor Hallgring presents a detailed analysis of the proposed Uniform Trustees' Powers Act's impact on the fiduciary duties of loyalty, care, and non-delegation of discretionary powers. He emphasizes serious downgrading of fiduciary responsibility implicit in several provisions of the proposed act, particularly in the modern context of the large corporate fiduciary. Professor Hallgring concludes that, although many provisions of the act have merit, it does not sufficiently protect the beneficiary as presently drafted. He suggests, however, that amendments strengthening the standards of fiduciary responsibility could be incorporated into the act without destroying the benefits sought by its framers.

Toward A Restatement Of Professional Ethics, William F. Swindler
Toward A Restatement Of Professional Ethics, William F. Swindler
Faculty Publications
The attitude of the courts and the practitioners is in a state of change, recognizing instances where group-practice is necessary and proper. Professor Swindler asserts that the Canons of Ethics must be revised to indicate the acceptance by the legal profession of such group-practice, particularly if the indigent and low-income client is to be served properly. Suggested revisions to the applicable Canons reflect the author's opinion.
The Procedure Before The Court Of Justice Of The European Communities, Peter E. Herzog
The Procedure Before The Court Of Justice Of The European Communities, Peter E. Herzog
Washington Law Review
The Court of Justice of the European Communities has inspired much legal writing, including many books and articles in English. Particular attention has been paid to its jurisdiction and general organization, much less to its procedure. But Professor Sereni has pointed out that differences in the domestic procedural laws of states appearing before an international court may cause difficulties in the work of the international tribunal itself. It therefore may be of interest to review briefly some aspects of the procedure of a court which is perhaps not an international tribunal in the strict sense of the word, but in …

As will be evident by the time this symposium on consumer protection appears in print, not all the proposals that have been made on behalf of the consumer will pass this year; some, perhaps, will never be enacted in anything like their present form. However, both opponents and proponents of this spate of legislative proposals should recognize the timeliness and importance of the discussions presented in this issue of the Michigan Law Review.

Two’S Company, John S. Bradway
Two’S Company, John S. Bradway
Duke Law Journal
This is an article which all lawyers should read. Its immediate concern is with legal services for the poor, but its thrust goes far beyond the immediate problem; indeed, its true emphasis concerns a fundamental evaluation of the legal profession and its place in our society. To state that it is thought-provoking is to give it little credit. The author is a man whose experience in the field spans almost half a century. The reader may disagree with the conclusions reached, but he must pay deference to the sincerity and sagacity of the views which it expresses.
Off-The-Record Consultations And The Revised Model State Administrative Procedure Act, John H. Martin
Off-The-Record Consultations And The Revised Model State Administrative Procedure Act, John H. Martin
Michigan Law Review
The drafters of the Revised Act have sought to resolve the confrontation of policy objectives in part by insisting that the decision maker refrain from off-the-record communications with any of the parties to the proceeding. However, there are a number of ambiguities in the act which indicate that it may be possible for state agencies to avoid this objective. Furthermore, implementation of the policy decisions of the drafters may prove to be undesirable for the overall operation of state administrative agencies. This comment will consider these two possible criticisms of the Revised Model Act and will suggest that changes be …
