Pathways For Future Justice, Honorable Ben F. Overton
Pathways For Future Justice, Honorable Ben F. Overton
Nova Law Review
Our judicial system is said to be in a state of crisis. Courts across the entire United States are being asked to absorb increased court work; the judiciary is losing its attractiveness for outstanding lawyers; and the public continues to be uninformed about the legal system.
Implied Warranty Of Habitability In Pennsylvania, William S. Jacoby
Implied Warranty Of Habitability In Pennsylvania, William S. Jacoby
Duquesne Law Review
Following the trend of other states, Pennsylvania is on the verge of adopting the implied warranty of habitability. The comment examines the current status of the warranty, and suggests that the warranty might become counter-productive. It concludes that legislative action is most appropriate, and that a synthesis of two bills pending in the Pennsylvania legislature would be desirable.

Accident And Malpractice Liability Of Professional Corporation Shareholders, Richard Tunis Prins
Accident And Malpractice Liability Of Professional Corporation Shareholders, Richard Tunis Prins
University of Michigan Journal of Law Reform
Part I of this note describes the various tort liability provisions found in the professional corporation acts, focusing particularly on the recently published Model Professional Corporation Supplement. Part II compares how effectively these alternatives accomplish the goals of accident law in the professional corporation setting. The inability of the preferred model provision to alleviate the malpractice problem in any way as well as proposals for reinvigoration of the professional corporation act concept are discussed in Part III.

The Future Of Evidence Law: Or, Some Prophecies About Proof, John W. Reed
The Future Of Evidence Law: Or, Some Prophecies About Proof, John W. Reed
Other Publications
I am honored to participate in this seminar that is part of the celebration surrounding the dedication of Colorado's new State Judicial Building. But that feeling of honor is tempered by an awareness of the responsibility and perils of the role I have been asked to play. With the assignment, "The Future of Evidence Law," I have been asked to play the prophet, to be a seer of sorts, and to suggest what rules and principles will govern proof at trials at some date in the future. Exactly what date was not specified in the invitation-a decade, perhaps? A generation? …
Legal Ethics And The Government Lawyer, Eric Schnapper
Legal Ethics And The Government Lawyer, Eric Schnapper
Articles
All litigation presents to some degree, real though not always perceived, a conflict between each attorney's responsibility as a representative of his or her client and as an officer of the court. Winning the case and seeing that justice is done must be inconsistent goals for counsel on at least one side in a case, if not on both. However substantial this problem may be regarded, it is certainly more complex for counsel for the government. Unlike a private attorney subject to dismissal for ignoring a client's wishes, counsel for the government often has, subject to the variables of intragovernmental …
Conflict Of Interest, Robert H. Aronson
Conflict Of Interest, Robert H. Aronson
Articles
The purpose of this article is to indicate situations in which conflict of interest problems most commonly arise and to suggest principles for avoiding such situations or resolving unavoidable conflicts. Part One presents an overview of the subject, with a discussion of general principles underlying conflict of interest problems. Part Two applies these general' principles to a number of frequently encountered problem areas. Throughout the discussion, the author approaches problem situations with a cautious eye. Not every court or grievance committee would impose discipline or invalidate a transaction for all the conflicts scrutinized herein; nevertheless, the possibility of such measures …

Monrad Paulsen: An Affectionate Appreciation, Michael I. Sovern
Faculty Scholarship
I have been an admirer of Monrad Paulsen since my first days as his junior colleague at the University of Minnesota Law School back in 1955. In retrospect, I recognize that my view of what makes a great law professor was profoundly influenced by the qualities I saw, and respected, in Monrad. For me, they began with collegiality – a personal interest in and a professional commitment to the welfare of the new boy. That first year at Minnesota was an enormously happy and productive apprenticeship for me, and Monrad helped make it so.

Community Legal Workers At Parkdale Community Legal Services October 1977, Katie Mcgovern, Frederick H. Zemans
Community Legal Workers At Parkdale Community Legal Services October 1977, Katie Mcgovern, Frederick H. Zemans
Books
Since its opening in September 1971, Parkdale Community Legal Services has served as both a neighbourhood law office and as Osgoode Hall Law School's first clinical training setting. Law students have been the primary deliverers of legal.services, with a growing number of staff lawyers, articling students, and practitioners supervising the student caseload. But most law students spend only one semester at Parkdale; therefore the staff lawyers and especially the community legal workers must provide continuity within the office and serve as the conduit to the Parkdale community.
Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Law Faculty Articles and Essays
This Commentary rests on five premises. The first is that it is both possible and necessary to understand clinical legal education as a general instructional method. The second is that all legal educators must be more willing to reexamine and clarify the purposes of legal education and to engage in discussion about the primary educational goals to be served. The third premise is that different educational methods possess distinct capabilities for the attainment of specific educational goals and that certain applications of the clinical method are manifestly superior vehicles to facilitate learning in the area of "professional responsibility." The fourth …
Practical Skills In The Law School Curriculum, Richard L. Braun
Practical Skills In The Law School Curriculum, Richard L. Braun
University of Dayton Law Review
Response to address by Rex E. Lee. Introduction:
It is beyond dispute that the past decade has witnessed a great deal of ferment in the field of legal education. The size of law schools, their standards, their curricula, relations between dean and faculty, student power and the importance of training in practical skills compared with theoretical knowledge of the law are a few of the subjects that have involved legal academe, as well as bench and bar, in controversy. Among these issues, that of practical versus theoretical training is one of the most important, and one that merits extensive discussion …

The First-Year Courses: What's There And What's Not, David L. Chambers
Book Chapters
For many of you, law school will be a full-time occupation for three school years; for others, a second job squeezed in at night over four or five years. Whatever your route to a degree, whatever sort of law school you attend, the beginnings of law school are likely to be much the same. You will face initially a set of required courses that will probably bear the same titles as the titles of our next six chapters: Civil Procedure, Contracts, Criminal Law, Property, Torts and Constitutional Law. The six are likely to be taught in ways that resemble each …
