Reassessing Law Schooling: The Sterling Forest Group, Thomas L. Shaffer
Journal Articles
This Article is the result of a weekend in December 1976 at the Sterling Forest Conference Center. Several legal educators came together there to explore the possible relevance of humanistic educational psychology to legal education, and the pieces that follow flow from the experiences in learning we shared there. The concerns that brought the ten of us together were not new; rather, they emanated from a longstanding challenge within the profession.
Although we taught at different institutions and in different fields, our experiences had led us to a common dissatisfaction with legal education and a hope that more was possible. …

Clinical Education-A Golden Dancer?, W. Wade Beryyhill
University of Richmond Law Review
Before any revealing analysis of clinical education can take place, it is necessary, as well as helpful, to look briefly at the history and criticisms of legal education which spawned the emphasis in clinical programs. These efforts will be followed by an analysis of the recent clinical movement. The most predominant American law school programs generally termed "clinical" experience will be identified, described and critiqued. Section four of this article discusses the results of the author's survey QUESTIONNAIRE: Classroom Teaching Techniques and Programsof ClinicalEducation.Deans, or clinical faculty members if the law school had an ongoing clinical program, plus certain law …

Lawyers, Privileged Communications, And The Foreign Agents Registration Act Of 1938, Phyllis K. Fong
Lawyers, Privileged Communications, And The Foreign Agents Registration Act Of 1938, Phyllis K. Fong
Vanderbilt Journal of Transnational Law
Originally enacted to control the spread of subversive propaganda during World War I, the Foreign Agents Registration Act of 1938 (Act) now regulates the conduct of lobbyists, public relations counsellors, attorneys, and other agents acting on behalf of foreign entities. The Act no longer prohibits dissemination of political propaganda, but requires that foreign agents register and disclose the nature and extent of all activities conducted pursuant to the agency agreement, on the assumption that adequate disclosure and publicity of agents' activities will make it impossible for foreign agents to take advantage of an unwary public. Congress has imposed, moreover, penal …

Prisoner's Rights -- Failure To Provide Adequate Law Libraries Denies Inmates' Right Of Access To The Courts, Irma S. Russell
Faculty Law Review Articles
This article examines the Supreme Court's decision in Bounds v. Smith and the movement toward recognition of the rights that prisoners retain after incarceration.
Part I outlines the nature and legal foundation of the right of access to the courts as endorsed by Bounds. Part II examines questions raised by the dissenting opinions concerning the scope and validity of the right. Part III addresses the practical implication of the decision and concludes that the right of state and federal prisoners to access legal information in preparing legal papers stands on firmer ground after this decision.
The Ideology Of Advocacy: Procedural Justice And Professional Ethics, William H. Simon
The Ideology Of Advocacy: Procedural Justice And Professional Ethics, William H. Simon
Faculty Scholarship
Conventional morality frowns at the ethics of advocacy. Public opinion disapproves of what it considers the lawyer's most characteristic activities. Popular culture can reconcile itself to him only by pretending that all his clients are virtuous. The lawyer's response takes the form of a dialectic of cynicism and naiveté. On one hand, he sees his more degrading activities as licensed by a fundamental amorality lying beneath conventional morality. On the other hand, he sees his more heartening ones as serving an institutional justice higher than conventional morality. The two moods divide the profession as a whole, and the division can …
Judicial Overload: The Reasons And The Remedies , Maria Marcus
Judicial Overload: The Reasons And The Remedies , Maria Marcus
Faculty Scholarship
Animosity towards lawyers, perennial in our social history long before Watergate, parallels a contradictory and equally persistent belief in judges as problem-solvers for a variety of personal, economic, educational and political ills. An increasing number of litigants are bringing to the courts not only the class of disputes that has been the traditional fare of judicial decision-making, but also an array of issues that were formerly resolved in private meetings, at hospitals, in schools, or at home. The causes of this explosion of lawsuits and the possible buffers to an eventual implosion in our judicial system will be discussed below
