Advocacy As Moral Discourse, Thomas L. Shaffer
Advocacy As Moral Discourse, Thomas L. Shaffer
Journal Articles
Advocacy at its best is a form of reconciliation. It reconciles the advocate with those whose champion he proposes to be. It reconciles the advocate with his hearers. It reconciles the person whose cause is advocated with the persons who hear advocacy. It brings to community life a new sense of the interests of those the community neglects. It seeks to make things better. It is moral discourse.
This article will examine advocacy in two contexts. The first is advocacy to an institution, conducted in the name of justice or the welfare of the community; one might call this first …

Review Of The Legal Needs Of The Public, , Richard Lempert
Review Of The Legal Needs Of The Public, , Richard Lempert
Reviews
Both the title, The Legal, Needs of the Public, and the subtitle, The Final, Report of a National, Survey, of this volume are, quite fortunately, inapt. The report does not seek to quantify the legal needs of the public or to determine whether "needs" are being "met," and we are told by both Barbara Curran in her preface and Spencer Kimball in his foreword that this "final report" signifies the beginning and not the end of data analysis. This study (which I shall call the ABF study) is a joint undertaking of the American Bar Association Special Committee to Survey …

United Brands Company V. Commission Of The European Communities: Window To Price Discrimination Law In The European Economic Community, Margaret H. Fitzpatrick
Northwestern Journal of International Law & Business
Enterprises operating within the European Economic Community have long faced the difficult task of ascertaining whether they are subject to the price discrimination restrictions of the Treaty of Rome. The difficulty stems from the ambiguity present in the Treaty provisions and is exacerbated by the lack of authoritative interpretation of their restrictions. However, a recent opinion of the European Communities' Court of Justice, United Brands Co. v. Commission of the European Communities, has brought the contours of the price discrimination prohibition into sharper focus.
Reconciling National Interests In The Regulation Of International Business, Stanley J. Marcuss, Dale P. Butland
Reconciling National Interests In The Regulation Of International Business, Stanley J. Marcuss, Dale P. Butland
Northwestern Journal of International Law & Business
In an increasingly integrated world where political and economic issues are deeply intertwined, the regulation of international business activity raises complex problems in international law. The existence of the multinational corporation, which is possessed of multiple identities and therefore subject to the jurisdiction of both "home" nations, where it is headquartered, and "host" nations, where its subsidiaries are located, makes the potentiality of jurisdictional disputes among nations particularly acute. While attempts to apply United States law to American foreign subsidiaries virtually ensures conflicts among jurisdictions, excusing subsidiaries from compliance with domestic law could seriously undermine comprehensive regulatory activity. It could …

The Federal Ministry Of Justice As Government's Legal Adviser To The Ministry Of External Affairs In Nigeria, Niki Tobi
Dalhousie Law Journal
Before the establishment of the Federal Ministry of Justice, there was in existence the Colonial Legal Department which was headed by a Britain. He was the Registrar and Taxing Master of the then Supreme Court between 1863 and 1901. In addition to this duty, he functioned both as the Queen's Advocate and the Queen's Proctor. The exact date in which the office of the Attorney-General was created is not known but there is evidence that it was created during the era of Lord Lugard. The first incumbent of the office of the Attorney-General was Sir Donald Kingdon who was in …

Some Aspects Of Abuse Of Dominant Positions In European Community Antitrust Law, John Temple Lang
Some Aspects Of Abuse Of Dominant Positions In European Community Antitrust Law, John Temple Lang
Fordham International Law Journal
This article starts by looking at Article 86 of the ECC Treaty governing antitrust violations and the significance of "dominant position" in applying the Rule. The author then explains how in light of United Brands v. Commission, a Court of Justice of the European Communities Court, evidence of dominance may be classified in four categories. Next, the author explains the different types of abuses under Article 86. Finally, the author draws four conclusions. First, the contrast drawn by various authors between the EEC law, which prohibits abuse of a dominant position, and U.S. law, which forbids "monopolisation", is exaggerated and …

University of Richmond Law Review
This Comment focuses on the confidential communication privileges recognized under federal and Virginia law. Discussion includes an examination of various trends or approaches which recent federal decisions have taken in applying rule 501. Finally, specific privileges which have been recognized by federal courts and specific privileges recognized under Virginia law are enumerated.
Outpatient Mental Health Care Services - A Minor's Right, John V. Cogbill Iii
Outpatient Mental Health Care Services - A Minor's Right, John V. Cogbill Iii
University of Richmond Law Review
The 1979 Session of the General Assembly made important changes in Title 54 of the Code of Virginia pertaining to health care for minors. One of the principal changes involved the right of unemancipated minors to seek outpatient treatment for mental health problems without the consent of their parents. Additionally, lawmakers deleted the criminal sanctions imposed against medical practitioners who performed authorized abortions on consenting minors. This bill appears to bring into Virginia a partial realization of a child's right to due process and equal protection under the law.
The History Of Legal Education In Virginia, William Hamilton Bryson
The History Of Legal Education In Virginia, William Hamilton Bryson
Law Faculty Publications
Many methods of legal education have been used over the years. Each has its strengths and its weaknesses. The study of the past is instructive and useful in showing both the good and bad goals and methods. We must cultivate the good and uproot the bad. This study suggests that there has always been progress, slow but constant improvement. The teaching of law is vital to the administration of justice, a noble cause. The continuing challenge is ever to strive for the improvement thereof.
