When William B. Lockhart resigned from the deanship of the University of Minnesota Law School in June 1972, a productive sixteen-year tenure came to an end. Guided in the early years by the recommendations of the 1955 Law School Self-Survey, Lockhart and his faculty achieved significant success in improving the school's relationship with the bar, in revitalizing the educational program, in improving the quality of the student body, and in maintaining the quality of the faculty. In the later years of his tenure, the law school successfully responded, under Lockhart's leadership, to a variety of challenges presented in the turbulence …

European Analogues To The Class Action: Group Action In France And Germany, William B. Fisch Jan 1979

European Analogues To The Class Action: Group Action In France And Germany, William B. Fisch

Faculty Publications

For the civil proceduralist in the United States the most perplexing problems of recent years have been presented by claims of large numbers of persons against large economic interests. A single error in manufacturing design can cause a relatively small injury to each of a large number of consumers; a misrepresentation in national advertising for such goods can have similar consequences; the polluting effects of a single enterprise can be dispersed among a large neighboring population. The result is that the stake of each potential claimant in the outcome of the litigation can be greatly outweighed by the magnitude of …

Status Of Student Practice Rules People V. Perez—An Initial Look At The Sixth Amendment, Catherine Walker Jan 1979

Status Of Student Practice Rules People V. Perez—An Initial Look At The Sixth Amendment, Catherine Walker

Seattle University Law Review

Despite the advent of the limited practice of law by law students as early as 1957, a California Court of Appeals in 1978 became the first court to examine the sixth amendment status of student representation in state criminal prosecutions. In People v. Perez, a California appellate court concluded that a lawyer-supervised law student, certified for limited practice by the California Student Practice Rules, is per se ineffective counsel in felony trials. Ostensibly to protect the defendant's right to effective counsel, Perez struck down the student practice rules without considering the proper function of certification in sixth amendment analysis. Moreover, …

Regulation Of Employee Welfare Benefit Plans: The Scope Of Erisa's Preemption And The State Power To Regulate Insurance, Molly B. Kenny

University of Dayton Law Review

In 1974 Congress enacted the Employee Retirement Income Security Act, which was hailed as landmark social legislation in the area of pension and welfare plan reform. It has been characterized as the "greatest development in the life of the American worker since social security."

ERISA was enacted to remedy many of the defects and problems associated with employee pension and welfare benefit plans. A primary objective was to strengthen the private employee benefit plan system to provide for the retirement and financial security of employees and their families and, no less importantly, to encourage the growth of this system. Many …

The Clinical Method Of Legal Instruction: Its Theory And Implementation, David R. Barnhizer Jan 1979

The Clinical Method Of Legal Instruction: Its Theory And Implementation, David R. Barnhizer

Law Faculty Articles and Essays

This article assists the process of understanding the clinical methodology by analyzing the following premises. 1. The method of instruction termed "clinical" differs from the Langdellian appellate casebook method in only one respect--the clinical method collects directly experienced legal processes involving a third party (the client) as its core of material studied by the law student while the casebook method utilizes collections of vicariously or indirectly experienced two-dimensional material as its core of learning material. 2. Issues of what specific educational goals are selected by the law teacher, and the techniques of instruction (Socratic, lecture, discussion, videotapes, etc.) are not …
