Jihad, Race And Western Media, Post-September 11, Tagg Jan 2009

Jihad, Race And Western Media, Post-September 11, Tagg

Societies Without Borders

The article examines jihad within what is loosely referred to as “the Western imagination.” Through the analysis of both popular stereotypes and the broader historical context of religious antagonism and (neo)colonialism, the paper discusses both contemporary political rhetoric and a pair of liberal post September-11 political cartoons. While European and North American political leaders have often stereotyped Muslims in order to justify various “axis of evil” bandwagons and further political and economic interests throughout the Islamic Crescent, I argue here that the liberal media's critiques also often rely on fallacious embodied stereotypes. The pervasiveness of such representations has important implications …

Caveat Emptor’S Current Role In Louisiana And Islamic Law: Worlds Apart Yet Surprisingly Close, Andrea Borroni, Charles Tabor

Journal of Civil Law Studies

Caveat emptor is one of the most well known maxims of the legal world. Interpreters from different countries have their own understanding of this doctrine. At first glance, Louisiana law and Islamic law have nothing in common. Louisiana, at least superficially, adheres to the great civil law tradition that the legislature is supreme. Its primary sources of law are legislation and custom. Islamic law is divine in origin, a direct manifestation of Allah’s will. Its primary sources of law are the Koran and the wisdom of the Prophet Muhammad. Yet, in practice, these two systems have developed surprisingly similar approaches …

The desire to keep up with major international players has pushed the Chinese government to overlook whatever human rights abuses may be occurring inside and outside of its borders. China has taken steps to support Sudan despite its use of child soldiers and the genocide in Darfur that has been occurring for years. By criticizing and withdrawing support from President al-Bashir, China could …

Islamic Law And Women's Rights: Questioning The Validity Of The Reservations Invoking Islamic Law To The Convention On The Elimination Of All Forms Of Discrimination Against Women (Cedaw), Malak Khalil

Archived Theses and Dissertations

This thesis will attempt to demonstrate that the reservations invoking Islamic law to the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) are invalid. Reservations to human rights treaties in general are problematic, because these ones not only govern the relationship between States, but they also govern the relationship between the State and its citizens. Thus, finding a balance between state sovereignty, the pillar of international law and the rights of the people remains a challenge in the international arena. Another dimension of the argument is analyzing the validity of claiming Islamic law as a basis …

Manipulating Public Debate: Using The Patriot Act To Keep Out Foreign Scholars, Hasan Z. Mansori Jan 2008

Manipulating Public Debate: Using The Patriot Act To Keep Out Foreign Scholars, Hasan Z. Mansori

St. Thomas Law Review

This paper will argue that the new exclusion provision violates the First Amendment right to receive information and ideas by "blacklisting" foreigners who express disfavored political views. The Bush Administration has routinely utilized its powers to stifle dissent and to manipulate the public debate over political issues. This signifies a reemergence of the system of ideological exclusion prevalent during the Cold War. By preventing foreign scholars, poets, artists, musicians, and others with unique talents and perspectives from entering our borders, the government restricts public access to such views and information in contravention of the First Amendment. First, this paper will …

Justice And Equality In Muslim Family Laws: Challenges, Possibilities, And Strategies For Reform', Zainah Anwar, Jana S. Rumminger

This Article outlines key discriminatory provisions within Malaysia's Islamic Family Law (Federal Territories) Act of 1984 and the efforts being made by Muslim women in Malaysia to advocate for comprehensive reform of Malaysian Muslim family laws. This effort includes developing an understanding of …
