Handicaps Which Threaten Others And The Prohibition Of Discrimination Under The Rehabilitation Act, Stephen L. Mikochik
Handicaps Which Threaten Others And The Prohibition Of Discrimination Under The Rehabilitation Act, Stephen L. Mikochik
Hofstra Labor & Employment Law Journal
This paper explores whether persons whose handicaps constitute a potential threat to others are in any measure protected by federal law from discrimination in employment. After reviewing the evolution of section 504 of the Rehabilitation Act of 1973, the principal federal safeguard for handicapped workers, the author examines whether alcoholics, drug addicts, and carriers of contagious diseases, like Acquired Immune Deficiency Syndrome (hereinafter AIDS), are included within the statute's coverage. He reviews the Supreme Court's 1987 decision in School Board of Nassau County v. Arline which required federally funded employers to explore ways of safely accommodating workers handicapped with infectious …

This paper will focus on the probable impact of AIDS upon family law and family issues in America. Although it is still too early to tell precisely what effect AIDS will have in these areas, it is essential for lawyers and other professionals to begin a dialogue now in order to face the many challenges which lie ahead as the disease continues to spread and impact family relationships.
Among the many subjects discussed below is the likely trend that fear of infection and death will restrict the societal demand and acceptance of new definitions of family. In order to provide …

This Comment assesses the current state of forensic DNA tests and analyzes whether courts should admit the results of these tests as evidence. Section I provides a background discussion of how DNA tests work. This knowledge is essential for attorneys and courts seeking to evaluate expert testimony and analyze important issues concerning the reliability and admissibility of DNA test results. Section I also proposes safeguards and standards to facilitate the judicial acceptance of forensic DNA tests. Disappearances: Towards A Declaration On The Prevention And Punishment Of The Crime Of Enforced Or Involuntary Disappearances, Matthew Lippman
Connecticut Journal of International Law
The term "disappearances" 1 (in Spanish desaparecido or "to have disappeared") was first used to describe the plight of the victims of Latin American death squads in the 1960s.1 It is estimated that 90,000 people have disappeared in Latin America alone over the past two decades3 and, in recent years, the practice has spread to Africa, Asia and the Middle East.
Disappearances have been characterized as "the highest stage of political repression, because [they] immediately hinder[] the application of legal codes established for the defense of personal freedom, physical integrity, human dignity, and life itself." Once an individual is abducted, …

Aids In The Workplace: Termination, Discrimination And The Right To Refuse, J Scott Kenney
Aids In The Workplace: Termination, Discrimination And The Right To Refuse, J Scott Kenney
Dalhousie Law Journal
Not since the days of leprosy has there been a disease so feared and so fatal as AIDS (Acquired Immunodeficiency Syndrome). The lack of knowledge about the disease has merely compounded the problem, so that not only AIDS victims themselves, but also members of perceived "high-risk" groups, face increasing discrimination in all facets of their lives. This paper will focus on only one of these contexts: the workplace. After a review of the current medical knowledge, two principal questions wifl-be examined: (i) What protection does the law give AIDS victims, or members of highrisk groups, against discrimination in employment? (ii) …
The Twentieth-Century Revolution In Family Wealth Transmission, John H. Langbein
The Twentieth-Century Revolution In Family Wealth Transmission, John H. Langbein
Michigan Law Review
The main purpose of this article is to sound a pair of themes about the ways in which these great changes in the nature of wealth have become associated with changes of perhaps comparable magnitude in the timing and in the character of family wealth transmission. My first theme, developed in Part II, concerns human capital. Whereas of old, wealth transmission from parents to children tended to center upon major items of patrimony such as the family farm or the family firm, today for the broad middle classes, wealth transmission centers on a radically different kind of asset: the investment …
