Protections Against Hiv-Based Employment Discrimination In The United States And Australia, Georgeana K. Roussos
Protections Against Hiv-Based Employment Discrimination In The United States And Australia, Georgeana K. Roussos
UC Law SF International Law Review
Much fear and ignorance surround AIDS and other stages of HIV infection. The United States and Australia are representative of many countries where anxieties have given rise to discrimination against individuals with HIV infection. HIV-based employment discrimination is a particularly invidious form of discrimination, robbing individuals of capital and other resources when they are needed most to fight a demoralizing and expensive disease. This Note examines the development of employment law protecting the rights of individuals with HIV disorders from disability-based discrimination. After an initial discussion of the disease's characteristics and its incidence, this Note analyzes the status of the …

Lights, Camera, Actionable Negligence: Transmission Of The Aids Virus During Adult Motion Picture Production, Francisco G. Torres
UC Law SF Communications and Entertainment Journal
Adult motion picture production is an activity in which the risk of HIV transmission is extremely high. Film producers' failure to employ safe sex practices and California legislation prohibiting AIDS testing by employers have combined to create an unsafe working environment for performers. This Note examines the potential liability of producers for transmission of HIV during the production of an adult motion picture. This Note then proposes that California Health and Safety Code section 199.21 be amended to allow adult motion picture producers to use AIDS test results to determine employability of performers.

Women In The Aids Epidemic: A Portrait Of Unmet Needs, Arlene Zarembka, Katherine M. Franke

While rarely a month goes by that the topic of AIDS escapes discussion in the legal literature, a survey of legal publications reveals that the implications of AIDS for women has received scant treatment by legal commentators. Unfortunately, this neglect is not unique to the legal community, but reflects a larger societal disinterest in women with AIDS.
In fact, this epidemic looks quite different from the perspective of women. The medical, social, and legal needs of women affected by AIDS are in many ways needs that preexisted AIDS, but which have been magnified by the threat and implications of HIV …

Roughly a year ago, in Chalk v. U.S. District Court Central California, a United States appellate court authorized a teacher to return to his teaching duties, after a California school department had barred him from his classroom upon learning he had Acquired Immune Deficiency Syndrome (AIDS). The case parallels the widely reported events of the Eric Smith story of Autumn 1987. Teacher Smith was initially removed from his Shelburne County, Nova Scotia classroom, and reassigned to non-teaching duties after a medical secretary disclosed that Smith had tested positive for the AIDS virus. While Smith immediately refused the reassignment, he eventually …

Blood On North American Soil: A Comparison Of United States And Canadian Infectious Waste Disposal Regulations, Scott B. Goldie
Syracuse Journal of International Law and Commerce
It is the intent of this note to show that the United States federal government has failed to establish a clear national definition and standard for the handling of infectious waste, and that that failure is responsible for the confusion among state infectious waste policies. The federal approach taken by the United States will be compared with that of the Canadians, and both will be examined to determine the impact each has had on its nation, and the support each has given its state or provincial governments. By making these comparisons, this note will show the importance of a clear …
