Changing Sovereignty Games And International Migration, Aristide R. Zolberg
Changing Sovereignty Games And International Migration, Aristide R. Zolberg
Indiana Journal of Global Legal Studies
In this article, Professor Zolberg argues that today's
immigration issues should be analyzed within their historical bases.
He follows the formation of the modern State, with particularfo cus
on the legal and political meaning of "sovereignty" as understood
in pre-colonial times down to the World War II period. He next
identifies several late twentieth century phenomena in Europe and
elsewhere, many of which pose serious challenges to long-standing
notions of nationhood and citizenship. The author concludes that
despite the recent development of borderless markets and
communication infrastructures, much remains to be done to build a
truly global community.

Unblinded Mandatory Hiv Screening Of Newborns: Care Or Coercion?, Linda Farber Post
Cardozo Law Review
The image of mother and child is perhaps the most universal symbol of love and protection. The concept of mother and sick child evokes instant compassion and the desire to do somethinganything-to help the mother help her baby. When the disease is both incurable and fatal, there is the expectation that the combined efforts of the state and the medical community will be mobilized to intervene on behalf of those who are afflicted. This Note looks at one such attempt and considers, not the good intentions that prompted it, but the legal ramifications of its implementation.

A Comparative Study Of The Formation And Development Of Air & Water Pollution Control Laws In Taiwan And Japan, Chao-Chan Cheng
A Comparative Study Of The Formation And Development Of Air & Water Pollution Control Laws In Taiwan And Japan, Chao-Chan Cheng
Washington International Law Journal
Taiwan and Japan have faced similar environmental problems at comparable stages in their economic development, and have passed through similar stages in the development of their systems of environmental law. Three phases in the development of environmental law making are distinguished: preparatory, formative and developed. This article compares the relative progress of Taiwan and Japan through these stages, and suggests that Taiwan may benefit by studying Japan's analogous prior experiences with pollution prevention and environmental law.
Revitalizing Our Cities Or Restoring Ties To Them? Redirecting The Debate, Donald A. Hicks
Revitalizing Our Cities Or Restoring Ties To Them? Redirecting The Debate, Donald A. Hicks
University of Michigan Journal of Law Reform
In this Article, I generally concur that certain legal reforms do hold considerable potential for ameliorating some of the desperate circumstances we find in our cities today. My view is rooted in the recognition that past reforms which dismantled legal barriers to equal opportunity were of monumental significance in broadening social and economic access to our urban arrangements. But it also is rooted in the conviction that a new wave of legal reform might well be required in order to reconsider other past reforms that, however unintentionally, have made many matters worse. Above all, any proposed legal reform should be …

Enforcing Corrections-Related Court Orders In The District Of Columbia, Jonathan M. Smith
Enforcing Corrections-Related Court Orders In The District Of Columbia, Jonathan M. Smith
University of the District of Columbia Law Review
In 1909, a presidential commission made the following comment about the conditions that prevailed in the District of Columbia's jail: That men and women should be sent to these narrow and confined cells, the lazy to be fostered in laziness, the industrious to be deprived of every form of employment, in one promiscuous assembly, to corrupt and be corrupted by each other, to be fed like beasts and maintained at the public charge, with no prospect for improvement in condition, with the moral certainty that they will come out far worse than they went in, is a fact that has …
