Prenatal Genetic Testing And Its Impact On Incidence Of Abortion: A Comparative Analysis Of China And Ireland, Stacy Klein

Cardozo Journal of International and Comparative Law

The note examines how cultural, political, and religious ideologies influence the use and regulation of prenatal genetic testing in China and Ireland, highlighting their contrasting approaches. China's liberal policies, driven by population control and economic considerations, contrast sharply with Ireland's conservative stance, rooted in Catholic teachings. The analysis critiques both countries' approaches against the ethical guidelines set by the NIH Workshop, emphasizing the need for a balanced regulatory framework that respects individual autonomy and cultural values.

Health Care Access For Children With Disabilities, Linda C. Fentiman Jan 1999

Health Care Access For Children With Disabilities, Linda C. Fentiman

Elisabeth Haub School of Law Faculty Publications

In the last twenty-five years, we have seen a remarkable evolution in attitudes and practice toward the treatment of children with disabilities. Children born with severe physical and mental anomalies are no longer routinely allowed to die. Many such children, along with those who become disabled later in childhood through illness or injury, receive aggressive life-saving medical treatment as well as continuing medical and habilitative care. Some children, particularly those whose families are affluent, receive substantial therapeutic and other supportive services that permit them to overcome their disabilities and function effectively in school and, later, at work.

Physician-patient confidentiality even abstains sharing information with patients' families. However, when medical information affects the health of the patient's relatives, many medical professionals assert that they have a duty to share the information, with or without the patient's consent, particularly in the context of children of patients with genetic diseases and disorders, where forewarning may significantly decrease the risks or increase prevention of the effects of the disease or disorder. Currently, while physicians respect …

As New York has the highest rate of reported AIDS cases, the Article notes that the state's decision to enact this law could have significant influence on other states. It begins by describing the partner notification system laws in the United States, and then presents arguments for and against partner notification. The Article ultimately argues for a modified version of the New York law. This refined …
