The Internet of Battlefield Things (IoBT) is an advanced network of interconnected devices that significantly enhance military operations through real-time data exchange and situational awareness. While IoBT offers tactical advantages like improved surveillance, reconnaissance, and operational effectiveness, it also introduces substantial cybersecurity risks. Adversaries can exploit vulnerabilities within these networks, potentially compromising mission integrity and national security. This research examines the cybersecurity measures of commercial drone controllers and their correlation with military devices. It aims to enhance future vulnerability assessments with advanced tools and approaches to better secure critical military operations. The study highlights the need for robust security architectures …

Critical water infrastructure in the United States faces increasing cybersecurity threats from state-sponsored actors, with potentially devastating consequences for national security, economic stability, and public health. (Cybersecurity and Infrastructure Security Agency, 2025). This infrastructure supports defense critical assets and is actively being targeted by various state-sponsored hacking groups, which poses a major concern for civilians and military alike. K. Herath (personal communication, February 24, 2025) reported being aware of two attacks on Ohio water systems during his tenure as Cybersecurity Strategic Advisor to Ohio Governor Mike DeWine.
Water is essential to everyday life and defense and presents as a high-value …

Understanding Russia’S Cyber Policies, Strategies, And Doctrines, Bryan Hancock, Hanh Nguyen, Olga Karpoyan, Ekzhin Ear, Shouhuai Xu
Military Cyber Affairs
This study analyzes the strengths and weaknesses of Russia’s cyber policies, strategies, and doctrines through a systematic set of attributes, leading to key insights: (i) Russia has proactively adapted its cyber policies, strategies, and doctrines to its evolving environment; (ii) Russia actively conducts cognitive warfare, but remains equally vulnerable to it; and (iii) Russia’s cyber posture faces significant challenges, including a limited technological base, shortage of skilled personnel, and restrictive approach to information control, all of which undermine the effectiveness of its strategies. These insights offer valuable implications for US Cyber Command and the Department of Defense.

Silicon Sentinels: Using Whistleblower Protections To Manage Information Asymmetry And Ai Risk, Jason Green-Lowe, Fynn Fehrenbach, Mark Reddish
Liberty University Law Review
In the rapidly evolving landscape of artificial intelligence (“AI”) development, policymakers face a critical challenge: obtaining accurate and timely information about the potential risks and impacts of advanced AI systems. This Article examines the pivotal role of whistleblower protections as a mechanism to address the information asymmetry between AI companies and government officials. Employees inside AI companies are uniquely positioned to share information that can help outside regulators make wise policy decisions, but employees might be reluctant to do so unless their decision to share that information is legally protected. We propose a comprehensive framework for AI whistleblower protections as …

Is Ai A Horse Or A Zebra: Do Ai Free Speech Concerns Require New Legal Tools?, Jennifer Huddleston
Liberty University Law Review
In 1996, as the internet was emerging into more popular use among the general public, Judge Frank Easterbrook published Cyberspace and the Law of the Horse. In this essay and lecture, Judge Easterbrook warned against the rise of specialized law for general purpose technology and instead posited that many common law legal principles will be able to evolve. As this essay and lecture posit, new technologies provide may provide an opportunity to examine if existing legal principles function optimally, but we should be cautious of interventions in the name of protecting the public from new and rapidly evolving technologies.

A (Loper) Bright Future? Charting Federal Ai Legislation With State Blueprints In A Post-Chevron World, William B. Simpson
Student Journal of Information Privacy Law
Despite a growing proliferation of algorithmic systems across the market, the U.S. lacks a comprehensive federal AI law to address the risks posed by this technology. The 2024 Supreme Court case Loper Bright v. Raimondo, which overturned the doctrine of Chevron deference, arguably complicates the passage of such a law by constraining Congress’ ability to use ambiguous statutory language as a means of reaching legislative consensus. Nevertheless, as Congress prepares to tackle this complex issue, it can look to state legislatures that have passed AI laws amidst similar constraints. The purpose of this article is to analyze certain state AI …

The Case For A Federal Data Privacy Law From A National Security Perspective - What The U.S. Can Learn From Overseas, Theodore H. Massey Iii
Student Journal of Information Privacy Law
The collection of personal data in the private sector has grown exponentially over the years, leading to an exponential growth in the theft and the purchase of personal data by criminals and foreign adversaries. While the United States has implemented EO 14117 and the Protecting Americans’ Data from Foreign Adversaries Act of 2024 to protect against the inherent national security risks associated with data privacy, the United States must create an omnibus federal privacy law if it wishes to mitigate the national security risk. This paper introduces the reader to the increase in personal data collected by private organizations and, …

The Constitutionality Of Geofence Warrants, Sahara R. Damon
Student Journal of Information Privacy Law
In our current Information Age, new technologies are expanding faster than our legislatures can keep pace with. This has certainly been the case with “Geofence Warrants,” which are a form of reverse warrant that law enforcement has increasingly relied on to uncover perpetrators of crimes where a suspect may otherwise not be uncovered. Chatrie, the first case to be heard in a Circuit Court regarding geofence warrants, serves as a prime example of the typical context in which these warrants are employed. In Chatrie, over a week, three armed robberies took place at the same bank by what appeared to …

Free Speech And Synthetic Lies: Deepfakes, Synthetic Media, And The First Amendment, Jacob R. Bourgault
Student Journal of Information Privacy Law
The rapid evolution of deepfakes and synthetic media presents unique and pressing challenges to the scope and resilience of First Amendment protections. While these technologies can be used creatively or comedically, they are increasingly weaponized in ways that can cause substantial harm: from non-consensual pornography and fraud to manipulated political content and reputational sabotage. As the production of synthetic media becomes more accessible and convincing, courts and lawmakers are being called upon to resolve the tension between free expression and individual dignity, autonomy, and privacy. This Article examines whether existing exceptions to First Amendment free speech—such as obscenity, defamation and …

The Impact Of The Chevron Ruling On Medicare, Sana Sherali
The Impact Of The Chevron Ruling On Medicare, Sana Sherali
DePaul Journal of Health Care Law
The Supreme Court’s historic decision to overturn the Chevron doctrine in June 2024 received national attention due to its implications for how much power agencies will hold in the years to come. The Chevron doctrine originally comes from the Supreme Court’s 1984 decision in Chevron, U.S.A., Inc. v. Natural Resources Defense Council.Chevron addressed the requirements imposed on states by The Clean Air Act Amendments of 1977. This decision set the precedent that if federal legislation is unclear or leaves an administrative gap, courts have to follow the regulatory agency’s interpretation of the law, as long as the interpretation is …
Heterogeneity In Hospital Consolidation, Christina Depasquale
Heterogeneity In Hospital Consolidation, Christina Depasquale
DePaul Journal of Health Care Law
This paper examines the heterogeneity between two types of hospital consolidations—mergers and system-joinings. I examine changes in admissions, employment outcomes, beds in different medical units, surgeries, costs, case mix, and discharges. I find that hospital mergers and system-joiners are fundamentally different among almost all outcomes examined. Additionally, I extend my analysis by examining those hospitals that, at the time of consolidation, are closer to either their fellow merging hospital or a fellow system-member hospital. I find no meaningful correlation between distance and outcomes.

The Opioid Crisis: How The United States And Countries Abroad Are Making Strides, Maura Mcginnity
DePaul Journal of Health Care Law
The opioid epidemic has been an ongoing problem in the United States since the 1980s. The United States has had a very negative attitude towards individuals suffering from addiction. This attitude is clearly shown through the United States’ handling of the opioid crisis. Hundreds of thousands of individuals have died due to opioids. In the forty years since this epidemic became prevalent, the United States has still failed to implement a country-wide solution to combat the crisis. Certain states, like New York and Illinois, have made strides toward helping individuals suffering from opioid use disorder, but nationally, the country is …

Psychopathy, Emotion, And Mock Juror Decision-Making, Bailey A. Hall
Psychopathy, Emotion, And Mock Juror Decision-Making, Bailey A. Hall
USF Tampa Graduate Theses and Dissertations
Research suggests that mock jurors impose harsher sentencing (including death sentencing) when defendants are described as psychopathic, but reasons for this are unclear. This preregistered study investigated the role of juror anger and cognitive biases (predecisional distortion [PDD]) in the relationship between defendant psychopathy descriptions and mock juror decision-making. In an online experiment, participants (undergraduates in a large Southeastern university [n=410] and a US Census-representative online sample [n=384]) reviewed case facts of a murder, were randomized to expert witness testimony of defendant psychopathy or control conditions and read the prosecution and defense arguments before sentencing the defendant to death or …
The Foundations Of International Taxation: Knocked From Post To Pillars, Yariv Brauner
The Foundations Of International Taxation: Knocked From Post To Pillars, Yariv Brauner
Akron Law Review
After a century of convergence and consolidation, the international tax regime is at a crossroads. A recent program promoted by the OECD, known as the two pillars program, departs in many ways from long standing norms of the regime. But the OECD and many states insist that the foundations of the regime have not changed, portraying the two pillars as a negotiated, pragmatic compromise that responds mainly to the challenges that the digital economy presented to the old rules. This article rejects this portrayal, arguing that the program is far from being a balanced or a truly negotiated compromise between …
China’S Role In A Future Korean War, Jake Rinaldi
China’S Role In A Future Korean War, Jake Rinaldi
The US Army War College Quarterly: Parameters
This article argues that China’s intervention in a Korean conflict will hinge more on North Korea’s ability to hold territory than on bilateral ties. Rather than treat Chinese intervention as a yes-or-no proposition, this study models three scenarios—full intervention, sustained support, and limited support—based on North Korean resilience. Using Chinese-language sources and scenario-based analysis, it assesses how each model would shape key functional areas such as ISR, cyber, materiel, and force posture. The findings offer US defense planners a framework for anticipating variable People’s Liberation Army involvement in a future Korea contingency.
A Tragedy Of Incommensurability: Indigenous Rights And The Limits Of Human Rights Law, Zeina Ali
A Tragedy Of Incommensurability: Indigenous Rights And The Limits Of Human Rights Law, Zeina Ali
Theses and Dissertations
This thesis explores the tragedy of incommensurability between indigenous rights and international human rights law. Despite the emergence of frameworks like the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), indigenous calls for sovereignty remain fundamentally unintelligible within a liberal order structured to preserve settler-state legitimacy. Tracing the historical and theoretical evolution of indigenous advocacy, this study critiques the strategic shift from demands for self-determination to claims of cultural rights. It argues that this shift offers no real alternative: self-determination and cultural rights are functionally equivalent, as both are ultimately filtered through legal and political frameworks that cannot …
Strategic Narratives To Counter Global Threats, Jerry E. Landrum, Chase Metcalf, Michael M. Posey
Strategic Narratives To Counter Global Threats, Jerry E. Landrum, Chase Metcalf, Michael M. Posey
The US Army War College Quarterly: Parameters
This article argues that the current National Security Strategy lacks the necessary coherence and fidelity to mobilize collective action against the emerging Russia-China axis. It merges multiple theoretical concepts to assert that the “rules-based order” theme is insufficient for mobilizing public support. Using textual analysis of the strategy compared with publicly available polling to determine levels of popular resonance, the authors find that the “rules-based order emphasis” does not resonate. This study’s conclusions will assist practitioners as they develop an updated National Security Strategy in the new presidential administration.

Compelled Speech, Speaker Preception, And Plausibility, David S. Han
Florida Law Review
In Masterpiece Cakeshop Ltd. v. Colorado Civil Rights Commission, a baker raised a compelled speech claim when his bakery was sanctioned by the Colorado Civil Rights Commission for refusing to make a customized cake for a same-sex wedding. This argument raised a number of difficult questions regarding the existence, attribution, and interpretation of speech that the Supreme Court ultimately left unanswered. Is making a customized cake protected “speech” for First Amendment purposes? When a baker makes a customized cake for a wedding, what exactly does that cake communicate (if anything)? And to whom should any message expressed by the …

Caste Discrimination In Ny - Starting A Conversation, Pranathi Charasala, Gali Racabi
Cornell Law Faculty Working Papers
Despite rapid socioeconomic ascent of Indian Americans in the U.S., caste hierarchies continue to structure inequality within the Indian diaspora. This working paper examines caste discrimination in contemporary New York, situating it within broader civil rights frameworks and legal precedents. Drawing from headline cases, emerging local laws, and collective bargaining agreements, the paper shows how caste operates as a social category—legally unrecognized yet experientially real. It explores both the possibilities and pitfalls of folding caste into existing categories like race, color, national origin, and religion, while grappling with arguments that frame caste protections as anti-Hindu bias. The paper concludes with …

The Corporate Governance Of The Biggest Corporations You’Ve Never Heard Of, Aaron M. Schutt
Alaska Law Review
When Congress passed the Alaska Native Claims Settlement Act (ANCSA) in 1971, it directed the creation of twelve regional and over two hundred village corporations chartered under Alaska state law. ANCSA subjected these corporations to Alaska’s corporate governance framework, including the laws and regulations governing corporate elections. This Article examines the statutory and regulatory requirements applicable to ANCSA corporations, including the various requirements around ANCSA corporation annual shareholder meetings. It also analyzes relevant state and federal case law interpreting and applying these requirements. Finally, the Article explores the rights and responsibilities of corporate directors and officers, as well as the …
