Validity Of Legislation Limiting Hours Of Labor For Women, Ralph W. Aigler Jan 1910

Validity Of Legislation Limiting Hours Of Labor For Women, Ralph W. Aigler

Articles

Public opinion and the development of social and economic thought are well read in the decisions, of the courts. An excellent illustration: of this is found in the recent case of Ritchie & Co. et al. v. Wayman, 244. Ill. 509, 91 N. E. 695, decided April 21, 1910.

The Public Service Of The Future Lawyer, John C. Park Dec 1909

The Public Service Of The Future Lawyer, John C. Park

Michigan Law Review

The lawyer has two characters. He is a private personage, and as such cares for his family, contributes to the local improvement and philanthropies and conducts the common business affairs of his clients. He is also a public functionary and as such his usefulness is not confined to appearance in court and the conduct of litigation. From him must be had the counsel necessary in public movements, his brain must plan and his hand write the rules necessary to make right and wrong govern modem conditions. His must be the thought which shall stir the people to action. In him …

The Illinois Ten-Hour Labor Law For Women, Andrew Alexander Bruce Nov 1909

The Illinois Ten-Hour Labor Law For Women, Andrew Alexander Bruce

Michigan Law Review

There are few cases before the American courts today which are of more significance than that which has recently been brought in the Illinois courts by William E. Ritchie of Chicago and which seeks "to enjoin the prosecuting officers of the state from enforcing the provisions of the so-called Women's' Ten-Hour Labor Law. The case of course involves the somewhat mooted question as to whether the remedy in such cases, if remedy there be at all, is by injunction, or whether the slower and more unsatisfactory procedure of a writ of error is not technically demanded, but this question is …

The Supreme Court And The Fourteenth Amendment, Edward S. Corwin Jun 1909

The Supreme Court And The Fourteenth Amendment, Edward S. Corwin

Michigan Law Review

It was formerly the wont of legal writers to regard court decisions in much the same way as the mathematician regards the x of an algebraic equation: given the facts of the case and the existing law, the outcome was inevitable. This unhistorical standpoint has now been largely abandoned. Not only is it admitted that judges in finding the law act not as automata, as mere adding machines, but creatively, but also that the considerations which determine their decisions, far from resting exclusively upon a narrowly syllogistic basis, often repose very immediately upon concrete and vital notions of what is …

The Anthracite Coal Industry And The Busness Affected With A Public Interest, Andrew Alexander Bruce Jun 1909

The Anthracite Coal Industry And The Busness Affected With A Public Interest, Andrew Alexander Bruce

Michigan Law Review

The constitutions, state and federal, do not anywhere guarantee any absolute property rights nor right to liberty. The guarantee is merely that no person shall be deprived of life, liberty and property without due process of law. The right to liberty and property was never absolute under the English law, and the American constitutions have never been construed as going further than guaranteeing the continuance of the rights which existed at the time of their adoption.

Mutuality Of Options, R. T. Holland Apr 1909

Mutuality Of Options, R. T. Holland

Michigan Law Review

In spite of the fact that options, so-called, have been in use for many years, it is surprising to find that the law is still somewhat unsettled, and that courts frequently express doubt as to their validity at this late day. The main difficulty with this form of contract seems to be an apparent lack of mutuality, and even when sustained, they have, in many cases, been treated as exceptions to the rule that mutuality must be present in all contracts.

National Sovereignty, S. S. Gregory Mar 1909

National Sovereignty, S. S. Gregory

Michigan Law Review

The growth and development of our country and its marvelous progress in every direction have been dwelt upon so constantly in what our critics characterize as a spirit of boastfulness and over weening national self-conceit, that almost any reference to this stupendous theme seems trite and commonplace. If we compare our country as it existed when the Federal Constitution was adopted, in extent of territory, in population and in wealth, with our present situation, the retrospect is astounding and overwhelming. It is not my purpose to rehearse the epic story of this mighty nation, inspiring and exalting as it is. …

Characteristics And Constitutionality Of Medical Legislation, Harry B. Hutchins Jan 1909

Characteristics And Constitutionality Of Medical Legislation, Harry B. Hutchins

Articles

Right to practice medicine regulated by statute.--In the absence of a statute upon the subject, any person is at liberty to practice medicine or surgery or both. This is the common law. And yet in the absence of a statute the physician necessarily assumes certain responsibilities that grow out of his relation to those whom he treats. He is bound to bring to the discharge of his duties the learning, skill and diligence usually possessed and exercised by physicians similarly situated. In other words, while in the absence of statutory regulation, the door of the profession is open to all, …

A year ago the writer of this article outlined in the Michigan Law Review "Some Suggested Changes in the Constitution of Michigan," in view of the Constitutional Convention that had been called to revise the Constitution in force. Since that time the members of the convention have been elected; and after four months of earnest work, the results of its labors have been presented to the people of Michigan in the proposed revised Constitution, which will be submitted for their approval or disapproval at the general election in November of the present year. The Rights And Remedies On Permitting, Diverting, Increasing And Obstructing The Natural Flow, John R. Rood Apr 1908

The Rights And Remedies On Permitting, Diverting, Increasing And Obstructing The Natural Flow, John R. Rood

Michigan Law Review

It is evident that no one hard and fast rule could be applied to all cases, either in city or country, "without producing injustice and impolitic results. The needs and conditions in city and country are different. They usually differ widely in different parts of the same city. These considerations have induced the Supreme Court of New Hampshire to adopt the flexible rule, that: "In determining this question all the circumstances of the case would, of course, be considered; and among them the nature and importance of the improvements sought to be made, the extent of the interference with the …
