Defendant's intestate applied for insurance with "plaintiff, expressly waiving, for himself and beneficiaries, the privilege of excluding testimony of physicians who had then attended him or might do so later. The policy lapsed, but the insured, falsely representing that he was in good health and had consulted no doctor for any cause, secured a reinstatement. He died six months later. Plaintiff sued for cancellation, and defendant objected to the testimony of physicians who had been consulted before and after the reinstatement. Held, the testimony was admissible, since the privilege was waived; also the mere fact that there were consultations …

In many circles today, law enforcement is looked upon as a panacea for the present condition of lawlessness. Our political parties carry law enforcement planks in their platforms. The party in power seeks to carry out its pledge of remedying the evil. President Hoover appoints a Law Enforcement Commission and tells them that they are to deal with the dominant issue before the American people. He calls that issue "enforcement and obedience to the laws of the United States, both Federal and State".

"Much acute intellectual ability, energy, and expository skill has been . . . uneconomically spent in an attempt to distill from knowledge of a phase of governmental business a rarefied and sublimated science to be labeled 'jurisprudence'. "The law is essentially a practical matter. No theory or effort concerning it can command much attention and respect unless it is directed by an intelligent recognition of this fact." The vast and increasing amount of money invested in policies of life insurance in the states having a community property system makes the status of the proceeds of such policies under that system of very general interest, and renders it highly desirable and important that the laws as to such contracts should be worked out with dispatch, definiteness and certainty The fact that there are in the community property states different theories as to the character and extent of the wife's interest and different statutes affecting the determination of the rights of the spouses has led to somewhat varying results. …
