Acute Tax Neuroses, Lawrence Bloomenthal
Acute Tax Neuroses, Lawrence Bloomenthal
Cleveland State Law Review
The major cause of acute taxitis is the mental and physical turmoil arising from accusations by the Revenue Service that false and fraudulent returns have been filed with intent to evade taxes. The three most common means by which tax evasion is discovered are: (1) routine audit-spot checks and surveys; (2) tips from informers in hopes of receiving sizeable rewards,or by jealous neighbors or disgruntled employees; (3) newspaper publicity about marriages, trips, home purchases, robberies, real estate and business transactions.
Occupational Dermatitis In Railroad Cases, Howard L. Oleck, Elmer I. Schwartz
Occupational Dermatitis In Railroad Cases, Howard L. Oleck, Elmer I. Schwartz
Cleveland State Law Review
Employers today must be presumed to know of the dangerous nature of many chemicals which produce contact dermatitis, as well as respiratory and other injuries. Among the known-to-be-dangerous substances are such things as chrome compounds, lead compounds, petroleum compounds, and many others. The danger of sensitization by these substances also must be presumed to be known. It follows that an employer is legally bound to take all reasonable possible precautions to protect his workers from such injuries. Whether or not he has taken adequate precautions is a question of fact, for the jury. If he has taken no special precautions, …

Metro System Of Local Government (A Survey), Wilson G. Stapleton, Hugh E. Dunn, G. Brooks Earnest, A. B. Bonds Jr.
Cleveland State Law Review
Growth of many American cities into vast metropolitan communities of suburban cities, towns and villages clustered about the central city is creating complex problems of local government. Duplication of services and costs is matched by artificial "compartmentalization" of adjacent areas, all developing with little or no overall plan or logic.Herein, four outstanding community leaders examine the problem in terms of the situation in the Ohio area of Cuyahoga County, around the core city of Cleveland. Extracts from four speeches are set forth here, all delivered at a recent luncheon of the Cleveland-Marshall Alumni Association.
The Mallet Finger Injury, Donald R. Pratt
The Mallet Finger Injury, Donald R. Pratt
Cleveland State Law Review
Mallet finger is a permanent deformity caused by injury to the distal phalanx of a finger. Commonly seen in industrial accidents and in baseball players, the extending tendon is pulled off the bone of the terminal phalanx. Treatment consists of simple splinting (illustrated) in mild trauma, or surgical intervention when large bony fragments have been pulled off. If left untreated, some degree of drop finger ultimately develops. This disability varies in degree. Joint stiffness and deformity may result. A method of surgical treat- ment of more severe injuries is described. The chief importance of this injury, to the lawyer, is in …

Constitutional Law - Due Process - Denial Of Admission To The Bar Based On Unwarranted Inferences Of Bad Moral Character, Jerome B. Libin
Constitutional Law - Due Process - Denial Of Admission To The Bar Based On Unwarranted Inferences Of Bad Moral Character, Jerome B. Libin
Michigan Law Review
Power over admission to the bar has long been vested in the judiciary of each state. While the legislature may prescribe certain standards, the state court alone is responsible for the determination of those qualified for the practice of law within its jurisdiction. The application of these standards often demands the exercise of meticulous judgment by the court in reaching its conclusion as to an applicant's fitness. Where, on the evidence or lack of evidence presented, the court finds that it cannot in good conscience grant its approval, the candidate is denied admission. To the extent that such a denial …

Constitutional Law - Due Process - Jurisdiction Of State Court Over Nonresident Tortfeasor, J. Martin Cornell
Michigan Law Review
The defendant, a resident of Wisconsin, was engaged in the business of selling appliances and sent one of his employees to deliver a gas cooking stove to the plaintiff in Illinois. Claiming that the employee had negligently injured him in unloading the stove, the plaintiff brought action in Illinois, seeking damages of $7,500. A summons was personally served on the defendant in Wisconsin, and the defendant appeared specially, moving to quash the summons on the ground that the Illinois statute, providing for extraterritorial service on any person who commits a tortious act within the state, contravened the constitutions of the …

Testing For Analytic Ability In The Law School Admission Test, Monroe H. Freedman
Hofstra Law Faculty Scholarship
The Law School Admission Test, in conjunction with college grades, has, for many years, provided a significant prediction of performance in law school. We are, however, at present conducting a study of a section of the Test known as "Principles and Cases" to determine in what ways it might be improved. Specifically, we have considered whether the question forms that are currently being used in this section provide the best possible test of a student's ability to cope with the precise kinds of intellectual problems involved in the study of law.
