Truth and Reconciliation History Project
A bibliography of resources about the history in Nebraska of Native Americans, African Americans, Latinos, Asian Americans and Recent Refugees
We hope that these five bibliographies will prove fruitful in helping us to understand what our history has been, where we have gone astray, and what we can do to help bring about reconciliation in our community and in our state.
The discovery of what has happened in Nebraska in the last hundred and seventy years is not an easy task, but it is our goal in putting together this bibliography to begin that task. By putting together a picture …
Mapping Human Rights-Based Climate Litigation In Canada, Lisa Benjamin, Sara L. Seck
Mapping Human Rights-Based Climate Litigation In Canada, Lisa Benjamin, Sara L. Seck
Articles, Book Chapters, & Popular Press
In line with global trends, there has been an increase in human rights-based climate litigation brought in Canadian courts in recent years. Some litigants invoke human rights as found in the Canadian Charter of Rights and Freedoms to push federal and provincial governments to take seriously the implementation of their climate obligations. Other litigants invoke procedural environmental human rights to engage in free speech and peaceful protest in the face of government action supporting fossil fuel consumption or expansion. At the same time, the Supreme Court of Canada has recognized that Canadian courts could develop civil remedies for corporate violations …
Law And Empire, 1500–1812, Philip Girard, Catherine Evans
Law And Empire, 1500–1812, Philip Girard, Catherine Evans
Articles & Book Chapters
When we think about law and empire, it is most accurate, if inelegant, to pluralize everything: empires, colonies, peoples, cultures, sources of law. The transnational turn has dramatic implications for the history of law in the Americas. Most obviously, especially for the period from 1500 to 1812, scholars have become increasingly sensitive to the role of European empires – including the British, French, and Spanish – in shaping America’s legal cultures. Groups of colonists from across Europe brought a multiplicity of understandings of law and social order with them, encountering Indigenous nations with their own rich legal traditions. Colonists used …
Regulatory Competition And State Capacity, Martin W. Sybblis
Regulatory Competition And State Capacity, Martin W. Sybblis
William & Mary Business Law Review
This Article explores an underlying tension in the regulatory competition literature regarding why some jurisdictions are more attractive to firms than others. It pays special attention to offshore financial centers (OFCs). OFCs court the business of nonresidents, offer business friendly regulatory environments, and provide for minimal, if any, taxation on their customers. On the one extreme, OFCs are theorized as merely products of legislative capture— thereby lacking any meaningful agency of their own. On the other hand, OFCs are conceptualized as well-governed jurisdictions that attract investment because of the high quality of their laws and legal institutions—indicating some ability to …
The Status Of State And Nonstate Actors In Postwar Hostilities: Restoring The Rule Of Law To Us Targeted Killing Operations, Claire Finkelstein
The Status Of State And Nonstate Actors In Postwar Hostilities: Restoring The Rule Of Law To Us Targeted Killing Operations, Claire Finkelstein
Vanderbilt Journal of Transnational Law
With the killing of Iranian general Qassim Soleimani, the United States crossed a new frontier in the use of extrajudicial lethal operations outside of armed conflict. As a state actor, Soleimani once would have been entirely off-limits as a target outside the context of a formal armed conflict between the United States and Iran. The Trump administration's choice to conduct a one-off strike on a state military leader indicates that conflicts among state adversaries are increasingly fought using the hybridized tools of the war on terror. This Article will argue that the increasing use of such techniques and the perceived …

When The Conditions Are The Confinement: Eighth Amendment Habeas Claims During Covid-19, Michael L. Zuckerman
When The Conditions Are The Confinement: Eighth Amendment Habeas Claims During Covid-19, Michael L. Zuckerman
University of Cincinnati Law Review
The COVID-19 pandemic cast into harsher relief much that was already true about mass incarceration in the United States. It also cast into harsher relief much that was already true about the legal barriers confronting people seeking to make its conditions more humane. This Article offers a brief overview of the legal landscape as the COVID-19 crisis arose and then surveys eight prominent federal cases involving Eighth Amendment claims related to COVID-19 outbreaks at carceral facilities, most of which included significant litigation over whether they could secure release through habeas corpus. The Article then distills six key tensions from these …

The Assault On Elisha Green, Randolph Paul Runyon
The Assault On Elisha Green, Randolph Paul Runyon
Civil Rights
On June 8, 1883, Rev. Elisha Green was traveling by train from Maysville to Paris, Kentucky. At Millersburg, about forty students from the Millersburg Female College crowded onto the train, accompanied by their music teacher, Frank L. Bristow, and the college president, George T. Gould. Gould grabbed the reverend by the shoulder and ordered him to give up his seat. When Green refused, Bristow and Gould assaulted him until the conductor intervened and ordered the assailants to stop or he would throw them off of the train. Friends advised Green to take legal action, and he did, winning his case …

An Immigration Innovation: A Comparative Analysis Of The American Diversity Visa Lottery Program And The Canadian Points-Based System, Jennifer Hopkins
An Immigration Innovation: A Comparative Analysis Of The American Diversity Visa Lottery Program And The Canadian Points-Based System, Jennifer Hopkins
St. John's Law Review
(Excerpt)
United States immigration policy has historically been a strategy for national growth. Congress passed the Immigration Act of 1990 to stimulate further growth by increasing immigration opportunities. This substantial immigration reform created the Diversity Visa (“DV”) lottery program, which administers 50,000 lawful permanent residence visas annually. These visas are drawn randomly from a pool of applicants from countries with low rates of immigration to the United States.
Donald J. Trump pushed for major immigration reform beginning on his first day in office, including the repeal of the DV program and the development of a points-based system modeling the current …

Nazi Germany's Race Laws, The United States, And American Indians, Robert J. Miller
St. John's Law Review
(Excerpt)
Most Americans would be shocked to learn that in the 1920s and 1930s Adolf Hitler and Nazi scholars, lawyers, and officials were studying United States law while developing Germany’s policies and laws concerning Jews and the conquest of Eastern Europe. Most Americans would also be surprised that, as the leaders of the Third Reich were turning racist ideas into official German policies, Nazis were carefully studying United States federal Indian law and state laws that discriminated against Indian nations and American Indians.
Rent-A-Bank: Bank Partnerships And The Evasion Of Usury Laws, Adam J. Levitin
Rent-A-Bank: Bank Partnerships And The Evasion Of Usury Laws, Adam J. Levitin
Duke Law Journal
“Rent-a-bank” arrangements are the vehicle of choice for subprime lenders seeking to avoid state consumer protection laws. In a rent-a-bank arrangement, a nonbank lender contracts with a bank to make loans per its specifications and then buys the loans from the bank. The nonbank lender then claims to shelter in the bank’s federal statutory exemptions from state regulation. The validity of these arrangements is the most bitterly contested legal question in consumer finance.
The rent-a-bank phenomenon is a function of a binary, entity-based regulatory approach that treats banks differently than nonbanks and that treats bank safety-and-soundness regulation as a substitute …
Rewriting Our Nation's Deadly Traffic Manual, Sara C. Bronin, Gregory H. Shill
Rewriting Our Nation's Deadly Traffic Manual, Sara C. Bronin, Gregory H. Shill
Cornell Law Faculty Publications
Every day, Americans entrust their lives to a road system that is governed by the Manual on Uniform Traffic Control Devices for Streets and Highways (the Manual). On its face, this Federal Highway Administration (FHWA) publication is a straightforward technical document. It contains over eight hundred pages of engineering guidance on everything from traffic-light placement to the font of highway signs. It also establishes acceptable methods for officials to modify speed limits.
While such provisions may sound inconsequential, some of the Manual’s provisions have far-reaching, even deadly, consequences. They prioritize vehicular speed over public safety, mobility over other uses of …
Linguistic Branching Of Semantics In Arabic: A Social Approach, Hanan Ismael Amayreh, Mohammad Ismael Amayreh
Linguistic Branching Of Semantics In Arabic: A Social Approach, Hanan Ismael Amayreh, Mohammad Ismael Amayreh
Al-Balqa Journal for Research and Studies البلقاء للبحوث والدراسات
Linguist Branching is appropriate for Arabic Language as words branch out mostly from roots, and every root becomes a tree, which is different from others, not because of the tree itself, but because of what society uses. Language branching expresses the controversial relationship between the language and the rules that govern it from one side, and society’s preference of certain terms over others from the other side. This study tries to answer the following questions: does the language impose the used words, or does it offer options for society to choose what suits it? The study reaches a conclusion that …

The majority of residential and commercial buildings use appliances powered with fossil fuels for space and/or water heating. Collectively, these appliances—most of which run on natural gas—emit substantial quantities of a variety of harmful air pollutants, including particulate matter, nitrogen oxides (“NOx”), and carbon dioxide. Fossil-fuel appliances in the U.S. emitted over 425,000 tons of NOx in 2017—almost three times the amount attributable to gas-fired power plants in that year. And fossil-fuel combustion in residential and commercial buildings accounted for almost 10% of the nation’s greenhouse gas emissions in 2019—only slightly less than gas power plants. Yet while the U.S. …

Professional Responsibility, Legal Malpractice, Cybersecurity, And Cyber-Insurance In The Covid-19 Era, Ethan S. Burger
St. Mary's Journal on Legal Malpractice & Ethics
In response to the COVID-19 outbreak, law firms conformed their activities to the Centers for Disease Control and Prevention (CDC), Occupational Safety and Health Administration (OSHA), and state health authority guidelines by immediately reducing the size of gatherings, encouraging social distancing, and mandating the use of protective gear. These changes necessitated the expansion of law firm remote operations, made possible by the increased adoption of technological tools to coordinate workflow and administrative tasks, communicate with clients, and engage with judicial and governmental bodies.
Law firms’ increased use of these technological tools for carrying out legal and administrative activities has implications …

“It’S Not Really Hate Crime” – Reframing Hate Crime As Not Police Business” – Police Narratives Of Resistance And Denial, Timothy Bryan, Lorretta Trickett
Journal of Hate Studies
Within a global pandemic and increased questioning of police utility and legitimacy around racism and violence against women and girls (VAWG), this article examines the gap between police policy and practices on hate crime. Based on research with police forces in Canada and the UK, it demonstrates how police officers view hate crime through a policing rather than victim-centred mandate. Without reframing hate crime as a public and community safety issue, hate crime policies and procedures designed to ‘take hate crime seriously’ are unlikely to do just that. Real ‘commitment’ is needed to tackle hate crime as part of the …
No Honor In Genocide: A Case Study Of Street Renaming And Community Organizing In The Wake Of National Decolonization Efforts, Margo Hill
Journal of Hate Studies
The United States hosts countless streets, structures, and cities named after colonial and military leaders. Although many of these white historical figures, like Robert E. Lee, were revered in their own eras, modern history now acknowledges their involvement in immoral acts such as slavery and genocide. As they recognize that individuals responsible for such traumatic events should no longer be honored, the citizens of many towns and cities across the nation are attempting to rename their public properties. These efforts, however, rarely prove straightforward; the process of renaming a single road, for example, requires a thorough understanding of city ordinances …
