Can Big Data Achieve Environmental Justice?, Dina Sunyowati, Masitoh Indriani, Annisa Firdhausy, Mochamad Kevin Romadhona
Indonesian Journal of International Law
Big data and analytical tools are being used by agricultural startup companies to develop their application performance. Generally, big data is a term that describes a large volume of structured and unstructured data. A few goals of its utilization include promoting environmental justice, improving energy efficiency, as well as tracking climate change by introducing ‘smart farms’. However, the utilization is accompanied by some flaws, such as legal regulatory issues involving the gap between applied technology and global government policies. There is also increased development of agricultural applications in Indonesia, which led to the initiation of a digitization program for plantation …
Public Access To Online Hearings, Jérémy Boulanger-Bonnelly
Public Access To Online Hearings, Jérémy Boulanger-Bonnelly
Dalhousie Law Journal
The open court principle faced a significant challenge when courthouses closed their doors to limit the spread of COVID-19. The shift to online hearings in many jurisdictions generated new avenues for public access but also raised concerns for the privacy and security of individuals, and for the administration of justice. Building on existing principles and a review of the measures adopted by courts in Canada, the United Kingdom, the United States, and Australia during the pandemic, this paper seeks to identify best practices to preserve an appropriate balance between openness and competing interests in the online environment. It concludes that …

Towards New Pedagogical Practices In Times Of Covid: Distance Education As A Mark Of Resilience In The Moroccan University, Abdelfettah Nacer Idrissi
BAU Journal - Society, Culture and Human Behavior
Affected, like most countries in the world, by the covid-19 pandemic which has affected all sectors of activity, Morocco has proposed, as part of a policy of prevention and anticipation. The measures including the objective is not only to limit the spread of covid but also and above all to ensure educational continuity and the transition from face-to-face teaching to distance learning. However, not having, like the majority of countries, a prior strategy to deal with this disaster situation, the concept of the resilience of education systems was not yet included in public policies. This fact did not prevent the …

From Trauma To Resilience: The Cases Of Beirut Syndrome By Alexandre Najjar And Beirut 2020 Diary Of A Collapse By Charif Majdalani (Comparative Study), Ilham Slim-Hoteit, Lama Farhat
BAU Journal - Society, Culture and Human Behavior
This study is an attempt to think, interpret and analyze the concept of resilience and to study the factors and mechanisms that result from it under the influence of historical, psychic, social and cultural challenges. Boris Cyrulnik defines resilience as a "biological, psycho-affective, social and cultural process that allows a new development after psychic trauma". It is thus presented as an experience that can only be lived after going through various shocks, turbulences and disturbances, whether individual or collective. The two novels of Alexandre Najjar Le syndrome de Beyrouth and Charif Majdalani Beyrouth 2020 Journal d'un effondrement seem to offer …

From Damage To Words : The Diary Of A Confined Person, Christelle Stephan-Hayek
BAU Journal - Society, Culture and Human Behavior
From March 16 to April 20, 2020, therefore from the 1st to the 35th day of confinement due to the COVID-19 pandemic, in France, Wajdi Mouawad writes his logbook every day, during this crossing of the desert, alone which more is “A word from a confined human to a confined human,” he says in his introduction.
Faced with one of the greatest social challenges that our current world has had to face in its almost entirety, each "confined human" has experienced a fight and has had no choice but to fight it. We will consider that of the Lebanese-born playwright, …

Geostationary Orbit Slot Reconceptualization In Accommodating The South, Yaries Mahardika Putro, Ridha Aditya Nugraha, Taufik Rachmat Nugraha
Indonesian Journal of International Law
Geostationary Orbit (GSO) located above the equator is deemed as limited resources with strategic position for satellites in outer space. As today, the majority who possess GSO slots are non-equatorial states, in this context developed countries. The distribution of orbital slots in the GSO has been discussed among scholars from the developing states for decades. In the past, the developing states ever formed the “Bogota Declaration” aimed to ensure the developing states possess special rights over the GSO slot. The declaration arose from the distribution of the GSO slot by unequal treatment and dissatisfaction to the International Telecommunication Union (ITU) …

Family | Home | School, Latoya Baldwin Clark
Family | Home | School, Latoya Baldwin Clark
Northwestern University Law Review
The state grants residents who live within a school district’s border an ownership interest in that district’s schools. This interest includes the power to exclude nonresidents. To attend school in a school district, a child must prove that she lives at an in-district address and is a bona fide resident. But in highly-sought-after districts and schools, establishing a child’s bona fide residence may be highly contested.
In this Essay, I show that education law, policies, and practices fail to recognize a child’s residence when the child’s family and living situation do not comport with a particular ideal of family life. …
Property Law And Inequality: Lessons From Racially Restrictive Covenants, Carol M. Rose
Property Law And Inequality: Lessons From Racially Restrictive Covenants, Carol M. Rose
Northwestern University Law Review
A long-standing justification for the institution of property is that it encourages effort and planning, enabling not only individual wealth creation but, indirectly, wealth creation for an entire society. Equal opportunity is a precondition for this happy outcome, but some have argued that past inequalities of opportunity have distorted wealth distribution in contemporary America. This article explores the possible role of property law in such a distortion, using the historical example of racially restrictive covenants in the first half of the twentieth century. I will argue that the increasing professionalization and standardization of real estate practices in that era included …
Eviction Court Displacement Rates, Nicole Summers
Eviction Court Displacement Rates, Nicole Summers
Northwestern University Law Review
This Essay introduces the concept of eviction court displacement rates, defined as the percentage of eviction filings that result in tenant displacement. The Essay argues that a jurisdiction’s eviction court displacement rate provides crucial insight into the role of its legal system in driving substantive eviction outcomes. The Essay then compiles existing data on court displacement rates and compares those rates across jurisdictions. This comparison reveals massive variation in court displacement rates nationwide. In some jurisdictions, a tenant’s likelihood of displacement upon receiving an eviction filing is approximately one in twenty. In other jurisdictions, it is higher than one in …

The Long Migration Route: Exploring Social Implications For Asylees In The Us And Policy Creation In Transit Countries As A Result Of Immigration Patterns Of African And Haitian Asylum-Seekers Traveling Through Latin America To The United States, Brendan Rupprecht
Capstone Collection
The number of asylum-seekers from African nations and Haiti traveling from their origin countries, through Latin America, and then to the United States is increasing. This capstone explores why Africans and Haitians are choosing to embark on this journey, what the experience is like for the asylum-seekers (including mapping the physical route taken), and what policies have been developed in transit countries, specifically Panama and Mexico, as a response to this phenomenon. To fulfill the objectives of the study, data was collected by conducting semi- structured interviews with 4 individuals who currently work in the field of international migration and …

Arctic Navigation And Climate Change: Projections From Science For The Law Of The Sea, Charles H. Norchi, Amanda H. Lynch
International Law Studies
The most variable climate conditions on the planet are observable in the Arctic. These conditions affect all forms of life, including the human interactions and social processes that generate law. Among the critical activities affected by climate is navigation, which is subject to national regulations, general maritime laws, and the international law of the sea. As a result of anthropogenic climate change, Arctic climate variability is already moving the system into states that humans in the Industrial Era have not experienced. Most critically, while the end point of unfettered climate change as manifest in the Arctic – an ice-free ocean …

Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Contributions to Books
Published as Chapter 4 in Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
Areas beyond national jurisdiction are the largest environment on earth and marine genetic resources are its new, and perhaps final, frontier. It is no wonder, then, that the scope and protection of marine genetic resources in this oceanic space have been hotly contested and that a new doctrine for ocean governance has been coined in this context: mare geneticum. This chapter examines different definitions of marine genetic resources debated in the ongoing treaty negotiations over areas beyond national jurisdiction (the BBNJ), the conflicting interests involved, and …

Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Contributions to Books
Published as ine introduction to Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book discusses the juridical thinking that has enshrined the land/sea divide into contemporary governmental infrastructures, disciplinary traditions, and regulatory apparatuses, and charts the disastrous implications that such a legal fixation on the land/sea binary has wrought on human and other-than-human lifeworlds. As the collection proceeds, a second broad theme emerges, building on the first: when one rethinks the abstraction of law as played out on the ground, the …
