Unconstitutional Racial Classification And De Facto Segregation, Joseph A. Milchen
Michigan Law Review
Classification along racial lines, when involving state action, is unconstitutional. The Dominican Crisis: An Examination Of Traditional And Contemporary Concepts Of International Law, John F. Naughton
Duquesne Law Review
In late April of 1965 the Dominican Republic became embroiled in internal revolution. On April 25th the Dominican government was toppled by supporters of former Dominican President Juan D. Bosch. For the next three days the pro-Bosch rebel regime demanded the return of the former president. Bosch's return, however, was opposed by units of the Dominican naval and air forces under the command of Dominican Air Force General Elias Wessin y Wessin. The revolution appeared to collapse after heavy fighting in the Dominican capital of Santo Domingo on April 27th. That day the United States Embassy in Santo Domingo announced …

Some Comments On The Reapportionment Cases, Paul G. Kauper
Some Comments On The Reapportionment Cases, Paul G. Kauper
Michigan Law Review
Any appraisal of the Supreme Court's decisions in the legislative reapportionment cases must necessarily distinguish between the basic policy ingredients and social consequences of the decisions on the one hand, and the question whether the results were reached by a proper exercise of judicial power on the other. Respecting the first of these considerations, I have no difficulty identifying the social advantages accruing from these decisions. Because of the stress on the population principle, the decisions will afford a greater voice to urban interests, will make the legislative process more responsive to current needs of particular concern to urban dwellers, …
Reapportionment In The Supreme Court And Congress: Constitutional Struggle For Fair Representation, Robert G. Dixon Jr.
Reapportionment In The Supreme Court And Congress: Constitutional Struggle For Fair Representation, Robert G. Dixon Jr.
Michigan Law Review
Fair representation is the ultimate goal. At the time of the Reapportionment Decisions, much change was overdue in some states, and at least some change was overdue in most states. We are a democratic people and our institutions presuppose according population a dominant role in formulas of representation. However, by its exclusive focus on bare numbers, the Court may have transformed one of the most intricate, fascinating, and elusive problems of democracy into a simple exercise of applying elementary arithmetic to census data. In so doing, the Court may have disabled itself from effectively considering the more subtle issues …

Reappraising American Legal Education Through A Comparative Study, Stanley A. Samad
Reappraising American Legal Education Through A Comparative Study, Stanley A. Samad
Cleveland State Law Review
The current ferment in American legal education has been stimulated mainly by the American realists and a recent offshoot of that school, called policy science. The thrust of their reproof is that law to be studied is not to be found in the casebook and the law library, but is to be found in "law in action" in the context of economic, moral, political, psychological and social forces that shape law and the process of decision. Some have stressed the role of the lawyer as policy maker, or as counsel or adviser to policy makers, and have developed a suggested …

Finding An Expert Witness In The Sciences, Ralph K. Davies
Finding An Expert Witness In The Sciences, Ralph K. Davies
Cleveland State Law Review
To the uninitiated a classification of diversified sciences upsets the notion that science is one field of knowledge. There are times when even a scientist in one area has difficulty in locating an expert in another area. How then does one find a scientific expert?
