The Status Of Lawyer Advertising In Virginia: What Is Good Taste?, Carol Anne Weiss
The Status Of Lawyer Advertising In Virginia: What Is Good Taste?, Carol Anne Weiss
University of Richmond Law Review
When Abraham Lincoln wanted to attract clients to his law practice in 1837, he ran a simple advertisement announcing his services in an Illinois newspaper. Despite the precedent set by "Honest Abe," fifty years later the American Bar Association banned legal advertising and solicitation. Today, there is no absolute ban on legal advertising. A need exists for information regarding legal assistance, and in today's commercially-oriented society, it is not surprising that members of the legal profession want to advertise the availability of their services.

The Canadian Constitutional Experiment, Alan C. Cairns
The Canadian Constitutional Experiment, Alan C. Cairns
Dalhousie Law Journal
Amidst the staggering array of possible foci for an essay on the Canadian constitutional experiment I have chosen to stress the recent tumultuous struggles for identity and community which have engaged citizens and governments. My perspective is primarily from the bottom up, not because the recent constitutional exercise shows the Canadian peoples as masters of their fate, which it does not, but because who we are and to whom we relate as fellow citizens are important subjects in themselves. Further, the contemporary democratic state cannot function successfully in a vacuum. Its weight and its pressure are such, and its purposes …

Jailbirds In Mid-Victorian Halifax, Judith Fingard
Jailbirds In Mid-Victorian Halifax, Judith Fingard
Dalhousie Law Journal
The social history of crime and criminal justice in the nineteenth century has recently tended to emphasize two themes: first, attitudes towards crime and punishment, and the administrative reforms of institutions which grew out of those attitudes; second, the nature of criminality, particularly of serious crime and long-term trends, as revealed in case studies of offences in particular localities, including computer-based, statistical profiles of criminal populations. Both these approaches have their strengths, but it must be recognized that they are heavily weighted in favour of the theoretical, the institutional, and the statistical; they are also predominantly concerned with the view …

The Old British Empire at its greatest extent and the height of its grandeur, between 1763 and 1776, comprised thirty-three colonies, all but a few of them in North America and the Caribbean, none of them older than 1607. The most recently acquired colonies included the largest, Canada, and some of the smallest, Grenada and St. Vincent.1 The Empire was not a monolith. Differing geography, history, economics, social structure and dynamics, and ethnicity produced political societies of great variations and disparities, even between contiguous colonies. Historians of the Old Empire have found generalization difficult and dangerous, save when describing "imperial …

The three men began their work on the morning of 26 January 1850. They were in the snowy street of the village of St.-Grrgoire le Grand, on the St. Lawrence south shore, to assess the population for school taxes. Hardly had they begun when they were confronted by a mob of three hundred angry men who ordered them to stop, tore up and burned their assessment books, and warned them not to attempt to carry out the government's work. A week later, on 2 February, the assessors went to the grand jury of the Court of Queen's Bench at Trois …

Ice-Covered Areas: The Competing Interests Of Conservation And Resource Exploitation, John Warren Kindt, Todd Jay Parriott
Ice-Covered Areas: The Competing Interests Of Conservation And Resource Exploitation, John Warren Kindt, Todd Jay Parriott
San Diego Law Review
This Article examines the various issues surrounding the exploitation of ice-covered areas. The author examines the resource potential of these areas, as well as the economic and environmental implications of resource exploitation in these areas. The author argues that hypersensitivity of the environment and ecology in these areas requires some minimal legal safeguards to prevent potentially irreversible damage. The author suggests that the legal regime which would best protect the ice-covered areas is that of an international marine sanctuary, but that such a regime is probably not attainable due to increasing worldwide pressure for commercial exploitation of the areas' valuable …

Institutional Aspects Of Fishery Management Under The New Regime Of The Oceans, J. E. Carroz
Institutional Aspects Of Fishery Management Under The New Regime Of The Oceans, J. E. Carroz
San Diego Law Review
This Article reviews the changes already made or envisaged in light of the relevant provisions of the 1982 United Nations Convention on the Law of the Sea and the biological characteristics of the living resources of the sea. The author argues that the establishment of exclusive economic zones necessitates the alteration of institutional arrangements developed over the last decades to promote international cooperation in the management of fisheries. The author describes the establishment of a network of regional fishery bodies and analyzes the effect of the 1982 Convention provisions concerning the institutional aspects of fishery management. The author then reviews …

Further, the differences international law affords coastal archipelagos as opposed to outlying mid-ocean archipelagos will be interpreted. These differences include, for instance, the design of baselines used to enclose territorial waters. Geography And Law, Bernhard Grossfeld
Geography And Law, Bernhard Grossfeld
Michigan Law Review
The central questions of comparative law are still unsolved: Which legal institutions in what legal cultures can be compared with each other in a meaningful way? What can we learn from comparative law for the solution of our own problems?
This Article will discuss the relations between geography and law. I have already discussed the subject of language and law elsewhere; with regard to religion and law, I refer the reader to the extensive writings of Harold Berman.
Trade Friction With Japan And The American Policy Response, Thomas J. Schoenbaum
Trade Friction With Japan And The American Policy Response, Thomas J. Schoenbaum
Michigan Law Review
In Toyko recently I called upon an official of the Ministry of International Trade and Industry (MITI) to discuss trade frictions between the United States and Japan. On the way to my appointment I passed by Hibiya Park in the center of the city. About 10,000 people were gathered in a peaceful demonstration against any lifting of Japan's quotas on imports of agricultural products. Inside the MIT! building I asked the official whether the quotas on beef and oranges would be abolished soon. He told me they would eventually be liberalized or abolished to please the United States, but that …
