Expressive Harms, "Bizarre Districts," And Voting Rights: Evaluating Election-District Appearances After Shaw V. Reno, Richard H. Pildes, Richard G. Niemi
Michigan Law Review
This article attempts to define the constitutional principles that characterize Shaw and to suggest how those principles might be applied in a consistent, meaningful way. Part I, in which we argue that Shaw must be understood to rest on a distinctive conception of the kinds of harms against which the Constitution protects, is the theoretical heart of the article. We call these expressive harms, as opposed to more familiar, material harms. In Part II, we briefly survey the history of previous, largely unsuccessful, efforts in other legal contexts to give principled content to these kinds of harms in redistricting. …

Due Process Rights Of Parents And Children In International Child Abductions, Dorothy C. Daigle
Due Process Rights Of Parents And Children In International Child Abductions, Dorothy C. Daigle
Vanderbilt Journal of Transnational Law
Rising divorce rates in recent years have led to increasingly frequent abductions of children by one parent away from the other parent. Often, abducting parents move the children to different jurisdictions in which the parents believe they can obtain a more favorable decision on custody. To remedy this problem, twenty-nine nations joined in 1980 to adopt the Hague Convention on the Civil Aspects of International Child Abduction. This Convention mandates the immediate return, upon request, of the abducted child to the state of habitual residence of the child. The Convention includes several limited exceptions to this mandate, applicable at the …

Culture And The Canadian Constitution, Patrick J. Monahan
Culture And The Canadian Constitution, Patrick J. Monahan
Osgoode Hall Law Journal
This article examines the current division of powers over cultural matters in the Canadian Constitution and the manner in which the 1992 Charlottetown Accord would have altered that distribution. During the debate over the Charlottetown Accord, it was argued by the federal government and the provinces that the Constitution allocates primary legislative responsibility over cultural matters to the provinces. Therefore, the cultural amendments in the Accord which would have recognized the provinces' exclusive jurisdiction to make laws in relation to culture were justified on the basis that they merely codified the status quo. This paper challenges the belief that the …

Allotment In Severalty On The Northern Ponca Reservation: The Geography Of Disposession, Oliver Raimund Froehling
Allotment In Severalty On The Northern Ponca Reservation: The Geography Of Disposession, Oliver Raimund Froehling
Department of Geography: Dissertations, Theses, and Student Research
In 1890 the Ponca Reservation in Knox and Boyd county was parcelled up and each individual Ponca received a plot of land as his or her own. The remaining 72,000 acres were opened for settlement under the Homestead Act. During the next few decades, most of the remaining Ponca lands held by individuals were sold to non-Indians. When the Ponca were allowed to acquire some tribal lands under the 1934 Indian Reorganization Act, the land base had already disintegrated. One effect of this disintegrating land base was the increased out-migration of tribal members which eventually led to termination of the …
