Ecosystem Management And The Everglades: A Legal And Institutional Analysis, Thomas T. Ankersen, Richard Hamann Jul 1996

Ecosystem Management And The Everglades: A Legal And Institutional Analysis, Thomas T. Ankersen, Richard Hamann

UF Law Faculty Publications

Three dominant themes can be distilled from ongoing efforts to identify a set of generic principles to guide the management philosophy known as ""ecosystem management."" These include: (1) the notion of boundaries, both geographical and institutional; (2) scientific uncertainty; and (3) governance. This article analyzes the manner in which the present legal and institutional framework for environmental management addresses these themes.

Part II identifies the problems inherent in defining the appropriate management unit for ecosystem management and in delineating the unit's boundaries in the face of inherently complex and unstable ecological factors. Part II also considers the more insidious institutional …

Constitutional Reform And Social Difference In New Zealand, Jack H. Nagel Jul 1996

Constitutional Reform And Social Difference In New Zealand, Jack H. Nagel

Cardozo Journal of International and Comparative Law

The article examines New Zealand's transition to a mixed-member proportional (MMP) electoral system, emphasizing its innovative approach to ensuring representation for the Maori minority. It argues that the MMP system, combined with dual constituencies (MMP-DC), offers a unique solution to the challenges of representing minority groups in plural societies, providing both descriptive and substantive representation without marginalization. The analysis highlights the historical and political processes that led to this system, which could serve as a model for other democracies facing similar challenges.

Siting, Justice, And The Environmental Laws, Rodger C. Field Jul 1996

Siting, Justice, And The Environmental Laws, Rodger C. Field

Northern Illinois University Law Review

Environmental justice is gaining momentum throughout the country. As a result, industrial development can no longer be determined solely by the dictates of one agency or entity. Environmental justice requires efforts of all to participate in the decision-making process to determine how industry will develop in the future. This article traces the history and themes of the environmental justice movement and examines that movement's impact on industrial development. Specifically, the article focuses on how the environmental justice movement affects future source-siting decisions and its ramifications on the various levels of government and on the industrial development. The article concludes by …

Economic Foundations Of The Current Regulatory Reform Efforts, W. Kip Viscusi Jul 1996

Economic Foundations Of The Current Regulatory Reform Efforts, W. Kip Viscusi

Vanderbilt Law School Faculty Publications

Almost since the inception of the risk and environmental agencies in the early 1970s, there has been a continuing concern with ensuring that regulations yield societal benefits commensurate with their costs. This recognition of the need for balance, in turn, has led policymakers to seek a greater role for economists, and the principles of economic analysis undoubtedly will continue to play a central role in the debate over the future of regulatory policy.

The Mixed Constitution After Liberalism, Graham Walker Jul 1996

The Mixed Constitution After Liberalism, Graham Walker

Cardozo Journal of International and Comparative Law

The article proposes a mixed constitution as a solution to the ideological conflict between liberal and illiberal values, particularly in post-communist nations. It argues that a mixed constitution, combining elements of both ideologies, can provide a balanced approach that avoids the extremes of either system, fostering stability and justice.

Stratified Juror Selection: Cross-Section By Design, Nancy J. King, G. Thomas Munsterman Jun 1996

Stratified Juror Selection: Cross-Section By Design, Nancy J. King, G. Thomas Munsterman

Vanderbilt Law School Faculty Publications

Of the various selection methods that contribute to the underrepresentation of members of racial and ethnic minority groups on juries, peremptory challenges have attracted the most attention in recent years. Yet gains in diversity from regulating, or even eliminating, peremptory challenges are necessarily limited by the composition of the venire from which jurors are chosen. This article describes methods of constructing lists of veniremembers and qualified jurors used by some courts to restore the racial and ethnic diversity that is missing from the primary source lists or is eroded in the process of summoning and qualification. It also evaluates potential …

Religious Tolerance And Its Limits In Early America, George Dargo May 1996

Religious Tolerance And Its Limits In Early America, George Dargo

Northern Illinois University Law Review

This article posits that religious toleration in early America was rooted in practical considerations amid the necessities of settlement. The British colonies in North America achieved an unparalleled degree of religious liberty. Even groups that were on the social margins of American life--e.g., Roman Catholics, Jews, African Americans--gained a measure of social recognition and religious toleration because they found a role or served certain necessary functions in a developing society. Native Americans were not similarly treated because they were never able to establish equivalent functional utility. Philosophical advocates of Religious Toleration and Freedom of Conscience--principally Roger Williams and John Locke--envisaged …

The Substantial Burden Of Municipal Zoning: The Religious Freedom Restoration Act As A Means To Consistent Protection For Church-Sponsored Homeless Shelters And Soup Kitchens, Marc-Olivier Langlois May 1996

The Substantial Burden Of Municipal Zoning: The Religious Freedom Restoration Act As A Means To Consistent Protection For Church-Sponsored Homeless Shelters And Soup Kitchens, Marc-Olivier Langlois

William & Mary Bill of Rights Journal

Despite the increase in poverty and homelessness in the United States, many municipalities are attempting to use zoning regulations to limit the spread of church-sponsored programs that minister to the poor. Although the Religious Freedom Restoration Act of 1993 (RFRA) suggests that courts should find churchsponsored programs exempt from the burdens of municipal zoning, recent decisions in federal courts demonstrate that church-sponsored homeless shelters and soup kitchens will receive the same inconsistent protection they received under traditional Free Exercise Clause analysis. This Note argues that enforcement of zoning regulations places a substantial burden on church-sponsored programs that minister to the …
