Some Intersections Of The Negative Commerce Clause And The New Federalism, James F. Blumstein

Much has been written about the change in the Supreme Court's judicial philosophy, as a new, ascendant majority has been able successfully to implement its emerging notions of judicial reticence and self-abnegation. This fundamental turnabout in judicial perspective is hardly coincidental, since it reflects the fulfillment of an oft-repeated campaign pledge of Richard Nixon, who in 1968 promised, if elected, to appoint so-called strict constructionists to the Court.' In a basic way his appointees have succeeded in modifying the activist stance that prevailed on the Court during much of the tenure of Earl Warren as Chief Justice. With notable exceptions …

An Environmental Overview Of Geothermal Resources Development, A. Dan Tarlock, Richard L. Waller

While the adverse environmental effects of geothermal resources development appear to be less severe than those created by other energy sources, geothermal development nonetheless poses serious environmental problems. Professor Tarlock and Mr. Waller identify and discuss four categories of potential adverse environmental impacts of geothermal development: land use disturbance, water pollution, air pollution and noise.

Property And Tort In Nuclear Law Today, Kazimierz Grzybowski, William Dobishinski

Legal regimes regulating the exploitation of atomic energy follow three patterns. The pattern adopted in a particular country depends upon its social and governmental structure. In socialist states, like the Soviet Union, the state owns and uses nuclear materials and installations and is a monopolistic insurer against atomic hazards. In such states nuclear energy law is simplicity itself. It consists of instructions and regulations on the handling, transport and storage of nuclear materials, and the management of nuclear installations by administrative agencies. An important part of the regulations deals with the safety and health of the workers.
