Prospects For Increased State And Public Control Over Ocs Leasing: The Timing Of The Environmental Impact Statement, Edward Corwin
San Diego Law Review
This Comment reviews the current opportunities for state, local government, and public influence on the Department of Interior's Outer Continental Shelf decisions. The author argues that, while federal statutory procedures provide local governments and the public various opportunities to provide input regarding oil and gas leases on the Outer Continental Shelf, these channels of input fall far short of facilitating effective participation by these groups in federal decisions concerning those leases. The author suggests that earlier public availability of the Draft Environmental Impact Statement may remedy some of the inadequacies of the current process.

Warsaw Convention Liability Limitations: Constitutional Issues, Thomas J. Dolan
Warsaw Convention Liability Limitations: Constitutional Issues, Thomas J. Dolan
Northwestern Journal of International Law & Business
The equal protection claim closely tracks the substantive due pro- cess claim. Both claims will succeed only if the liability limitations prove not to be means rationally related to a legitimate purpose. A right-to-travel challenge to the liability limitations should also fail. The liability limitations simply do not restrict travel. Nor do the liability limitations impose a prohibitive penalty on international air trav- elers. There is no constitutional right to the most desirable liability terms nor to the least expensive transportation. There remains the question of whether the liability limitations, converted to dollars at the last official price of gold, …

This article suggests a normative framework which, if adopted and internalized by our political, economic, and social institutions, might enable them to serve as vehicles for ensuring that future generations will inherit their just share of our global heritage. Its thesis is that the human species holds the natural and cultural resources of the planet in trust for all generations of the human species. The article focuses on our duty towards the human species, for it is on this fiduciary duty that law and political institutions can be brought most readily to bear. This planetary trust obligates each generation to …

The Path Along The Ridge: Regional Planning In The Face Of Uncertainty, Kai N. Lee
Washington Law Review
The Northwest Power Act responds to the changing circumstances of electric power in the Pacific Northwest by defining policy directions and creating new institutional arrangements for regional power planning. The Northwest Power Planning Council (Council) is the agent of the region in meeting the challenges of planning under the Act. This paper discusses the conceptual framework of regional power planning—a task that confronts a degree of uncertainty and risk without historical precedent.

Eis Supplements For Improperly Completed Projects: A Logical Extension Of Judicial Review Under Nepa, Michigan Law Review
Eis Supplements For Improperly Completed Projects: A Logical Extension Of Judicial Review Under Nepa, Michigan Law Review
Michigan Law Review
This Note argues that the private cause of action under NEPA retains its utility despite the completion of the project sued upon. Part I describes the procedural implementation of the policy concerns underlying NEPA through the EIS process for proposed actions, and the EIS supplementation process for project changes made after the original EIS has been prepared. Part II examines current law applicable to projects completed in violation of NEPA and concludes that the denial of post-completion relief conflicts with the underlying goals of NEPA. Part III analyzes extension of relief to completed projects, and proposes court-ordered EIS supplementation for …
