Taking Uncertainty Seriously: From Permissive Regulation To Preventative Design In Environmental Decision Making, R. Michael M'Gonigle, T. Lynne Jamieson, Murdoch K. Mcallister, Randall M. Peterman

Osgoode Hall Law Journal

This paper contrasts two paradigms of environmental regulatory decision making, "permissive regulation" and "preventative design," with respect to their treatment of scientific and legal uncertainty and the allocation of legal standards and burdens of proof. "Permissive regulation," which is the predominant approach in Canada, suffers two types of statistical errors. A type I error occurs when, for example, a pollution control device is unjustly imposed on an industry. A type II error occurs when no action is taken to control an industry when, in fact, damage is taking place. Concern to prevent type I errors often leads to type II …

Borders, Barriers, And Other Obstacles To A Holistic Environment, Steven M. Siros Jul 1993

Borders, Barriers, And Other Obstacles To A Holistic Environment, Steven M. Siros

Northern Illinois University Law Review

This article addresses the barriers and obstacles that are facing parties harmed by transboundary pollution in the Great Lakes ecosystem. The article advocates the breakdown of reciprocal access for parties on both sides of the border. The article further advocates the breakdown of substantive barriers facing parties harmed by transboundary pollutants via the integration of the fragmented regulatory scheme into one holistic environmental statute. The environment must be looked at in a holistic manner, and the breakdown of the substantive and procedural barriers facing parties affected by pollutants is a step in that direction.

Advocacy And Diplomacy In The Great Lakes: A Case History Of Non-Governmental-Organization Participation In Negotiating The Great Lakes Water Quality Agreement, Jack Manno

Buffalo Environmental Law Journal

This article describes and analyzes the role of non-governmental organizations, or NGOs, in the system of governance that has developed to manage the use of natural resources, and that management's impact on the Great Lakes ecosystem. Particular emphasis is given to the organizational history of one such NGO, Great Lakes United, and its actions and strategies in relation to the Canada-U.S. Great Lakes Water Quality Agreements, and to the negotiations leading to the 1987 Protocol to the Agreements. My more general purpose is to contribute to the development of a literature of NGO case histories in order to provide an …

Pollution Control In An Era Of Economic Redevelopment: An Overview, Kurt A. Strasser Apr 1993

Pollution Control In An Era Of Economic Redevelopment: An Overview, Kurt A. Strasser

Connecticut Journal of International Law

The worldwide growth of interest in environmental protection is one of the most startling legal developments of the late Twentieth century. As recently as twenty-five years ago, the presentation of an environmental law panel at a symposium such as this would have been unimaginable. At that time, in neither East nor West was environmental law an important area of social concern or a topical area of interest to practical lawyers. Environmental protection was often paid lip service, but the reality was that it counted for little. Indeed, the question of tradeoff between environmental protection versus economic development, however inaccurate today, …
