What Can States Teach? The Right To Education After Mahmoud, Will Simon

In the summer of 2025, the U.S. Supreme Court set new limits on what public schools could require students to learn. Mahmoud v. Taylor pitted a school district interested in promoting pluralism against religious parents who wished to withdraw their children from classroom instruction that promoted celebration and acceptance of LGBTQ+ people. The Court found a violation of those parents’ constitutional right to freely exercise their religion, which both expanded the control parents can exert over their child’s public school education and increased the likelihood of similar claims going forward. The Mirage Of Meta Pixel Code: Redefining Pii In The Era Of Generative Ai, Sophie Venter

Data privacy laws are intended to put consumers in control of whether their identifying data can be sold and used for targeted advertising. However, these laws do not provide adequate protections in the era of generative artificial intelligence (AI). This Note examines one way that existing privacy law permits companies to profit from selling data for targeted advertising without obtaining user consent: transferring video watching data in a pixel code. Some U.S. Courts of Appeals have determined that these data transfers do not sufficiently identify users and the videos they watched to constitute violations of user privacy. This has led …

การเผยแพร่ข้อมูลบนสื่อออนไลน์มีลักษณะคงอยู่อย่างถาวรและสามารถเข้าถึงได้ตลอดเวลา เมื่อข้อความอันอาจเป็นการหมิ่นประมาทถูกเผยแพร่ผ่านแพลตฟอร์มดิจิทัล ปัญหาทางกฎหมายจึงเกิดขึ้นว่าควรเริ่มนับอายุความเมื่อใด เนื่องจากภายใต้หลักการเผยแพร่หลายครั้ง (Multiple Publication Rule) การเข้าถึงเนื้อหาแต่ละครั้งอาจถูกตีความว่าเป็นการกระทำความผิดใหม่ ส่งผลให้อายุความถูกขยายออกไปอย่างไม่มีที่สิ้นสุด ทำให้ผู้เผยแพร่ต้องเผชิญความเสี่ยงทางกฎหมายอย่างไม่มีกำหนด อันก่อให้เกิดผลกระทบเชิงยับยั้ง (chilling effect) ต่อเสรีภาพในการแสดงความคิดเห็น และเกิดความไม่สมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียงของบุคคล บทความวิจัยนี้ศึกษาวิเคราะห์มิติปัญหาทางกฎหมายว่าด้วยการกำหนดจุดเริ่มต้นการนับอายุความของความผิดฐานหมิ่นประมาทที่กระทำผ่านสื่อออนไลน์ โดยมีขอบเขตการศึกษาครอบคลุมถึงแนวคิดว่าด้วยการสร้างดุลยภาพระหว่างเสรีภาพในการแสดงความคิดเห็นกับการคุ้มครองชื่อเสียง การตรวจสอบหลักเกณฑ์การนับอายุความตามประมวลกฎหมายอาญาและประมวลกฎหมายแพ่งและพาณิชย์ของไทย และการศึกษาเปรียบเทียบพัฒนาการ บรรทัดฐานคำพิพากษา และบทบัญญัติทางกฎหมายของประเทศอังกฤษและสหรัฐอเมริกาที่นำหลัก Single Publication Rule มาปรับใช้ ผลการศึกษาพบว่า การปรับใช้หลักการนับอายุความแบบเดิมที่ถือว่าการเผยแพร่ซ้ำแต่ละครั้งเป็นความผิดใหม่ไม่สอดคล้องกับลักษณะของสื่อออนไลน์ และก่อให้เกิดภาระเกินสมควรแก่ผู้เผยแพร่ จึงควรนำหลัก Single Publication Rule มาใช้ โดยถือว่าการเผยแพร่เนื้อหาที่มีสาระสำคัญเดียวกันเป็นการกระทำเพียงครั้งเดียวและเริ่มนับอายุความนับแต่วันที่เผยแพร่ครั้งแรก เว้นแต่การเผยแพร่ครั้งหลังจะมีความแตกต่างอย่างมีนัยสำคัญจึงจะถือเป็นการเผยแพร่ใหม่ อย่างไรก็ดี การนำหลักดังกล่าวมาใช้ควรกำหนดรายละเอียดและกลไกทางกฎหมายเพิ่มเติม อาทิ การให้ดุลพินิจแก่ศาลในการขยายอายุความ การกำหนดขอบเขตระยะเวลาและการนับอายุความจากวันที่เผยแพร่ครั้งแรกให้ชัดเจน ตลอดจนมาตรการที่ใช้บังคับกับคลังข้อมูล แพลตฟอร์ม และผู้เผยแพร่ เพื่อสร้างความสมดุลระหว่างเสรีภาพในการแสดงความคิดเห็นกับสิทธิในชื่อเสียง ให้สอดคล้องกับบริบทของสังคมดิจิทัล

บทความนี้มุ่งศึกษาถึงการคุ้มครองสิทธิอนามัยเจริญพันธุ์ของสตรีและผู้มีความหลากหลายทางเพศในบริบทประเทศไทย ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน เช่น อนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) หลักการยอกยาการ์ตา และเป้าหมายการพัฒนาที่ยั่งยืนข้อที่ 5 ซึ่งต่างยืนยันถึงสิทธิในการเข้าถึงสุขภาพทางเพศและอนามัยเจริญพันธุ์อย่างเสมอภาคและปราศจากการเลือกปฏิบัติ จากการศึกษาพบว่า แม้ประเทศไทยจะมีความก้าวหน้าในเชิงกฎหมายและนโยบาย แต่ยังคงเผชิญอุปสรรคสำคัญ อาทิ อคติจากผู้ให้บริการ ความเหลื่อมล้ำทางเศรษฐกิจและภูมิศาสตร์ ตลอดจนข้อจำกัดทางกฎหมายที่ยังไม่สอดคล้องกับมาตรฐานสิทธิมนุษยชนสากล การศึกษาวิจัยนี้จึงมุ่งศึกษาพัฒนาการและปัญหาทางกฎหมายและนโยบายของประเทศไทยที่เกี่ยวข้อง เช่น การยุติการตั้งครรภ์ การขยายสิทธิประโยชน์ด้านการคุมกำเนิด การบริการอนามัยเจริญพันธุ์ รวมถึงสิทธิในการเข้าถึงบริการยาฮอร์โมนและการยืนยันเพศสภาพ โดยศึกษาเปรียบเทียบกับการคุ้มครองสิทธิอนามัยเจริญพันธุ์ในสหราชอาณาจักร เยอรมนี และอินเดีย อันเป็นตัวอย่างการพัฒนากลไกกฎหมายและนโยบายที่ช่วยลดความเหลื่อมล้ำและสร้างระบบบริการที่เป็นมิตร เพื่อยกระดับกลไกทางกฎหมายและนโยบายสาธารณะของไทยให้สามารถส่งเสริมและสนับสนุนสิทธิอนามัยเจริญพันธุ์เกิดขึ้นจริง ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน และบรรลุเป้าหมายการพัฒนาอย่างยั่งยืนได้ต่อไป

Kosovo’S Strategic Missteps With International Law, Parker W. Remick, Robert Muharremi

This paper interrogates the principle of selective engagement with international law in the foreign policy of Kosovo, arguing that international law functions less as a neutral arbiter between states and more as a pliable instrument wielded in the pursuit of national objectives. Through a meticulous analysis of Kosovo’s post-2008 trajectory, the study unveils a pattern of selective engagement with international legal mechanisms highlighting both moments of strategic acumen and critical miscalculations. Postcolonial studies scholar Muzna Rahman reviews Children No More: Were and Are Gone, Hilla Medalia’s Academy Award-nominated short documentary. The film documents pro-peace Israeli activists who gather regularly in Tel Avivi to hold a silent vigil for Palestinian children killed by Israel forces. Against the backdrop of everyday urban life, the protestors simply hold photos of the children, commemorating their lives rather than their brutal deaths. The images of Palestinian children held by Israeli activities highlights the similarities between the groups, while the rage of passersby reveals the danger that Israelis who advocate for peace face in their work.

Four for Gideon, composed by American Michael Schachter, is a new setting for four Czech and Polish folk songs, with tunes previously arranged by Gideon Klein (1919–1945) during his imprisonment in the Terezin (Theresienstadt) Ghetto, a concentration camp in the present-day Czech Republic. Klein served as a music director there before being transferred to Auschwitz, where he was murdered. Four for Gideon was commissioned by the Standford Eisenberg Jewish Day School in Knoxville, Tennessee, and was premiered by the Knoxville Symphony Orchestra (Aram Demirjian, music director) on March 5, 2025, in a performance in honor of Violins of Hope, …

Abuse of presidential pardon power is taking a new and frightening turn. The Donald Trump administration is using clemency, including pardons, to signal impunity to regime allies contemplating misconduct. Such clemency has a predictable effect: it induces loyalist crime by reducing the expected penalty. "Patronage pardoning" refers to the clemency practices that power this loyalty-for-protection exchange. Those practices pose a grave threat to the rules-based constitutional order, and they are the subject of this Article.
Some historical observations predicate the diagnostic and prescriptive arguments that come later. Most importantly, the Framers concentrated federal pardon power in the president because they …

Twenty-seven years ago, in Olmstead v. L.C., the Supreme Court held that improperly institutionalizing people with disabilities is a form of unlawful discrimination. In doing so, the Court acknowledged that people with disabilities have a right to live free from confinement. Yet today, repair restrictions and outdated Medicare standards combine to threaten powered-wheelchair users' ability to live out in the world. Some states have responded by passing right-to-repair laws, which require powered-wheelchair manufacturers and suppliers to provide the resources necessary for more accessible and more timely repairs. Law enforcement agencies struggle to recruit and retain officers due to lack of public support, criticism, and declining well-being, which raises stress levels. While operational stress affects officers, organizational stress is more damaging. Transformational leadership can help create a psychologically safe work environment, but research on this link is limited and mixed. This study examined how each HEXACO personality trait (Honesty-Humility, Emotionality, Extraversion, Agreeableness, Conscientiousness, Openness) moderates this relationship, drawing on social exchange and attribution theories. The purpose of this case study was to explore the differentiation of instructional methods used for cluster-grouped gifted students in third through eighth-grade regular education classes at TCSS, a Title I school in North Carolina. For the research, differentiation for cluster-grouped gifted students was defined as students who have been identified as gifted and are grouped together, typically in clusters of three to more than 10 students in a regular education setting. In this environment, teachers differentiate instruction to meet the advanced learning needs of their students. The theory guiding this study is Gardner’s theory of multiple intelligences. The massive destruction and social dislocation wrought by capitalist crisis has culminated, historically, in the brutal cataclysms of fascism and other forms of authoritarian rule. Today, across the globe, we are confronted with the aggressive advance and entrenchment of a variety of such authoritarian political projects. Anxious discourses about ascendant fascism have become perfectly mainstream. These developments command our acute attention and critical analysis. This essay addresses these dire questions and the conceptual vexations surrounding the concept of fascism, particularly as it has been elaborated in various Marxist analyses. Generative AI is making it easier for self-represented litigants to produce polished legal documents, but easier filing does not necessarily lead to better outcomes. This presentation examines how AI may expand access to courts while increasing weak filings, early dismissals, and burdens on the legal system.
The session reviews attorneys’ duties of technological competence, confidentiality, supervision, and citation verification. It also distinguishes general-purpose AI from legal research tools. Using a Utah third-party custody and guardianship problem, the presentation compares several tools based on statutory accuracy, legal comprehension, treatment of case law, and completeness. The deployment of “bodyguard satellites”—spacecraft designed to autonomously detect and counter hostile space objects—has moved from classified capability development to explicit national security policy across a growing number of States. This article examines the circumstances under which interference with another State’s satellite may be legally justified under international law, analyzing several possible grounds: self-defense under Article 51 of the UN Charter, forcible countermeasures, non-forcible countermeasures, and necessity. Drawing on a survey of national space defense policies, jurisprudence of the International Court of Justice, and the law of State responsibility, the article reaches two principal conclusions.
