Operationalising The Social Licence To Operate Along The Belt And Road: The Case For A Mediation-Focused Approach, Mark Mclaughlin
Operationalising The Social Licence To Operate Along The Belt And Road: The Case For A Mediation-Focused Approach, Mark Mclaughlin
Research Collection Yong Pung How School Of Law
This article examines the intricate dynamics of community representation and stakeholder influence in the realm of international investment law. More specifically, it considers the most effective method by which to operationalise the concept of the ‘social licence to operate’ when attempting to resolve investor-state disputes. By utilising disputes relating to China’s Belt and Road Initiative as a case study, it is shown that the social impact of foreign investment projects is often a catalyst for arbitration claims. Community interests are insufficiently represented at the stage of procurement or admission of investment, which has led to violent clashes between investors and …
Exceptions To The International Customary Law Rule On Head Of State Immunity Under International Criminal Law, Daniel D. Ntanda Nsereko
Exceptions To The International Customary Law Rule On Head Of State Immunity Under International Criminal Law, Daniel D. Ntanda Nsereko
Cardozo International & Comparative Law Review
The article examines the tension between head of state immunity and the pursuit of justice in international criminal law. It argues that while some nations and regional bodies, like the African Union, assert immunity for heads of state, international institutions such as the International Criminal Court (ICC) reject this principle, emphasizing the rule of law and accountability. The ICC's jurisdiction, particularly through UN Security Council referrals, overrides state consent, challenging traditional notions of immunity. The article posits that states must adhere to their treaty obligations, such as the Rome Statute, and cannot unilaterally opt out for political expediency, reinforcing the …

Legal text poses distinctive challenges for natural language processing. The legal import of a term may depend on omissions, cross-references, or silence, Further, legal text is often susceptible to multiple valid, conflicting interpretations; as the saying goes: a good lawyer’s answer to any question is “it depends.”This work introduces a new, hand-coded dataset for the interpretation of privacy policies. It includes privacy policies from 149 firms, including materials incorporated by reference. The policies are annotated across 64 dimension that reflect the applicable legal rules and contested terms from EU and US privacy regulation and litigation. Our annotation methodology is designed …

Statewide Injunction: State Judicial Power And Meaningful Remedies, Constance C. Van Kley
Statewide Injunction: State Judicial Power And Meaningful Remedies, Constance C. Van Kley
Faculty Law Review Articles
As federal courts increasingly limit the scope of constitutional remedies, state courts have begun issuing statewide injunctions that extend protections beyond individual litigants. This article examines the doctrinal foundations and implications of such injunctions, arguing that they represent a legitimate exercise of state judicial power. By analyzing historical practices, procedural norms, and recent case law, the author contends that statewide injunctions can serve as essential tools for enforcing civil rights and ensuring meaningful relief. The piece calls for a reevaluation of remedial doctrines to better accommodate the evolving role of state courts in safeguarding constitutional guarantees.
Wealth Taxes Under The Constitution: An Originalist Analysis, David M. Schizer, Steven G. Calabresi
Wealth Taxes Under The Constitution: An Originalist Analysis, David M. Schizer, Steven G. Calabresi
Faculty Scholarship
A federal wealth tax is high on the wish list of progressives, but is it constitutional? This Article shows that under the original public meaning of the Constitution, a wealth tax is a “direct tax” that must be apportioned. This means that the percentage of revenue collected in each state must match its percentage of the population. For instance, if two states both have three percent of the population, each must provide three percent of the revenue. This leads to an unappealing outcome: if one state is less wealthy, it needs a higher tax rate to supply its share.

The Role Of Private Law In Promoting Building Safety: The Case Of Singapore, Edward S. W. Ti
The Role Of Private Law In Promoting Building Safety: The Case Of Singapore, Edward S. W. Ti
Research Collection Yong Pung How School Of Law
Singapore is a tiny granite rock situated just north of the equator. Lacking land, and indeed any kind of natural resource, means that the trend for urban development in the city-state will always be densifi cation; 96 per cent of residents in Singapore already live in multi-owned housing, ie high-rise apartments. 1 Singapore is also a rapidly greying nation. 2 It has been observed that persons over 70 years old are four times more vulnerable in the event of a fi re, 3 and fi re safety is a critical aspect of building safety. The Basic Structure In Malaysia: Less Than Meets The Eye, Benjamin Joshua Ong
The Basic Structure In Malaysia: Less Than Meets The Eye, Benjamin Joshua Ong
Research Collection Yong Pung How School Of Law
At first glance, studying the basic structure doctrine in Malaysia can be frustrating due to its inconsistent judicial treatment. While early cases such as Loh Kooi Choon and Phang Chin Hock rejected the doctrine, it was later accepted in landmark decisions like Sivarasa Rasiah, Semenyih Jaya, and Indira Gandhi. In 2020, scholars such as Jaclyn Neo and Yvonne Tew suggested a judicial embrace of the doctrine and its global trend toward constitutional unamendability. However, the Federal Court’s 2021 decision in Maria Chin Abdullah appeared to reject it once more, illustrating the doctrine’s precarious status. The resurgence seen in Dhinesh a/l …
Digital Economy Innovation In The Indo-Pacific: Towards A 'Singapore Effect'?, J.G. Allen, Qiu Xu Martin Liao
Digital Economy Innovation In The Indo-Pacific: Towards A 'Singapore Effect'?, J.G. Allen, Qiu Xu Martin Liao
Research Collection Yong Pung How School Of Law
This paper examines the rise of Digital Economy Agreements (DEAs) in the Indo-Pacific as a strategic response to digital trade fragmentation and great power competition. Focusing on Singapore’s leadership, we introduce the ‘Singapore Effect’ – a model of regulatory influence distinct from others, such as the ‘Brussels Effect’ and ‘Beijing Effect.’ Unlike market-driven regulatory diffusion, the Singapore Effect emphasizes interoperability, norm entrepreneurship, and mini-lateralism, enabling middle powers to shape digital trade governance. We analyze DEA formation, implementation challenges in national law, and Singapore’s role as a bridge between diverse regulatory regimes. DEAs’ flexible, modular structure allows for incremental regulatory alignment …

The Crucial Role Of Insolvency Law In Job Creation And Preservation, Andrés F. Martínez, Aurelio Gurrea-Martinez, Harish Natarajan
Research Collection Yong Pung How School Of Law
When companies face financial trouble, potential job losses can be a major risk for people and—depending on the size of the company or industry in trouble—a risk to local or national economies. An efficient insolvency system can mitigate this risk while contributing to the creation of more and better jobs. As jobs are the most critical tool in fighting poverty, a better understanding of the effects of insolvency law on employment is vital for development work.
Racial Capitalism, Neocolonial Wealth Transfer, And Canadian International Student Policy, Vincent Wong, Arman Sohi
Racial Capitalism, Neocolonial Wealth Transfer, And Canadian International Student Policy, Vincent Wong, Arman Sohi
Dalhousie Law Journal
This paper examines historical and contemporary trends in Canadian international student policy through the lens of racial capitalism, arguing that current policy facilitates a significant neocolonial wealth transfer from Global South families to Canada through processes of expropriation, exploitation, and expulsion. It argues that discriminatory tuition fees effectively function as “education head taxes”, which extract billions of dollars annually from international students. Meanwhile, “gauntlets” to permanent residency have emerged in an immigration landscape where working class migrants have narrower options to regularize, creating a system of labour exploitation where student-labourers face precarious conditions and structural indebtedness. Finally, the constant threat …
Extractivism And Water Crisis In The Moroccan Draa Oasis: Global South Reflections On Responsibility And Resistance, Ahmed El Khatabi
Extractivism And Water Crisis In The Moroccan Draa Oasis: Global South Reflections On Responsibility And Resistance, Ahmed El Khatabi
Journal of Maya Heritage
Abstract. The Draa Oasis in southeastern Morocco is experiencing severe water scarcity, driven by climate change and intensified by the expansion of watermelon agribusiness and desert tourism. This article explores how external investors, empowered by national agricultural policies, have disrupted traditional water governance systems rooted in collective management. Through ethnographic fieldwork involving interviews, focus groups, and spatial mapping, the study examines the socio-environmental consequences of groundwater depletion and land commodification. It argues that investors fail to assume ethical accountability for the ecological degradation they cause, despite being aware of the oasis’s fragile ecosystem. Meanwhile, local communities and civil society actors …

Abandoning The Iron Horse: Railroad Rights-Of-Way And The Implied Doctrine Of Reverter On Indian Reservations, Arthur B. Macomber
Public Land & Resources Law Review
Land title issues on Indian Reservations are notoriously but unnecessarily complex. Unsettled land titles and the resulting fragile land ownership status on Indian Reservations are well-known factors impeding productive land uses, the cure of environmental degradation, and Indian sovereignty, ownership, and control over sustainable land uses. Some lawsuits even question the existence of a Reservation itself. Land titles to many parcels on Indian Reservations have been split into thousands of owners. Using existing law and principles of equity, abandoned Reservation rights-of-way of many types do not have to sit unused and economically unproductive. Future lawsuits and other wasteful societal friction …

The Enduring Legacy Of The Habsburg Islam Policy: Muslim Communities In Central And Southeast Europe, Sevgi Adak, Thomas Schmidinger
Exploring Muslim Contexts
Examines contemporary legal and political structures governing Muslim communities in Central and Southeast Europe.
When Otto Habsburg – son of the last emperor of the Austria-Hungarian Empire Karl I – died in 2011, among those who prayed at the funeral was Mustafa Efendi Cerić, the Reis-ul-ulema of Bosnia and Herzegovina – the highest Islamic office in the country. This was to honour the long-lasting relationship between the bygone empire of the Catholic Habsburgs with Bosnian Muslims. The cornerstone of this relationship was the 1912 Islam Act (Islamgesetz) of the Habsburgs, which granted Islam legal recognition and incorporated it into …

Valuation Procedure For Condemnation: A Fifty State Survey, David Griffiths
Valuation Procedure For Condemnation: A Fifty State Survey, David Griffiths
BYU Law Review
The Fifth Amendment requires statutorily authorized condemnors to provide just compensation to landowners for all takings. The procedural method used by states to determine just compensation varies widely among states and is often separate from the more standard procedures existing in traditional civil litigation. Regardless of their method, all fifty states and the District of Columbia each have their own unique procedure for determining just compensation. This Note distinctly classifies the procedural schemes currently used by states to initially value just compensation of condemned property into three general categories: (1) schemes that rely on commissioners to determine just compensation, (2) …

The main focus is on minimizing static errors and improving the reliability of controllers. Optimization methods for PID and PI2D controllers are discussed, including the use of modern approaches such as genetic algorithms. The necessity of compromise solutions to achieve high-quality system responses to various impacts is investigated. It was also suggested that there is a need for an integrated approach to setting up controllers in order to increase their reliability and flexibility in conditions of dynamically changing processes. …
Licensure As Pathway, Not Barrier, Brian Gallini
Licensure As Pathway, Not Barrier, Brian Gallini
Arkansas Law Review
The legal profession knows it has an access to justice crisis. One side lacks a lawyer in approximately three-quarters of the twenty million civil cases filed across state courts every year. Against that concerning backdrop is how we license attorneys. The most common method is the written bar exam. But that exam bears little resemblance to the practice of law, produces racially disparate results, and is shockingly expensive for law graduates to prepare for and take. Its opaque scoring practices alongside its rare administration—offered just twice per year—strengthens the idea that the modern bar exam operates more as a barrier …

On 19 July 2024, the International Court of Justice (ICJ) rendered a historic ruling which declared that Israel’s presence in the Occupied Palestinian Territory (OPT) is unlawful. While this historic Advisory Opinion on the Legal Consequences Arising from Israel’s Policies and Practices in the OPT, including East Jerusalem (Advisory Opinion) should be celebrated, much more needs to be done in order to fully realize the decisions contained therein. This article presents an overview of the Republic of Indonesia’s legal arguments submitted to the ICJ concerning the request for an Advisory Opinion. Indonesia, a staunch supporter of the Palestinian cause, contends …

Compatibility Between The Indonesian Competition Law And Indonesia’S Climate Change Mitigation Policy Under The Unfccc Paris Agreement 2016: Quo Vadis?, Satya Arinanto, Dian Parluhutan, Louise Shania Sabela
Indonesian Journal of International Law
To overcome the global climate change crisis, the Government of Indonesia (GoI) ratified the United Nations Framework Convention on Climate Change (UNFCCC) Paris Agreement on Climate Change on 22 April 2016, imposing quasi-legal obligations on contracting states to reduce greenhouse gas (GHG) emissions based on Nationally Determined Contribution (NDC) until 2030. As a contracting party of the Paris Agreement, Indonesia has submitted an Enhanced Nationally Determined Contribution (ENDC), increasing its GHG emission reduction target from 31.98 percent to 43.20 percent by 2030. Pillar II of the Golden Indonesia Vision 2045, Indonesia has also reaffirmed its commitment to climate change mitigation …

Public Policy And The Refusal To Enforce Foreign Arbitral Awards: A Comparative Analysis Of France, Singapore, And Vietnam, Phan Hoai Nam
Indonesian Journal of International Law
The multilateral frameworks governing the recognition and enforcement of arbitral awards, such as the 1958 New York Convention, along with the domestic laws of most states, are generally designed to promote the efficient enforcement of foreign arbitral awards. However, practical experience reveals inconsistencies in its application. While many states adhere to international principles, some - despite being signatories to the Convention - have exploited the broad concept of public policy to unjustifiably refuse enforcement within their jurisdictions. Conversely, other states have adopted a more restrictive approach, limiting the public policy exception to ensure predictability in enforcement. This article focuses on …

Challenges In The Enforcement Of International Legal Framework Against Child Soldiering, Shedrack Ekpa, Daniel Friday Atidoga
Indonesian Journal of International Law
The war crime of child soldiering has contagiously blossomed, necessitating the application of several prohibitive legal standards for its extermination. As the impact of this heinous and atrocious crime soars, the multi-dimensional scope for the protection against child soldiering becomes more sternly entrenched. This article aims to interrogate this global and worrying phenomenon in the light of existing international legal framework. Alhough doctrinal in nature, this article relies on both primary and secondary sources of data. It was found that despite the high retinue of prohibitive norms as stipulated in various legal instruments, the war crime of child soldiering has …

Rooted in a rural community’s needs, this paper explores how historically, and ethically informed infrastructures can support community engagement towards identification, documentation, and dissemination of local, traditional, and indigenous knowledge relating to climate change. The paper examines climate adaptation and sustainability issues through the lenses of community organizing and Library & Information Science best practices. It draws on a growing body of literature identifying a role for expanded epistemological and subject discipline perspectives. While the impacts of climate on material culture are increasingly recognized, intangible, and biocultural heritage have not received as much attention. United States: Rhode Island Limited Bank Holiday, 1991, Ayodeji George, Sophia Alden
Journal of Financial Crises
In 1990, the Rhode Island Share and Deposit Indemnity Corporation (RISDIC) was a private mutual deposit insurance corporation funded by member institutions. Late that year, after the failures of two of its insured institutions in July and October, other RISDIC member institutions faced large depositor withdrawals, as concerns began to focus on the financial health of RISDIC itself. RISDIC had maintained inadequate reserves, and on December 31, 1990, it found itself lacking the resources to cover depositor withdrawals from member institutions. RISDIC leadership requested a state-appointed conservator, which meant that all its member institutions no longer had the deposit insurance …

The Greek government debt crisis was especially hard on the two largest Cypriot banks. Bank of Cyprus (BoC) and Laiki Bank lost EUR 1.8 billion and EUR 2.3 billion, respectively, on their Greek government bonds after the European Union (EU) decision in October 2011 to haircut the bonds. Over the next year, Laiki Bank faced severe liquidity problems from depositor withdrawals, the Central Bank of Cyprus (CBC) extended to it significant emergency liquidity assistance, and the government owned 84% of the bank after injecting EUR 1.8 billion. The Cypriot economy also suffered negative effects and in March 2013, authorities negotiated …

Time To Put Down Iq Testing: Analyzing The Unreliability Of Iq Testing In Capital Offenses, Nik Giyanani
Georgia Criminal Law Review
Georgia sentences individuals with intellectual disability (“ID”) to death at an alarming rate. As a result, Georgia has likely executed individuals with ID in violation of the United States Constitution already. These unjust executions are a result of the impossibly high “beyond a reasonable doubt” burden of proof that capital defendants in only Georgia must meet to prove they are intellectually disabled. One large hurdle for defendants attempting to meet this standard is the unreliability of IQ testing. IQ testing, a soft science, provides inconsistent results due to ever-changing variables in the testing process. Additionally, the generally accepted threshold IQ …

The Confined Life: Restrictions On Post-Conviction Sex Offenders Meets Habeas Corpus's "In Custody" Requirement, Christian Futch
Georgia Criminal Law Review
Clements v. Florida is a recent Eleventh Circuit decision holding that the court could not hear the habeas petition of a post-conviction sex offender in Florida since he failed to meet the “in custody” requirement for filing a habeas petition. However, the Eleventh Circuit did not consider the land restrictions in place against the petitioner and other sex offenders in Florida. This decision may leave sex offenders without an avenue to challenge the restrictions in place against them. Such restrictions have led to homelessness and poverty leaving sex offenders with no place to work or live, in poverty, as outcasts …
