The Running With The Land Of Agreements To Pay For A Portion Of The Cost Of Party Walls, Ralph W. Aigler Jan 1912

The Running With The Land Of Agreements To Pay For A Portion Of The Cost Of Party Walls, Ralph W. Aigler

Articles

Owners of adjoining properties, especially in cities, frequently find it advisable and advantageous to enter into arrangements whereby their buildings shall be supported by a common wall. These arrangements are ordinarily evidenced by party-wall agreements or covenants, so-called, out of which have grown a number of interesting questions. It not infrequently happens that when one owner desires to build such a wall his neighbor, for one reason or another, is not ready to join in the undertaking, so an agreement is entered into between the two adjoining owners whereby one agrees to proceed with the erection of the wall at …

A Treatise On The Constitution Of Georgia, Walter Mcelreath Jan 1912

A Treatise On The Constitution Of Georgia, Walter Mcelreath

Historical Treatises

Excerpt from the preface:

Every thorough lawyer and careful judge in Georgia has experienced great difficulty in tracing the history of constitutional provisions through the scattered and rare volumes of digests, codes and sessions laws and has suffered great inconvenience in ascertaining with certainty what was the organic law with respect to a given proposition at a given time. To remove this difficulty and to lessen this inconvenience, the preparation of the present work was undertaken, with the primary purpose to exhibit the fundamental law of the state,-not to furnish a commentary upon it. It was at first proposed only …

The Lien Or Equitable Theory Of The Mortgage--Some Generalizations, Edgar N. Durfee Jan 1912

The Lien Or Equitable Theory Of The Mortgage--Some Generalizations, Edgar N. Durfee

Articles

The question is--What is the nature of the rights of a real property mortgagee in those jurisdictions which adopt the lien or equitable theory3 of the mortgage? In one sense this question calls for a full statement of the law of mortgages but that, of course, is not the sense in which the writer puts it. He means by it to put a broader and more scientific question--a question, be it at once confessed, of jurisprudence--yet a question which has an important bearing on, if it is not in fact conclusive of, several specific problems in the law, which will …

Recovery Of Salary By A De Facto Officer, W. Gordon Stoner Jan 1912

Recovery Of Salary By A De Facto Officer, W. Gordon Stoner

Articles

The de facto doctrine in the law of officers has been a continual source of difficulty to the courts for more than a century. Many questions connected with the application of this doctrine to this branch of the law have been settled beyond controversy. Even the phase of this question which the writer proposes to discuss cannot be classed as new or novel. Recent years, however, have seen the development of certain tendencies on the part of some of the American courts in the application of this doctrine, which will furnish the subject for the major part of our consideration.

Possession Under Mistake As Adverse Possession, Ralph W. Aigler Jan 1912

Possession Under Mistake As Adverse Possession, Ralph W. Aigler

Articles

In Wissinger v. Reed et al., 125 Pac. lO3O (Aug. 24, 1912) the Supreme Court of Washington held that actual possession of land for the statutory period would confer title upon the occupant, although the possession was under a mistaken belief of ownership. While the doctrine that title to real property may be acquired by adverse possession has been firmly established in English and American law for a great many years, no little difficulty and confusion have arisen in determining what possession is adverse, especially where the actual possession upon which the claim of title is based has been under …

The Law In The United States In Its Relation To Religion, Edwin C. Goddard

Other Publications

Man is a religious being. To him, everywhere and always, religion and religious institutions have been and will be of prime concern. He is also a social being. As such he has always found it necessary to live in an organized society, under some form of government. Man never has lived to himself alone. Government is not an invention, a necessary evil, to which men submit. On the contrary, from the most primitive beginnings it has been man's natural though imperfect instrument for controlling and developing the social estate so essential to his very existence. And universally this government has …

The Rights Of Access Of An Upland Owner To Navigable Waters, Marshall John Rutherford Jan 1912

The Rights Of Access Of An Upland Owner To Navigable Waters, Marshall John Rutherford

University of the Pacific Theses and Dissertations

The question to be discussed in this dissertation is whether or not the upland owners on navigate waters live, by virtue of the position of their land a right of ocean to the free enjoyment of the water in front of the land there of for purpose of navigation.

The question here involved has been considered by many legislatures and courts as well as by many text writers and as a result of such consideration there is a great variety of opinions. I shall in this dissertation direct my attention to the law as believe it be in California.

The Mosaic Law, Clarence A. Lightner Dec 1911

The Mosaic Law, Clarence A. Lightner

Michigan Law Review

In recent years much has been learned of the civilization, which developed in early times in Mesopotamia. In Babylon, laws appropriate to a vast and wealthy agricultural nation, which was engaged, also, largely in commerce, had been developed many centuries before the authentic history of other peoples begins. This civilization was Semitic. A great light, where formerly but dim reflections had been seen, was thrown upon this jurisprudence by the discovery, in 1901, of the codification of the laws of Babylonia, which was promulgated by King Hammurabi about 2350 B. C. Migration from Babylonia occurred from time to time, and …
