Uniform Law Procedure In Federal Courts, Conner Hall Feb 1927

Uniform Law Procedure In Federal Courts, Conner Hall

West Virginia Law Review

A great drive is being made for the passage of a bill for investing the Supreme Court with power to prescribe rules of procedure for law actions in the Federal Courts. A committee of the American Bar Association, or perhaps rather a small number of a committee, has been active in propaganda work for the proposed legislation. Great names have been invoked, and meetings of the Bar Association and lawyers have been passing resolutions in favor of the bill, but the very unanimity with which some of these resolutions have been passed confirms a natural belief that the action was …

The Uniform Sales Act In The State Of Washington, Leslie J. Ayer Feb 1927

The Uniform Sales Act In The State Of Washington, Leslie J. Ayer

Washington Law Review

The Uniform Sales Act was enacted by the State of Washington at the extraordinary session of its legislature convened November 9, 1925, and adjourned January 7, 1926. Under constitutional provision 2 this law went into effect ninety days after the adjournment of the session at which it was enacted. The advantages of uniformity of legislation in matters pertaining to commercial subjects seems so obvious as to require but slight comment. In laws relating to commercial subjects, conditions and problems are rarely of a local nature, and in view of the great amount of trading which exists between the several states, …

The Inns Of Court, Frank E. Holman Feb 1927

The Inns Of Court, Frank E. Holman

Washington Law Review

The tendency of modern lawyers is to permit the profession to become a mere business and to give little or no attention to the tradition and romance of the law. During more than five centuries the Inns of Court have occupied an important place in the history and development of our jurisprudence. The constant growth and continuity which characterizes the great body of English law is not found in the native or national law of continental countries like France and Germany. Toward this characteristic entirety of English law the Inns of Court have contributed largely, for through the centuries of …

The Recognition Of Foreign Decrees Of Divorce, Wm. Turney Fox Feb 1927

The Recognition Of Foreign Decrees Of Divorce, Wm. Turney Fox

West Virginia Law Review

The question of the recognition of foreign decrees of divorce is one of real and growing importance. The conflict of law that exists in this country, where divorces are granted by one state and their validity tested in another, is one that is familiar to the legal profession. In fact, it is familiar to the public generally. The unfortunate situation of persons legally divorced in one state and not in another; of a second marriage valid in one state, declared invalid in another; and the general confusion resulting from such conflict is constantly presented to the public through the daily …

Sidelights On The Permanent Court Of International Justice, Ake Hammarskjold Feb 1927

Sidelights On The Permanent Court Of International Justice, Ake Hammarskjold

Michigan Law Review

In bidding you welcome, in the name of the Permanent Court of International Justice, in this room where that great institution holds its public meetings and pronounces its judgments and opinions, my first word should be, I think, one of regret-regret that a more worthy representative of the Court has not been able to receive you here today. And I daresay that the President of the Court, who would have been the obvious person to welcome you, shares those regrets,-although perhaps from a different point of view. He would, in fact, have liked immensely to be able to meet you …

Joinder And Splitting Of Causes Of Action, Charles E. Clark Feb 1927

Joinder And Splitting Of Causes Of Action, Charles E. Clark

Michigan Law Review

The pleading rules concerning joinder and splitting of causes of action are complements of each other, though designed to achieve different objectives. The joinder rule is that separate causes cannot be "joined" or pleaded in the same suit unless they fall within one of the classes of permissible joinder specified in the codes. The purpose of the rule is to prevent too wide a field of litigation and too diverse issues in a single suit and thus to avoid a case of undue confusion and complexity. The rule against splitting is that a single cause shall not be "split" or …

Trusts-Trust Estates As Bona Fide Purchasers Feb 1927

Trusts-Trust Estates As Bona Fide Purchasers

Michigan Law Review

The doctrine of bona fide purchase is of ancient origin. It has had many significances and interpretations attached to it. At one time it was explained entirely by the special nature of equity and equitable remedies. Maitland used it to show that equities were rights in personam. That the doctrine is no gauge for the quality of the prior estate was shown by Dean Pound, since legal titles may also be cut off. The doctrine has been criticized as anomalous. Two other writers have taken rather different views of the rule. Mr. J. E. Hogg suggests that the bona …
