If Androids Dream, Are They More Than Sheep?: Westworld, Robots And Legal Rights, Amanda J. Dipaolo
If Androids Dream, Are They More Than Sheep?: Westworld, Robots And Legal Rights, Amanda J. Dipaolo
Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy
The robot protagonists in HBO’s Westworld open the door to several philosophical and ethical questions, perhaps the most complex being: should androids be granted similar legal protections as people? Westworld offers its own exploration of what it means to be a person and places emphasis on one’s ability to feel and understand pain. With scientists and corporations actively working toward a future that includes robots that can display emotion in a way that can convincingly pass as that of a person’s, what happens when androids pass the Turing test, feel empathy, gain consciousness, are sentient, or develop free will? The …
A Gendered Perspective On Policing Violence In Happy Valley And Fargo, T. Allen Culpepper
A Gendered Perspective On Policing Violence In Happy Valley And Fargo, T. Allen Culpepper
Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy
Portrayal of a police officer determined to fight crime and execute justice in a harsh, isolated environment has become a television and film subgenre, often featuring women facing gender-related challenges. The issues raised in Sally Wainwright’s British television series Happy Valley, can be made more accessible, particularly to American undergraduate students, via its commonalities with the Coen brothers film Fargo. In both, a tough but compassionate policewoman pursues the more sociopathic of a pair of criminals involved in a botched kidnapping attempt instigated by an inept businessman, taking on the case for personal and professional honor, and as …

Public Men's Rooms And The Legal Construction Of Gender And Privacy, Steven J. Macias
Public Men's Rooms And The Legal Construction Of Gender And Privacy, Steven J. Macias
University of Cincinnati Law Review
This Article examines how the law is complicit in educating and socializing children into the cultural practices of gender and privacy. It accomplishes this by analyzing case law that involves minors and men’s public bathrooms. The men’s room is a place rife with social ambiguity, an ambiguity that has come to a head in recent transgender school bathroom cases. Although this Article is primarily concerned with the men’s bathroom as an important legal site in the development of gender and privacy for all youth, it discusses transgender (trans) rights cases as presenting the most fundamental challenge to the hegemonic logic …

Jurnal Ilmu Kesejahteraan Sosial
Transmigration in Lampung Province is part of Indonesia's national transmigration program, which aims to equalize development and reduce the population density of densely populated islands such as Java. Transmigration in Lampung began in 1905 with a colonial approach by the Dutch and continued during the Old Order New Order and began to decline after the 1998 reformation. The challenges of transmigration in Lampung include social and economic problems, integration of immigrants with local communities, and environmental impacts; the next challenge is the availability of health and welfare infrastructure and sustainable development. This study examines the dynamics of transmigration in Lampung …
The Rights And Obligations Of Mod Creators In Canadian Videogame Law, Christian Clavette
The Rights And Obligations Of Mod Creators In Canadian Videogame Law, Christian Clavette
Canadian Journal of Law and Technology
This article explores the legal landscape for mod creators in the Canadian video game industry, examining their rights and obligations under Canadian copyright law and End User License Agreements (EULAs). With the growth of the industry, independent creators have increasingly contributed to game development through “mods,” which modify or enhance existing games. While these mods offer significant creative and commercial potential, they also pose legal challenges, particularly regarding copyright infringement and the enforceability of EULAs. The article evaluates relevant Canadian and U.S. case law, highlighting key differences and similarities, and discusses how these legal principles apply to mods. It also …
(Un)Necessary Evils?: Ethical And Emotional Conflicts For Social Change Lawyers In Canada, Marina Francesca Mckenzie
(Un)Necessary Evils?: Ethical And Emotional Conflicts For Social Change Lawyers In Canada, Marina Francesca Mckenzie
LLM Theses
This thesis concerns an exploratory study about “social change” lawyers in Canada. Based on qualitative interviews, I aim to provide a modest but in-depth examination of the experiences and practical challenges these lawyers face in their work and how they navigate them. I find their approaches are divided between external and internal, both of which are affected by lawyers’ positionalities and experiences. “External approaches” concern how they reconcile conflicts in their values and responsibilities to different groups—namely individuals, communities and social movements—with each other, and with their obligations to the legal profession. Meanwhile, “internal approaches” concern how they navigate conflicting …

(Dis)Invested Bodies: The Neoliberal Crafting Of Disability, T. Wesley
(Dis)Invested Bodies: The Neoliberal Crafting Of Disability, T. Wesley
Electronic Theses and Dissertations
Using the Americans with Disabilities Act (ADA) as a unifying text, my dissertation explores the relationship between cultural production and the neoliberal crafting of humanity, the term I use to describe how social dimensions—including the construction of the textual and material body—become reorganized and governed through market relations. While many disability scholars and activists frame the ADA’s failures through social misunderstandings of disability, few have seriously attended to the limits of the ADA as a neoliberal fusing of economic governance and classical liberal individualism.
Tracing convergences between the ADA and earlier US disability legislation to socioeconomic and political reforms enacted …
Stigma Reduction And Resiliency Training For First Responders (Srrt-Fr): A Feasibility And Initial Efficacy Evaluation, Thalia P. Nicholson
Stigma Reduction And Resiliency Training For First Responders (Srrt-Fr): A Feasibility And Initial Efficacy Evaluation, Thalia P. Nicholson
Electronic Theses and Dissertations
First responders, especially law enforcement, frequently encounter individuals experiencing substance use concerns. Previous research has documented that a greater understanding of substance use disorders promotes a decrease in stigmatizing perspectives. We present a novel approach to training law enforcement officers to improve their interactions with community members exhibiting substance use disorders, while also promoting their professional well-being. The present study sought to evaluate the feasibility and acceptability of the Stigma Reduction and Resiliency Training for First Responders (SRRT-FR) in a sample of law enforcement officers, as well as its efficacy in decreasing stigmatizing perspectives towards substance use disorders and increasing …

A Nuremberg Woman And The Hague Academy, Diane Marie Amann
Scholarly Works
This article, which forms part of the journal's special review series marking the centenary of the Hague Academy of International Law, draws from the author's ongoing research into the roles that lawyers and other women professionals played at post-World War II trials. The article focuses on the life of one “Nuremberg woman,” Dr. Aline Chalufour, who attended the Academy in 1937 and again in 1957. In between, she worked in what is now Vietnam as a colonial schoolteacher, in Canada as a Free French propagandist for de Gaulle, at Nuremberg and Hamburg as a war crimes prosecutor, and in France …
We're Swarming Again! Swarming, Collectivity, And Trope: The Case Of Extinction Rebellion, Tyler J. Behymer
We're Swarming Again! Swarming, Collectivity, And Trope: The Case Of Extinction Rebellion, Tyler J. Behymer
Department of Communication Studies: Dissertations, Theses, and Student Research
This thesis explores the rhetoric of the eco-movement Extinction Rebellion, focusing on the use of swarming and nature tropes to mobilize collective action and revivify contemporary notions of collectivity. Drawing on rhetoric of social movement scholarship, cultural studies, and psychoanalysis, this essay theorizes swarming as a tropological economy that expands the conditions of propriety in the context of collectivity. Through an analysis of Extinction Rebellion’s discourse, this study demonstrates how the naturalization of swarming tropes works in various ways to rewild conventional political discourse, galvanize disruptive collective assembly, and challenge green neoliberalism.

Tek Seng Bio Temple As A Symbol Of History And Locality Of The Chinese Indonesian Community In Cikarang, Harry Farinuddin, Didik Pradjoko
International Review of Humanities Studies
This article examines Tek Seng Bio (德圣庙) Temple within the context of the temple as the symbol of local history among Chinese Indonesians in Cikarang. Established in 1900 by Tjio Lo Weh (蒋維内) from Fujian, the temple marked the inception of a Chinese settlement in North Cikarang. Unique in its devotion to Lín Tài Shī Gōng/Liem Tay Soe Kong (林太师公) as their main deity, Tek Seng Bio Temple originally functioned as a private familial place of worship. However, its transition to a public worship house faced challenges in 1967, with Presidential Instruction Number 14 imposing restrictions on Chinese religious practices, …

Branding as a cultural production is a phenomenon that involves the creation of narratives, symbols, and identities that affect individuals and social. Through the study of material culture, this article discusses the representation of a person's lifestyle and self-identification in meeting the needs of smartphones with the iPhone brand. Using the literature study method, social media data on the internet shows that there is a business service strategy in the form of savings or social gathering in buying an iPhone to consumers. The research results show that strong branding images built by Apple Inc. make people who economically are not …
From Law And Literature To Legality And Affect By Greta Olson, Azka Anees
From Law And Literature To Legality And Affect By Greta Olson, Azka Anees
Osgoode Hall Law Journal
IN A SPEECH ADDRESSING the Canadian Bar Association in 1970, leading literary critic of the twentieth century Northrop Frye said that “all respect for the law is a product of the social imagination, and the social imagination is what literature directly addresses.”3 In her book From Law and Literature to Legality and Affect, Greta Olson makes an important contribution in her reimagination of law and literature as a discipline. What is remarkable is the extent to which Olson’s thesis, arguing for broadening the scope and aims of the field, gives effect to Frye’s characterization of the field more than half …

The Dangers Of Terrorist Organizations Using Deepfakes And Ways To Confront, Mohammad Bedeir
Journal of Police and Legal Sciences
Societal reliance on digital data and cyber technology has increased, and an amazing boom in the field of artificial intelligence technologies has occurred in recent years, resulting in the rapid integration of artificial intelligence into daily life, through smart devices and smart cities, and although this has many advantages, as it is used in the entertainment and media industries, it also represents an increasing vulnerability to cyberattacks, which may manifest itself in deepfake attacks.
The researcher relied on the descriptive analytical approach, with the aim of describing the phenomenon under research, studying it from its various dimensions and aspects, and …
Free To Learn: Protecting Muslim Students In Public Schools, Case Precedent And Social Theory In The Fight To Protect Their Rights, Harold Hinds
Richmond Public Interest Law Review
In the aftermath of 9/11, anti-Muslim American sentiments surged. With social tensions escalating as a result of the ongoing Israel-Gaza war and, what many feel is xenophobic rhetoric from high profile political figures, discrimination against Muslim Americans has further grown. Muslim youth in this country have experienced acute discrimination that has the potential to make school an uncomfortable and hostile place. This article explains the different ways in which Muslim American students experience discrimination and provides a roadmap for how administrators, activists, attorneys, and advocates can use the long and storied history of American civil rights litigation to protect the …
Theorizing Constitutional Change In East Asia, John Gillespie
Theorizing Constitutional Change In East Asia, John Gillespie
Chicago Journal of International Law
How do constitutions change in response to social problems? This Article explores why constitutions in three East Asian countries, namely Japan, Indonesia, and China, changed rapidly during times of social crisis and then incrementally evolved during periods of stability. It looks for explanations in historical institutionalism, a novel theory developed to understand the factors that give rise to the creation, persistence, and change of political institutions, such as constitutions. Constitutional change in these East Asian countries is explored by examining constitutionally defined eminent domain powers that enable governments to compulsorily acquire land in the public interest. The Article aims to …

Contemporary military leadership faces a pressing challenge in reconciling traditional doctrine with the evolving needs and characteristics of Generation Z service members. This paper explores the vital importance of integrating critical and creative thinking skills into military small group dynamics to effectively prepare leaders for the complexities of their responsibilities as both decision makers and facilitators of successful teams. Drawing on a diverse range of sources, including academic literature, military publications, and firsthand experiences, the paper examines the inherent tensions between traditional military practices and the demands of a rapidly changing world. Through a synthesis of insights and recommendations, it …

An Antisemitism Academia Crisis: Communication Failure On Three Ivy League College Campuses, Rickardo W. Shuzzr
Student Theses and Dissertations
The issue of Antisemitism on college campuses in the United States has gained significant attention following the terrorist attack by Hamas on Israel on October 7th, 2023. This discriminatory behavior, hate speech versus free speech, and academia's role in the geopolitical climate have sparked protests and raised questions about the responsibility of universities today. It has even led to high-profile presidents from institutions such as Harvard, MIT, and UPenn being called to testify before a congressional oversight committee. These university presidents and others have been the subject of ongoing flak in the public sphere. As a result, there have been …

Emotion Regulation Strategies And Perceived Emotional Intelligence: The Effect Of Age., Iwanna Sepiadou
Adultspan Journal
The aim of this study was to investigate the relationship between perceived emotional intelligence and the reported use of cognitive reappraisal and expressive suppression. We also investigated the possible effects of age on the aforementioned variables. The total sample consisted of 379 people (158 men, 220 women, 1 unreported). Across participants, 273 were young (20-39 years old) and 106 were middle-aged (40-65 years old). We found statistically significant positive correlations between the dimensions of perceived emotional intelligence and the reported use of cognitive reappraisal and negative primarily correlations between the dimensions of perceived emotional intelligence and the reported use of …
The Submerged Administrative State, Gabriel Scheffler, Daniel E. Walters
The Submerged Administrative State, Gabriel Scheffler, Daniel E. Walters
Faculty Scholarship
The United States government is experiencing a reputation crisis: after decades of declining public trust, many Americans have lost confidence in the government’s capacity to perform its basic functions. While various explanations have been offered for this worrying trend, these existing accounts overlook a key factor: people are unfamiliar with the institutions that actually do most of the governing—administrative agencies—and they devalue what they cannot easily observe. The “submerged” nature of the administrative state is, we argue, a central reason for declining trust in government.
This Article shows that the administrative state is systematically submerged in two ways. First, administrative …

Black Girls Youth Participatory Action Research & Pedagogies, Kimberlé W. Crenshaw, Venus E. Evans-Winters
Faculty Scholarship
More than a decade ago, as a group of anti-racist and feminist researchers, including one of the authors, set out to survey the landscape of the schooling experiences of Black girls, we encountered a pronounced knowledge desert that threatened research-informed policy interventions that served to protect Black girls. Most research at the time focused on the educational experiences of male, female, or Black students. There was hardly any readily available data on the school-based outcomes of Black girls as a specific group of students with a unique set of experiences. In Black Girls Matter: Pushed Out, Overpoliced, & Underprotected (Crenshaw, …
Making "Medical": How Psychedelics Are Becoming Legal In Canada, Agnieszka Doll
Making "Medical": How Psychedelics Are Becoming Legal In Canada, Agnieszka Doll
Dalhousie Law Journal
As legal restrictions loosen, psychedelic-assisted therapies are advancing at an unprecedented pace and scope in Canada and the US. Presented as a miracle cure for post-traumatic stress, depression, and other psychological disorders, psychedelics are being touted to treat post-pandemic mental health crises. In this paper, drawing on Science and Technology Studies, I ethnographically trace the ongoing process and practices involved in transforming illegal psychedelics into a regulated medicine in Canada, paying particular attention to regulatory pathways and the development of networks involved in psychedelic advocacy. Using these pathways as a methodological “sampling device,” I map the main actors, their mutual …
Trinity Western University Decisions And Engineers’ Equity, Diversity, And Inclusion Obligations Under The Statutory Public Interest Mandate, Michelle Liu, Vanessa Matta
Trinity Western University Decisions And Engineers’ Equity, Diversity, And Inclusion Obligations Under The Statutory Public Interest Mandate, Michelle Liu, Vanessa Matta
Canadian Journal of Law and Technology
Engineers create technologies but do not sufficiently care for their biased and inequitable outcomes despite the engineering profession’s statutory mandate to protect the public interest. The engineering and legal professions’ similar admission processes and statutory provisions mandating the protection of public interest may justify applying the Supreme Court of Canada’s interpretation of the legal profession’s public interest mandate in the Trinity Western University decisions to the engineering profession. The Supreme Court’s interpretation centres on equal access to the profession, diversity within its membership, and protection of 2SLGBTQ+ persons. The work begins by setting out the definitions and challenges of equity, …
The Legal Realists On Law And Literature, Dan Priel
The Legal Realists On Law And Literature, Dan Priel
All Papers
This encyclopedia entry considers the legal realists’ neglected contribution to law and literature. Starting with Cardozo’s essay ‘law and literature’ on the importance of judicial style, it then considers the contributions of the legal realists to the topic, focusing especially on Karl Llewellyn and Jerome Frank. Cardozo and Frank—both judges who were interested in making sure they effectively conveyed their ideas—focused on the style a judge should adopt. By contrast, Llewellyn’s more sociological perspective was concerned with how different periods (as well as different jurisdictions) were dominated by different judicial styles. However, in both cases the question of judicial style …
Exclusive Legal Personality Of States In East Asia And The Legacy Of Bandung Pragmatism, Tetsuya Toyoda
Exclusive Legal Personality Of States In East Asia And The Legacy Of Bandung Pragmatism, Tetsuya Toyoda
Indonesian Journal of International Law
One of the significance of the Bandung Conference was the down-to-earth realism. The People's Republic of China (PRC) was among the major promoters of the conference, despite its mostly unrecognized status in the international community. The exclusive legal personality is the central tenet of the modern system of international law, where non-sovereign entities are strictly discriminated against sovereign ones. The introduction of international law in East Asia in the late-nineteenth century was particularly troublesome with the eventual denial of legal personality of semi-sovereign entities, such as the kingdom of Lew Chew, the Joseon dynasty, or the government of Tibet. East …
