Nonverbal Communication From The Other Side: Speaking Body Language, John L. Barkai Jan 1990

Nonverbal Communication From The Other Side: Speaking Body Language, John L. Barkai

San Diego Law Review

In this Article, Professor Barkai highlights the relationship between nonverbal communication and the legal profession. The author notes that lawyers are quickly realizing importance of nonverbal behavior in determining the nature of communication and the relationship between the communicators. As such, he sets out to define a broader and more universal role for conscious nonverbal communication in law. His analysis covers the mechanics of body language and the importance of nonverbal communication in the law office whether dealing with other attorneys, witnesses, or clients. Using research drawn from the social sciences, the author concludes that lawyers can consciously speak body …

Intoxication And Aggression, Jeffrey Fagan Jan 1990

Intoxication And Aggression, Jeffrey Fagan

Faculty Scholarship

Evidence of an association between use of illicit substances and aggressive behavior is pervasive. But the precise causal mechanisms by which aggression is influenced by intoxicants are still not well understood. Research on intoxication and aggression often has overlooked the nonviolent behavior of most substance users, controlled use of substances, and the evidence from other cultures of a weak or nonexistent relation between substance use and aggression. There is only limited evidence that ingestion of substances is a direct, pharmacological cause of aggression. The temporal order of substance use and aggression does not indicate a causal role for intoxicants. Research …

Representing Nazism: Advocacy And Identity At The Trial Of Klaus Barbie, Guyora Binder May 1989

Representing Nazism: Advocacy And Identity At The Trial Of Klaus Barbie, Guyora Binder

Journal Articles

Noting the enormous media interest in the war crimes trial of Klaus Barbie, and the surprising emphasis of this coverage on its cultural significance, this essay provides a literary reading of the trial as a contest over identity. More specifically, it treats the trial and its coverage as a struggle among competing groups - including the French state, various strands of the French left, the French right, resistance veterans, holocaust survivors, Zionists, Arabs, anti-colonialists - for the power to represent Nazism. All of these groups sought to define Nazism so as to claim a privileged identity as essential victims or …

Law's Centaurs: An Inquiry Into The Nature And Relations Of Law, State And Violence, Richard F. Devlin Frsc Jan 1989

Law's Centaurs: An Inquiry Into The Nature And Relations Of Law, State And Violence, Richard F. Devlin Frsc

Articles, Book Chapters, & Popular Press

The unfortunate truth claim which I wish to pursue in this paper is that the deep structural presupposition (which is almost universal amongst lawyers and clearly dominant among lay people) that law and violence stand in stark opposition is false. I argue that violence is endemic to any conception of modern law, that it is authorized by the legislature and/or executive, sanctioned by the judiciary, and perpetrated by what are euphemistically called the forces of law and order - the police, the military et cetera. In brief, I wish to posit the disquieting thought that legal violence is a sine …

Teaching Law Ethically: Is It Possible?, Mary Jewell May 1984

Teaching Law Ethically: Is It Possible?, Mary Jewell

Dalhousie Law Journal

In the past few years the public has been deluged with a constant barrage of unfavourable articles, newsreels, television shows, movies, books, and commentaries about lawyers. This constantly increasing quantity is infinitesimal in size when compared to the vast array of material written by legal educators in the last thirty years. If it can be accepted that the popular press represents to some extent the voice of the people, it may be suggested that society is trying to say something about its lawyers and the role they play in society. The message is clear and unequivocal: lawyers are not nice …

Legislation And Regulation Jan 1982

Legislation And Regulation

International Journal for the Study of Animal Problems

The idea of new federal regulation on the care and use of animals in research is no longer novel; bills that would control and refocus the conduct of animal experimentation in the U.S. have been pending since the last session of Congress. Last autumn, however, a new phase in the process began. On 13-14 October 1981, the House Subcommittee on Science, Research, and Technology held information-gathering public hearings to evaluate existing bills and possibly formulate its own legislation.

The Supreme Court And Obscenity: An Exercise In Empirical Constitutional Policy-Making, Stephen Daniels Aug 1980

The Supreme Court And Obscenity: An Exercise In Empirical Constitutional Policy-Making, Stephen Daniels

San Diego Law Review

This Article analyzes the Supreme Court's approach to obscenity. The author suggests that, during this century, constitutional interpretation has been marked by a shift from a formal, deductive approach toward one that is more empirical and instrumental in character. The author analyzes this approach as reflected in the Supreme Court's attempt to devise a constitutional policy on obscenity. The author isolates five empirical propositions underlying the attempt and analyzes them in terms of the empirical evidence that was presently available. The author finds little empirical substantiation for those propositions, casting doubt on the Court's policy and suggests a skeptical view …
