Don’T Hold Your Horses: Solutions To The Bureau Of Land Management’S Failure To Manage Wild Horse Populations, Sutaria, Kiran Mahendra

Santa Clara Law Review

Since the Wild Free-Roaming Horses and Burros Act (WFHA) was enacted in 1971 – mandating protection and management of the wild horse and burro population – the BLM has triggered a public outcry over its mismanagement of wild horses. From inhumane roundup processes to a well-intentioned but poorly executed adoption program that inadvertently subjects horses to cruel conditions and slaughter, the BLM’s efforts have continuously undermined wild horse preservation. When an overwhelming majority of Americans push for wild horse protections, and wild horse preservation is a topic that largely receives bipartisan support, it is hard to understand the current status …

Paradise Lost In The Patent Law? Changing Visions Of Technology In The Subject Matter Inquiry, Dana Remus Irwin Aug 2025

Paradise Lost In The Patent Law? Changing Visions Of Technology In The Subject Matter Inquiry, Dana Remus Irwin

Florida Law Review

In recent decades, the Patent and Trademark Office and the federal courts have dramatically expanded the scope of patentable subject matter—the set of inventions eligible for patent protection. Existing scholarship has taken a narrow view of this expansion. Scholars argue on efficiency grounds that without more meaningful limits on the scope of patentable subject matter, future invention will be impeded rather than encouraged. This Article takes a broader view of the subject matter inquiry, tracing its historical development and its changing theories of technology, from the patent system’s inception to the present. This Article demonstrates that through these theories of …

Ai At Work, Algorithmic Bosses, And The Ambivalence Of Automation, Antonio Aloisi, Valerio De Stefano Aug 2025

Ai At Work, Algorithmic Bosses, And The Ambivalence Of Automation, Antonio Aloisi, Valerio De Stefano

All Papers

This chapter revisits a foundational question (“what do bosses do?”) to explore how artificial intelligence (AI) is reshaping power dynamics in the workplace. Far from neutral tools of optimisation, algorithmic systems increasingly amplify managerial prerogatives, embedding them into automated processes that are difficult to scrutinise or contest. These developments give rise to a paradox: managers and workers are simultaneously augmented and disempowered, caught in systems that intensify control while eroding autonomy. Drawing on legal, organisational, and regulatory perspectives, we argue that existing safeguards, ranging from data protection rights to information and consultation, are ill-equipped to confront this shift. The chapter …

Restrictions On Veto Power: Holding The Permanent Five Accountable In The Face Of Intervention And Peacekeeping Operations, Theo Aldrighi Aug 2025

Restrictions On Veto Power: Holding The Permanent Five Accountable In The Face Of Intervention And Peacekeeping Operations, Theo Aldrighi

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

ABSTRACT: This article examines the structural constraints of the United Nations Security Council, with a focus on the veto power of its permanent members and its implications for intervention and peacekeeping. Through a realist lens and grounded in structural analysis, it contends that the recurrent paralysis of the Council in the face of mass atrocities stems from entrenched power asymmetries. The paper advances a bifold proposal: the adoption of the French-Mexican initiative to suspend veto use in cases of mass atrocities, and the entrenchment of the Council’s authority to authorize the use of force under defined conditions. Drawing on case …

The Effects Of Pandemic School Closures On Standardized Testing Outcomes: Evidence From Connecticut, Michael Manieri Aug 2025

The Effects Of Pandemic School Closures On Standardized Testing Outcomes: Evidence From Connecticut, Michael Manieri

Dartmouth Undergraduate Journal of Politics, Economics and World Affairs

During the Covid-19 pandemic, schools around the nation closed to prevent the virus’s spread. Following these closures, students’ performance on standardized exams worsened. Using a two-way fixed effect model with district and year fixed effects, I examine if the use of non-traditional schooling modes (i.e. hybrid and virtual) during the pandemic is associated with lower ELA and Math proficiency rates in Connecticut public schools. I find that Connecticut public school districts’ Math and ELA pass rates on the annual Smarter Balanced exam significantly decreased as they used higher levels of virtual and hybrid education. The magnitude of this decrease was …

From Legal Grey Area To Legal Recognition: Recent Legislative Reforms Regarding Sex Work Under Employment Contracts In Belgium, Ninon Ramlot

Dispatches

ON 1ST DECEMBER 2024, the Law of 3 May 2024 portant des dispositions en matière du travail du sexe sous contrat de travail [laying down provisions on sex work under an employment contract] entered into force in Belgium.1 This piece of legislation establishes a strict legal framework for an employer to lawfully employ sex workers, without this being condemned under the criminal offence of procuring, as well as creating an employee status tailored to sex workers. This Act is another building block in the broader process undertaken over the last few years to resolve the legal inconsistency surrounding sex work …

Out Of Sight, Out Of Mind: Nearby Branch Closures And Small Business Growth, Benjamin Ranish, Andrea Stella, Jeffery Y. Zhang Aug 2025

Out Of Sight, Out Of Mind: Nearby Branch Closures And Small Business Growth, Benjamin Ranish, Andrea Stella, Jeffery Y. Zhang

Law & Economics Working Papers

Since 2010, the total number of commercial bank branches in the United States has decreased by about 20%. Do branch closures meaningfully affect economic activity? We investigate the impact of branch closures on small businesses, whose access to credit may be facilitated through local relationships with banks. Using exogenous variation in closures related to mergers and acquisitions, we show that the closure of nearby bank branches leads to decreased small business employment growth and entry while increasing business exit. Our results are robust to variations in our measure of employment, proximity, and construction of the instrument. We use subsample analyses …

The Crucial Role Of Grassroots Social Organizations In Advancing Immigrant Legal Protections And Reshaping Immigration Policy, Isabella Reynolds Aug 2025

The Crucial Role Of Grassroots Social Organizations In Advancing Immigrant Legal Protections And Reshaping Immigration Policy, Isabella Reynolds

McNair Summer Research Program

This research project examines how grassroots social organizations contribute to the advancement of immigrant legal protections and shape immigration policy, with a particular focus on formerly incarcerated migrants in California. I focus on case studies and the personal experiences of organizers from Homies Unidos, Border Angels, and other organizations that operate near the San Diego–Tijuana border region. The study illustrates how these groups provide essential services, mental health support, and community-based initiatives for vulnerable and formerly incarcerated immigrants. By conducting oral histories and ethnography as methods for preserving emotional labor and shared memory, this research challenges prevailing narratives that criminalize …

Proportionality: Can’T Live With It But Can’T Live Without It, Geoffrey S. Corn Aug 2025

Proportionality: Can’T Live With It But Can’T Live Without It, Geoffrey S. Corn

International Law Studies

Perhaps no other word in the international humanitarian law lexicon evokes more interest and emotion than proportionality. How States implement the rule of proportionality is perhaps the most hotly debated aspect of international humanitarian law. The indeterminate nature of the rule allows for its meaning to conform to whatever its reader wants it to mean. This is a consequence of the variables related to key provisions of the rule: How do we assess military advantage? What makes an anticipated military advantage “concrete and direct”? And most problematic of all, what is the meaning of the term “excessive”? All of these …

Analisis Dampak Putusan Etik Terhadap Keabsahan Putusan Lembaga Peradilan: Perbandingan Putusan Mahkamah Konstitusi Dan Putusan Badan Peradilan Dalam Lingkup Mahkamah Agung, Muhamad Sidiq Aug 2025

Analisis Dampak Putusan Etik Terhadap Keabsahan Putusan Lembaga Peradilan: Perbandingan Putusan Mahkamah Konstitusi Dan Putusan Badan Peradilan Dalam Lingkup Mahkamah Agung, Muhamad Sidiq

Jurnal Konstitusi & Demokrasi

Constitutionalism places the constitution as the supreme law that binds all state administrators, with the Constitutional Court (MK) as the guardian of the constitution through final and binding judicial review decisions. However, serious challenges have emerged regarding ethical violations by constitutional judges, such as in Decision No. 90/PUU-XXI/2023, which raises questions about the legitimacy and validity of the decision. This study employs a normative legal method with a doctrinal approach to analyze the applicability and impact of ethical rulings on MK decisions and compares them with ethical oversight and decision correction practices within the Supreme Court (MA). The findings indicate …

Police Officer Use Of Force And Officer-Created Jeopardy After Barnes V. Felix: The Supreme Court's Important (Albeit Incomplete) Step In The Right Direction, Cynthia Lee Aug 2025

Police Officer Use Of Force And Officer-Created Jeopardy After Barnes V. Felix: The Supreme Court's Important (Albeit Incomplete) Step In The Right Direction, Cynthia Lee

ConLawNOW

This essay analyzes the Supreme Court’s 2025 unanimous decision in Barnes v. Felix rejecting the moment of threat doctrine that limited courts assessing the reasonableness of a law enforcement officer’s use of force. Under this narrow time-framing approach, courts were limited to considering only those facts and circumstances known to the officer at the moment of the threat, and acts occurring before the officer seized the individual that may have contributed to the dangerous situation could not be considered. Rejecting this narrow approach, the Court reaffirmed its longstanding rule that in assessing the reasonableness of an officer’s use of force …

Copyright In Characters: A Proposal For Reform, Michael W. Carroll Aug 2025

Copyright In Characters: A Proposal For Reform, Michael W. Carroll

Joint PIJIP/TLS Research Paper Series

The doctrine of character copyright is an eccentricity in copyright law that should either be abandoned or substantially reformed. Originally limited to literary characters, this doctrine decomposes a narrative work in order to recognize characters as works of authorship independent of the narrative works from which they are derived. Claimants generally seek independent protection for characters for three, sometimes overlapping, reasons: (1) to repackage what would otherwise be a weak claim of substantial similarity if comparison were to be made with the work(s) from which the character has sprung; (2) to overcome obstacles posed by prior licensing decisions that have …

The “Sweetest Sounding” Words Of Civil Rights: A Labor Origin Story Of The “Right To Work”, Thomas A. Castillo Aug 2025

The “Sweetest Sounding” Words Of Civil Rights: A Labor Origin Story Of The “Right To Work”, Thomas A. Castillo

History

This essay revisits the idea of “right to work” by offering historical context of Florida’s passage of its 1944 right to work constitutional amendment. A brief overview of the history of the term right to work and its contested nature indicates how the phrase likely led to confusion especially in the arena of political economy. A close evaluation of the amendment and its incongruent nature reveals the intent of its proponents was to deceive voters with the “sweetest sounding” words of civil rights while weakening their ability to organize labor unions. The history of safeguarding the free market entailed disciplining …
