Despair Amongst Brazil’S Youth: Does The Hague Convention On International Child Abduction Need More Bite?, Ishani Sanyal

Pace International Law Review

For decades, international child abduction by one parent from the legal custody of the other has been a persistent issue which continues to be overlooked by international organizations and countries from around the world. While the Hague Convention on the Civil Aspects of International Child Abduction has helped to initiate certain progress in addressing acts of international child abduction by parents, signatory states including Brazil have failed to enforce rulings and provisions of the convention. This article addresses how the convention does not account for structural inadequacies of Brazilian court systems which prevent thorough enforcement of international custody and visitation …

“Fleeing The Climate: The Need For Protection Of Climate Refugees In The Light Of International Law”, Carina Dietmayer

Pace International Law Review

Climate change, which is already making itself felt, poses challenges for international law and the international community. Climate change and its consequences will lead to (involuntary) human mobility and affect many people. This forced migration is not yet specifically addressed by international law. This article addresses climate-induced migration and the protection of climate refugees through international refugee and migration law, international human rights law, international environmental law, climate change law and international disaster law. It analyzes how and, above all, why climate refugees are protected. The core thesis of the article is the justification of a need for protection of …

The Illusory Privilege Against Self-Incrimination, Kelsey Rohr

Arkansas Law Review

This Note addresses the insufficiency of the current system in protecting criminal defendants’ privilege against self-incrimination. Part II will outline the background legal principles of the issue, including the privilege against self-incrimination, the presumption of innocence, and the no-impeachment rule. This part will also address the Supreme Court’s sole judicial exception to the no-impeachment rule as laid out in Peña-Rodriguez v. Colorado. Part III will address the statistical significance of juror bias against criminal defendants who invoke the privilege, highlight the widespread nature of the bias, and argue that the procedural safeguards currently in place are insufficient to protect.

Workplace Retaliation And The Intersection Of Protected Conduct And Job Performance, Chris M. Schmidt Dec 2025

Workplace Retaliation And The Intersection Of Protected Conduct And Job Performance, Chris M. Schmidt

Arkansas Law Review

A host of statutory schemes seek to ensure equal employment opportunities in the United States by eradicating workplace discrimination (“EEO laws”). Consider two foundational pillars necessary for these EEO laws to strike the desired balance between individual rights and workplace efficiency. First, employees require robust protection from retaliation if they engage in protected conduct—for example, by reporting perceived discrimination. Second, employers can—and ideally, should—make employment decisions based on how an employee performs the job.

The interests in robust protection and performance-based decision-making serve the purposes of our EEO laws and are well-established. Rarely do they conflict (to the contrary, they …

Conservatorship: An Enabler Of Involuntary Servitude, Jesse Long Dec 2025

Conservatorship: An Enabler Of Involuntary Servitude, Jesse Long

Arkansas Law Review

What happens when the conflict of interest relates to the conservatee’s substantial talents and their potential earnings? In this circumstance, a conservator has a perverse incentive to profit off of and coerce their conservatee into labor which serves to benefit the conservator—a kind of involuntary servitude that would seem to implicate the plain text of the Thirteenth Amendment of the United States Constitution.

This Note proceeds in three parts. Part I describes the history of conservatorships, why they were created, and the problematic issues that have arisen from the conservatorship system. Part II analyzes how the lack of meaningful judicial …

The Kids Aren’T Alright, Amy B. Levin Dec 2025

The Kids Aren’T Alright, Amy B. Levin

Arkansas Law Review

It is not new that students struggle in law school. Research has shown for decades that, while students generally begin law school with healthy well-being, the competitive nature of law school combined with the stress of the Bar and securing post-Bar employment causes increased anxiety, depression, isolation, and related symptoms among students, especially women and underrepresented groups. What is new is the sheer number of law students struggling with serious mental health challenges today—a number that has reached crisis proportions.

This Article is divided into four parts. In Part I, I explore the mental health landscape for high school, college, …

Weaponization Of Taxation: Sovereign Tax Immunity As A National Security Tool, Vinita R. Singh Dec 2025

Weaponization Of Taxation: Sovereign Tax Immunity As A National Security Tool, Vinita R. Singh

BYU Law Review

Amidst calls to reconceptualize taxation as a national security tool, legislators are reexamining how the United States taxes foreign governments. Federal income taxation of foreign governments—what this Article terms “the law of immunity from taxation” or “sovereign tax immunity”—strongly influences whether and how foreign governments pursue investment in the United States. This impact on international business transactions indicates sovereign tax immunity has the potential to be a powerful national security tool. Yet, despite its import, the law of immunity from taxation has been underexplored and undertheorized. This Article steps into this gap in discourse by challenging the way recent legislative …

Progressive Tax Rates As A Response To Algorithmic Tacit Collusion, Reuven S. Avi-Yonah, Lior Frank Dec 2025

Progressive Tax Rates As A Response To Algorithmic Tacit Collusion, Reuven S. Avi-Yonah, Lior Frank

Articles

This article suggests a tax-law-based approach to curtailing the harm that might be posed by algorithmic tacit collusion in response to the inability of antitrust laws to offer viable solutions. It suggests that progressive corporate tax rates, including higher tax rates, could alleviate the harm caused by algorithmic tacit collusion (“alleviate” because our tax-based approach would not entirely solve the problem of pricing algorithms’ ability to imitate prices of other algorithms without any form of agreement or communication). As we show, progressive and higher tax rates can lead to a redistribution of wealth and ultimately mitigate algorithmic supracompetitive pricing harm. …

Evolutions In European Family Law: Towards A Common Core?, Frédérique Ferrand Dec 2025

Evolutions In European Family Law: Towards A Common Core?, Frédérique Ferrand

Journal of Civil Law Studies

This paper examines developments in European family law and considers whether a common core is gradually emerging. The first part is devoted to the European Union. Under the Treaties, substantive law on family matters, including the legal status of persons, falls within the competence of Member States. However, EU regulations govern jurisdiction and the recognition of court decisions and authentic instruments in several areas directly relevant for families and children in cross-border situations. Although these regulations do not directly deal with substantive family law, they can provide indirectly for a certain harmonization via uniform jurisdiction and recognition rules as well …

The Legal Governance Of Arbitrary Construction In Azerbaijan: Current Issues And Paths To Reform, Natig Khalilov Dec 2025

The Legal Governance Of Arbitrary Construction In Azerbaijan: Current Issues And Paths To Reform, Natig Khalilov

Journal of Civil Law Studies

Azerbaijan has long faced challenges arising from the spread of arbitrary constructions and unauthorized settlements, with official data showing approximately half a million such structures across the country. These unregulated constructions contribute to social complications and hinder the efficient operation and development of the housing, real estate, and urban planning sectors. Currently, courts are handling numerous cases involving ownership disputes and potential demolitions linked to these constructions. Registering arbitrary constructions is seen as a step towards affirming citizens’ property rights while boosting state revenue.

This article will trace the historical development of the arbitrary construction framework in Azerbaijan, analyze its …

Marriage And Compensation: Wederstrandt V. Kol And A Spouse’S Right To A Wrongful Death Action, Van Matherne Dec 2025

Marriage And Compensation: Wederstrandt V. Kol And A Spouse’S Right To A Wrongful Death Action, Van Matherne

Journal of Civil Law Studies

The fascinating 2023 Louisiana Supreme Court case of Wederstrandt v. Kol[1] invokes the minds of legal scholars and displays a cautionary tale for the layperson. For the scholar, this case demonstrates skillful civilian statutory interpretation that highlights the exclusivity protecting the marriage articles in Louisiana’s Civil Code. However, for the layperson, this case uncovers a possible inequity within Louisiana’s wrongful death statutes that serves as a warning to choose your spouse wisely.

A Bicentennial Approach To An Exegetical School Of Private Law In Louisiana, Agustín Parise

Journal of Civil Law Studies

This paper is an expansion of the 44th Tucker Lecture on Civil Law. It deals with sources of law, codification, and the place of the civil code in the State of Louisiana. It explores to what extent it is possible to speak of the presence of an exegetical school of private law in Louisiana throughout the life of the Louisiana Civil Code. This paper is divided into five parts. First, it deals with foundational aspects of codification and of the Louisiana Civil Code. Second, it offers a conceptualization of exegesis. Third, it presents a periodization to help analyze the degree …
