Gender Differences In Biological And Sociological Predictors Of Crime, Deborah W. Denno Jan 1997

Gender Differences In Biological And Sociological Predictors Of Crime, Deborah W. Denno

Faculty Scholarship

One of the many goals of the Biosocial Study that I directed was determining whether there were gender differences among the numerous possible correlates of crime that the study examined. The purpose of my presentation today is to describe the Biological Study and its results, particularly as they relate to gender differences in crime. Another aim is to respond briefly to some of the potential political reactions to the study, despite its results. I will begin with a quick account of historical attitudes toward gender differences in crime. I will then discuss the Biosocial Study and its major findings relevant …

Halting Neotropical Deforestation: Do The Forest Principles Have What It Takes?, Matthew B. Royer Jan 1996

Halting Neotropical Deforestation: Do The Forest Principles Have What It Takes?, Matthew B. Royer

Duke Environmental Law & Policy Forum

INTRODUCTION I crashed into the thick secondary growth, stopping suddenly to duck a certain branch in my path: a fat black bullet ant crawled along it with indifference, an attitude that would have quickly changed had I brushed up against him. I headed toward the large patch of Heliconia just to the right. We had earlier mapped out the clump, and finding it to contain seventeen flower clusters, it was one of the prize patches in the study plot. I took my spot ten paces from the outer clusters, started my stop watch, and waited with field book in hand. …

Daubert And The Quest For Value-Free "Scientific Knowledge" In The Courtroom, Alexander Morgan Capron Jan 1996

Daubert And The Quest For Value-Free "Scientific Knowledge" In The Courtroom, Alexander Morgan Capron

University of Richmond Law Review

In a world that grows more technologically complex every day and in which scientific research continually expands both our understanding of, and our questions about, the operation of the natural and man-made world, it is hardly surprising that science should show up with increasing frequency in our court-rooms. Science itself is sometimes at issue, for example, in proceedings on allegations of scientific misconduct or in disputes over the ownership or patentability of technologies. But more frequently, science enters in aid of resolving a case in which a complex question of causation is at issue. To establish or rebut causation, each …

Biodiversity Conservation And The Ever-Expanding Web Of Federal Laws Regulating Nonfederal Lands: Time For Something Completely Different, J.B. Ruhl

Vanderbilt Law School Faculty Publications

This article offers an early examination of the law and governance of biodiversity (circa 1995) through the lenses of the Endangered Species Act, Clean Water Act, and Coastal Zone Management. It suggests that true multi-scalar, cooperative federalism will be needed to manage complex ecological resources for biodiversity conservation. A suggested model employing regional biodiversity management approaches is outlined.

Combatting The Exotic Species Invasion: The Role Of Tort Liability, Daniel P. Larsen Jan 1995

Combatting The Exotic Species Invasion: The Role Of Tort Liability, Daniel P. Larsen

Duke Environmental Law & Policy Forum

Introduction Present-day island and continental ecosystems began evolving millions of years before the human species appeared. These ecosystems became distinct as they developed in isolation from one another, due to natural barriers between them. Within the last 150 years, however, technology has enabled humanity to easily bridge continents and reach secluded islands. As a result, modern human vectors of transport are introducing exotic species 1 into ecosystems that have evolved autonomously for millions of years. Often, these non-native, immigrant species impact wildlife and ecosystem interactions so severely that they may be thought of as deadly "pollutants." Traditionally, environmental laws have …

Gender, Crime, And The Criminal Law Defenses, Deborah W. Denno Jan 1994

Gender, Crime, And The Criminal Law Defenses, Deborah W. Denno

Faculty Scholarship

This Article attempts to explain some of the disparity in criminality between males and females by analyzing the results of the “Biosocial Study,” one of this country's largest longitudinal studies of biological, psychological, and sociological predictors of crime. Section II analyzes the literature and research on gender differences in crime. Section III describes the Biosocial Study and its results, noting the gender differences in the prevalence and prediction of crime and the inability of any one factor to be a strong predictor of crime. Section IV considers whether gender differences warrant disparate types of punishment or treatment within the criminal …

Southwest Diversified, Inc. V. City Of Brisbane: New Opportunities For Municipalities To Avoid Referendum In Land Use Decisions, Cindy Y. Dobler Aug 1992

Southwest Diversified, Inc. V. City Of Brisbane: New Opportunities For Municipalities To Avoid Referendum In Land Use Decisions, Cindy Y. Dobler

San Diego Law Review

In Southwest Diversified, Inc. v. City of Brisbane, the California Court if Appeal held that a city ordinance which changed the zoning of originally designated wildlife habitat to another location within the proposed development was an administrative act and therefore not subject to referendum. Although local citizens groups had collected the requisite signatures to put the ordinance on the ballot for repeal by referendum, the appellate court upheld the lower court's decision ordering the city to desist from holding the election on the issue. The appellate court, narrowly focusing on the perceived intent and wording of a habitat conservation plan, …

The Concept Of Ecological Law, O. S. Kolbasov Jan 1989

The Concept Of Ecological Law, O. S. Kolbasov

Connecticut Journal of International Law

Intensified anthropogenic effects have accompanied rapid social and economic development. Since in many instances such effects are adverse, human behavior which disturbs the environment must be regulated in accordance with ecological requirements based on an analysis of practice and a knowledge of the objective laws that determine the interaction between society and nature.

Law is one of the most effective instruments for managing human behavior and all countries extensively utilize it in this capacity. The ability of law to adapt ecological requirements and express them in the form of generally binding rules of conduct allows for the resolution of environmental …

Ixtoc I: Case Study Of A Major Oil Spill, Peter G. Myer Apr 1984

Ixtoc I: Case Study Of A Major Oil Spill, Peter G. Myer

Marine Affairs Theses and Major Papers

The most disastrous oil spill the western hemisphere has ever witnessed occurred during the 10 months between June 1979 and March 1980, when the experimental well IXTOC I blew out off the coast of Mexico's Yucatan Peninsula. The disaster's effects on South Texas virtually destroyed a year's earnings for the region's tourism industry and cut into the profits of many commercial fishermen. The activities at the well that caused the blowout and subsequent spill, the effects of the oil on Texas' Gulf Coast, and the legal attempts to recover against losses suffered as a result of the spill will be …

The Juridical Status Of The Fetus: A Proposal For Legal Protection Of The Unborn, Patricia A. King Aug 1979

The Juridical Status Of The Fetus: A Proposal For Legal Protection Of The Unborn, Patricia A. King

Michigan Law Review

What claims to protection can be asserted by a human fetus? That question, familiar to philosophy and religion, has long haunted law as well. While the philosophical and theological issues remain unresolved, and are perhaps unresolvable, I believe that we can no longer avoid some resolution of the legal status of the fetus. The potential benefits of fetal research, the ability to fertilize the human ovum in a laboratory dish, and the increasing awareness that a mother's activities during pregnancy may affect the health of her offspring create pressing policy issues that raise possible conflicts among fetuses, mothers, and researchers. …

The Role Of Conservation And Fishery Science Under The Fishery Conservation And Management Act Of 1976, Dayton L. Alverson Jul 1977

The Role Of Conservation And Fishery Science Under The Fishery Conservation And Management Act Of 1976, Dayton L. Alverson

Washington Law Review

The enactment of the Fishery Conservation and Management Act of 1976, which extends United States jurisdiction over fishery resources seaward to 200 nautical miles, constitutes a radical departure from the legal and philosophical foundations of past United States fishery management. The Act incorporates major changes in the distribution of authority to manage fishery resources seaward of the territorial sea and broadens the goals of management to accommodate socioeconomic objectives. Furthermore, it explicitly mandates employment of the best scientific information available in the development of fishery management plans and seeks to establish a comprehensive program of fisheries research to carry out …
