Legal Construction Of Nationalism And National Identity In The Hashemite Kingdom Of Jordan, Zaina Siyam
Legal Construction Of Nationalism And National Identity In The Hashemite Kingdom Of Jordan, Zaina Siyam
Theses and Dissertations
Nationalism is an ideology that is not unique to one nation or one area, but it is a concept unique in the way it is defined. How it is defined and what it really is depends on where the definition is coming from. It is most important to post-colonial nations that relied and still rely on the creation of national identity and construction of an imagined community, in order to reach their liberation. Nations are imagined communities constructed through shared history, beliefs, traditions, and experiences that happen over different periods in time, between individuals that do not necessarily know each …

The Blue State: Unrwa's Transition From Relief To Development In Providing Education To Palestinian Refugees In Jordan, Alana Mitias
Honors Theses
Often referred to as the “Blue State”–due in part to its association with the United Nations’ trademark blue branding–the United Nations Relief and Works Agency for Palestinian Refugees in the Near East (UNRWA) has evolved since its creation in 1949 to become both a symbol of the Palestinian cause and an inimitable public service provider across its five areas of operation, especially in regards to education. In the Hashemite Kingdom of Jordan alone, the UNRWA education program educates more than 120,000 students in 169 schools with results comparable with, if not often superior to, Jordanian public schools.
The UNRWA regime …

More Than Sectarianism: How Have State And Non-State Institutions Used Violence To Form The Current Iraqi State And What Is The Effect?, Caitlyn Perkins
Honors Theses
This thesis examines the role of violence in Iraq in establishing the current Iraqi state. My chapters provide historical and theoretical context to the subject before getting into the analysis. The goal of this thesis is to show that violence in Iraq is not only caused by sectarian differences, but has been used and influenced by leaders, outside governments, and non-state institutions for personal gain and political goals at the cost of the Iraqi people.

Title : Divinity doctrine in the Arab Thought
Many religious, social and anthropological studies show that divinity in societies in general and in Arab societies in particular is enmeshed with human existence itself. That is, from Adam and on , divinity in societies underwent several changes. The prophets were the one charged to correct doctrines throughout human history .Nowadays, contemporary reality tells us that The Holy Prophet Muhammad is the seal of all prophets and that no other divine prophet will follow both in the Arab world or elsewhere.

Remarkably, there has been an argument about the number of the Holy Quran’s verses, some descended in Mecca and others descended in Madinah and why and what they descended for. This book includes a firmly religious and scientific ground enriching the reader by the decisive evidences for confirming the number of the Holy verses and a persuasive counterattack against those who say that Sahaba kept back some verses.
In addition to the recommendation of Al-Hafiz Al Zahabi and Ibn AL Jazri, many evidences converge together to prove the truth of this religious researcher:
- His dedication to Islamic Divinity after …
Legal Translation In A Political Context: The Trick Of Choosing Between Alternatives In Translating Electoral Terms, Zakia Deeb
Abdou Filali-Ansary Occasional Paper Series
Legal electoral terminology is a specialist subject within the broader legal language discourse. When translating into Arabic, even basic electoral terms can be translated differently in different Arab countries for various reasons due to different sources of inspiration. Most legal electoral terms have a variety of alternative equivalents within the relevant linguistic field or semi-legal domain. This paper discusses such alternatives while presenting problems related to the existing resources in the field. Data collected from the 2012 election of members of the Libyan General National Congress are analysed to test the consistency in selecting from these alternatives. Furthermore, material presented …

On The Basis Of Sex: Personal Status Law Reforms And Economic Growth, Kylie Bring
Honors Theses
The purpose of this thesis is to analyze how law reform toward gender equity has an impact on economic growth in Arab countries in the Middle East. Personal status law reform granting women economic, social, and personal freedoms is spreading across the region and showing substantial change. Texts, Language, And History In The Madhab-Law Tradition: A Study Of The ShāfiʿĪ School, Tarek Ghanem
Texts, Language, And History In The Madhab-Law Tradition: A Study Of The ShāfiʿĪ School, Tarek Ghanem
Theses and Dissertations
This thesis advances the study of the legal literature from the madhhab-law tradition by way of studying the Shāfiʿī literary tradition and its two most authoritative classics. These two works are al-Nawawī’s (d. 676/1278) digest Minhāj al-ṭālibīn and Ibn Ḥajar al-Haytamī’s (d. 974/1567) commentary on it, Tuḥfat al-minhāj. This study will provide a typology of the development of the Shāfiʿī juristic texts. The typology is based on an indigenous and coherent periodization centered around an analysis of the intellectual and social developments within the Shāfiʿī legal tradition, not the classical Eurocentric periodization scheme. The main objective of this typology is …

Islam, Democracy, And The Leadership Role Of Women In Government, Leea Collard
Senior Honors Theses
This thesis examines the relationship between Islam, democratic government, and the governmental leadership of women in the Middle East, North Africa, and Turkey (MENAT). In order to understand female leadership in this region, the compatibility between Islam and democracy is analyzed. This occurs through the examination of Sharia Law and democratic principles within Islam. Furthermore, a statistical analysis of the successes of democracies in the region will be presented. Each nation will be categorized by the constitutional provisions entrusted to its female citizens. Thus, this thesis will present the legality of the political participation of women in each of the …
The Political Development Of Capital Punishment In The Modern Moroccan State, Mia Barr
The Political Development Of Capital Punishment In The Modern Moroccan State, Mia Barr
Independent Study Project (ISP) Collection
The modern Moroccan state seen today is very young. Having only been independent from France since 1956, the country has spent the last sixty-four years crafting its post-colonial statehood. What has emerged is a hybrid political system with powers split, however unequally, between the King and his inner circle, known as the makhzen, and the Parliament. Not only is the monarchy constitutional—meaning that its legitimacy is literally written into the primary governing document of Morocco, which had its last referendum in 2011—but it is also self-sustaining and self-legitimizing, for the monarchy uses its constitutional powers to grant itself further powers …

Persistence Of Jewish-Muslim Reconciliatory Activism In The Face Of Threats And “Terrorism” (Real And Perceived) From All Sides, Micah B.D.C. Naziri
Persistence Of Jewish-Muslim Reconciliatory Activism In The Face Of Threats And “Terrorism” (Real And Perceived) From All Sides, Micah B.D.C. Naziri
Antioch University Dissertations & Theses
This dissertation concerns how Jewish-Muslim and Israel-Palestine grassroots activism can persist in the face of threats to the safety, freedom, lives, or even simply the income and employment of those engaged in acts of sustained resistance. At the heart of the study are the experiences of participants in the Hashlamah Project, an inter-religious collaboration project, involving Jews and Muslims. Across chapters and even nations, chapters of this organization faced similar threats and found universally-applicable solutions emerging for confronting those threats and persisting in the face of them. This raised the question of whether revolutionaries and activists in general can persevere …

Lived Experiences Of Temporary Permanence: The Syrian Perspective On Humanitarian Response And ‘Guest Status’ In Jordan, Leila A. Ismaio
Lived Experiences Of Temporary Permanence: The Syrian Perspective On Humanitarian Response And ‘Guest Status’ In Jordan, Leila A. Ismaio
Independent Study Project (ISP) Collection
As the conflict in Syria has evolved into a long-term crisis, Syrian refugees have found themselves in a state of both temporality and permanence, frequently cited as being ‘stuck’. Syrians in Jordan, particularly, have fallen victim to this status, frequently labeled as ‘guests’, with corresponding humanitarian aid also reflecting this temporality. No studies have yet explored Syrian refugees perceptions and experiences with ‘guest’ status and its relationship with humanitarian assistance. The purpose of this study is to explore Syrian perception of ‘guest’ status and current humanitarian efforts in Jordan and see how this demonstrates and challenges the dichotomy present in …

The Role Of Local Communities In Preventing And Countering Violent Extremism (P/Cve) In Jordan, Anna Fraher Klingensmith
Independent Study Project (ISP) Collection
Bordering Syria, Iraq, Saudi Arabia, and Israel/Palestine, with Lebanon not too far away, Jordan’s location makes it at high risk for violent extremism. Although Jordan is considered one of the safest countries in the Middle East and North Africa (MENA) region, the country is known for having one of the highest numbers of foreign fighters in the world, and for being the homeland of the father of ISIS (Abu Musab al-Zarqawi). Also worrisome is the increasing number of desperate people turning to extremist ideologies due to the country’s economic crisis and lack of opportunities for political engagement. Jordan could be …

Approximately one in four families in Morocco are affected by disability. Of those affected by disability, many are in vulnerable situations, because there is an explicit linkage between having a disability and likelihood of experiencing poverty. The primary reasons for this phenomenon include lack of access to education, employment and health care. Following the Arab Spring, the Moroccan government implemented Article 166 which explicitly banned workplace discrimination against people with disabilities (PWD); however, only 13% of those affected by disability of working age can find employment. In this paper, I investigate the obstacles PWD face that prevent them from accessing …
“All Arabs Are Liars”: Arab And Muslim Stereotypes In Canadian Human Rights Law, Reem Bahdi
“All Arabs Are Liars”: Arab And Muslim Stereotypes In Canadian Human Rights Law, Reem Bahdi
Journal of Law and Social Policy
Stereotypes exclude, stigmatize, and burden Arabs and Muslims in Canada. This article examines three prevailing Arab and Muslim stereotypes: the conviction that Arabs and Muslims have a culturally ordained propensity towards violence; the belief that, regardless of their citizenship status, Arabs and Muslims remain foreigners who threaten Western values and; the notion that Arabs and Muslims are dishonest. The analysis rests on the facts found and conclusions reached in nine claims filed by Arab or Muslim applicants before the British Columbia, Ontario, Quebec or Canadian human rights tribunals. The tribunal decisions reveal that the terrorist profile requires the other two …

Against All Odds: A Legacy Of Appropriation, Contestation, And Negotiation Of Arab Feminisms In Postcolonial States, Hoda Elsadda
Journal of Feminist Scholarship
Arab feminists have always faced challenges related to the burden of colonialism, accusations of westernization, isolation from their cultural heritage, and elitism, but the biggest challenge of all has been the fact that their activism and their entire lives have all been in the context of authoritarian postcolonial states. This article engages with a persistent challenge to Arab feminists that questions their impact, their awareness of their cultural and societal problems, and undermines their achievements over the years. It constructs a narrative of what feminists have achieved against all odds, within the constraints of authoritarian postcolonial states that have politically …
Narrating Dignity: Islamophobia, Racial Profiling, And National Security Before The Supreme Court Of Canada, Reem Bahdi
Narrating Dignity: Islamophobia, Racial Profiling, And National Security Before The Supreme Court Of Canada, Reem Bahdi
Osgoode Hall Law Journal
Captain Javed Latif, a Muslim Canadian pilot from Pakistan, was denied pilot refresher training by Bombardier Aerospace Training Center in Canada based on information received from US national security officials. Almost 12 years after Captain Javed Latif’s ordeal began, the Supreme Court of Canada affirmed a decision by the Quebec Court of Appeal overturning a finding by a Quebec Human Rights Tribunal that Latif had been racially profiled. The Supreme Court of Canada’s decision ultimately exposes and perpetuates a deep unwillingness to challenge the stereotyping of Muslims as terrorists in Canada. In response, this commentary seeks to excavate Captain Latif’s …
Commerce, Religion, And The Rule Of Law, Nathan B. Oman
Commerce, Religion, And The Rule Of Law, Nathan B. Oman
Faculty Publications
The rule of law and religion can act as commercial substitutes. Both can create the trust required for material prosperity. The rule of law simplifies social interactions, turning people into formal legal agents and generating a map of society that the state can observe and control, thus credibly committing to the enforcement of the legal rights demanded by impersonal markets. Religion, in contrast, embraces complex social identities. Within these communities, economic actors can monitor and sanction misbehavior. Both approaches have benefits and problems. The rule of law allows for trade among strangers, fostering peaceful pluralism. However, law breeds what Montesquieu …

Humanitarian Intervention: Determining The Effectiveness Of Outsourcing Humanitarian Intervention During Humanitarian Crises, Clarissa Caola
Political Science Theses and Capstones
At the end of the Cold War we witnessed a growing reluctance on part of many national powers to intervene in international crises. This unwillingness allowed for the development of Private Military and Security Companies (PMSCs). PMSCs have been deployed to provide a wide variety of security-related functions including combat, logistics, training programs, and armed guarding of personnel and infrastructures. Exploring the concept of outsourcing these military functions, others have applied the idea towards addressing humanitarian crises. PMSCs may face fewer geopolitical impediments that can hinder the efforts of many state actors. In certain humanitarian crises PMSCs may better address …

Law And Religion: Sharia Law And The First Amendment, Joseph A. Williamson
Law And Religion: Sharia Law And The First Amendment, Joseph A. Williamson
Senior Honors Theses
America has long been seen as the capital of religious freedom and individual rights. In recent years a debate has arisen over whether an individual can personally adhere to the legal concept of sharia law under the protections of the first amendment. At the center of this debate is precedent that can be drawn from previous interactions between religion and American ideals. Two similar issues that have been settled both judicially and legislatively are the conscientious draft objector and the federal prohibition of polygamy. By studying the roots of Islamic law and then the basis of these two concepts, a …
