Jerome Frank's Contributions To The Philosophy Of American Legal Realism, Julius Paul
Jerome Frank's Contributions To The Philosophy Of American Legal Realism, Julius Paul
Vanderbilt Law Review
Justice Holmes' famous statement that "the life of the law has not been logic: it has been experience' has had a profound effect on contemporary American jurisprudence. Holmes' monumental influence, together with the impact of positivism, American pragmatism, and more recently, psychoanalysis, have all played important roles in shaping the development of the school of American legal realism.
One of the most controversial and provocative members of this school was Jerome Frank, who was not only a prolific writer on matters legal, but also an eminent corporation lawyer, a government counsel, an administrator (a Commissioner and later Chairman of the Securities …

The Supreme Court And Obscenity, Philip M. Carden
The Supreme Court And Obscenity, Philip M. Carden
Vanderbilt Law Review
The Supreme Court of the United States has now made binding law of its oft-repeated dictum that obscenity is beyond the pale of constitutionally protected free expression. After being spared-or avoiding-the necessity of ruling squarely on the constitutional status of obscene matter for 169 years, the Court addressed itself to virtually every aspect of the whole slippery problem in a single year. The Court disposed of seven obscene publication cases' in the twelvemonths through January, 1958. These included three reversals this term in memorandum decisions merely citing the major opinion of the series, which was handed down in the combined …

Theology And Jurisprudence, Samuel E. Stumpf
Theology And Jurisprudence, Samuel E. Stumpf
Vanderbilt Law Review
Our era is one in which the law plays a far more important role than at any other time in history, for the law has insinuated itself into the control of almost every facet of man's life. If it was true over a century ago, as Chief Justice Marshall said, that "the judicial department comes home in its effects to every man's fireside; it passes on his property, his reputation, his life, his all,"' it is even more true today as the law has continued to proliferate its influence over an ever-widening range of human conduct. But it is precisely …
Introduction: Law, Christianity And The University, Wilber G. Katz
Introduction: Law, Christianity And The University, Wilber G. Katz
Vanderbilt Law Review
Demand for exploration of the relations between Christianity and law comes both from theologians and from members of the legal profession--practicing lawyers, judges, legislators and scholars. Among theologians, the demand reflects the concern of the Church for man's work and the desire to relate Christian teaching to the problems of the various professions. Among lawyers the demand reflects dissatisfaction with purely secular analyses of the functions and problems of the law and hope for profounder understanding in the light of Christian doctrine.
Within the university this effort is not merely the concern of the schools of law and theology. One …

An Analysis Of Marriage Trends And Divorce Policies, Robert S. Redmount
An Analysis Of Marriage Trends And Divorce Policies, Robert S. Redmount
Vanderbilt Law Review
Divorce law, theoretically, is the embodiment of policies governing the dissolution of marriage. It is the legal expression of the values attached to marriage and implicitly states the law's understanding of the marital relationship, at least that part of it that reflects conflict and disturbance.
The analytic discourse which follows briefly assesses the roles and meanings of marriage, the sources and consequences of marital disharmony and the complications of marriage dissolution. The history and composition of divorce policies and laws is carefully savored and sharply scrutinized for fidelity to the reason and experience of marriage. The outcome of this analysis …
