The Art Of Interpretation In Future Interest Cases, Daniel M. Schuyler Oct 1964

The Art Of Interpretation In Future Interest Cases, Daniel M. Schuyler

Vanderbilt Law Review

Man's quest for an absolute, for a definition of "good," for the meaning of "justice," carries us back to the beginnings of philosophy. And although these concepts are as elusive as the Questing Beast pursued by King Pellinore in T. H. White's delightful book, The Once and Future King, the history of mankind indicates that the curiosity of thoughtful persons is insatiable and that the search will not end. It continues daily before our eyes-in mathematics, astronomy, medicine, psychology, sociology, economics, philosophy, and other disciplines not the least of which is law. Even Holmes, the supposed skeptic, who rejected absolutes' …

Book Reviews, Richard C. Allen, Lawrence D. Gaughan

Vanderbilt Law Review

In this little book, Leon Radzinowicz, Wolfson Professor of Criminology and Director of the Institute of Criminology at the University of Cambridge, presents a brief survey of criminology in England, the United States, and eight countries of continental Europe. His perspective is historical as well as geographical: in discussing each nation, he begins with a sketch of the concepts and personalities that lent vitality to the development of its criminological teaching and research and concludes with an analysis of the contemporary scene, based on his own first-hand observations during a recent world tour "in search of criminology."With so vast a …

The Senile Testator: Medicolegal Aspects Of Competency, Robert Gene Smith, Laurence M. Hager Jan 1964

The Senile Testator: Medicolegal Aspects Of Competency, Robert Gene Smith, Laurence M. Hager

Cleveland State Law Review

The law has failed to recognize recent advances in geriatric psychiatry. Moreover, where medical language has been used, the terminology is either outdated or misapplied. What follows is an attempt to describe the nature and policy of the legal standard for testamentary competency, to set forth the current medical approach to senility and mental disease, and to suggest practical ways for the lawyer to use geriatric psychiatry in behalf of the senile testator.

Finding An Expert Witness In The Sciences, Ralph K. Davies Jan 1964

Finding An Expert Witness In The Sciences, Ralph K. Davies

Cleveland State Law Review

To the uninitiated a classification of diversified sciences upsets the notion that science is one field of knowledge. There are times when even a scientist in one area has difficulty in locating an expert in another area. How then does one find a scientific expert?
