Watergate And The Law Schools, Donald T. Weckstein
Watergate And The Law Schools, Donald T. Weckstein
San Diego Law Review
The misdeeds of the Watergate lawyers involve more than image tarnishing. A large number of the showcase successes for the profession have acted unethically, dishonestly, corruptly and criminally. But out of the debris of these fallen idols an opportunity for professional reform, more favorable than perhaps at any other time in our history, has arisen.

Judicial Reasoning And Social Change, David A. Dittfurth

Some have begun to doubt whether courts adequately respond to recent social problems. Formulated rules, principles, and statutes govern a case in court, and these commanding communications addressed to judges theoretically guide and control the decision-making process. Rules, although often imprecise, are subjected to the scrutiny of the legal profession, which is trained to interpret their meaning and possible application in different fact situations. This, in turn, promotes a high degree of social and political stability since there is less ambiguity as to what constitutes permissible or required behavior.
Attitudes, social institutions, language, and critical decision making are all factors …

Two Arguments For An Empirical Foundation Of Natural-Law Norms: An Examination Of Johannes Messner's And Victor Kraft's Approaches, Alfred Verdross
Syracuse Journal of International Law and Commerce
The first question that confronts the doctrine of natural law is: how can social norms be ascertained from the Is of human nature? This question raises the preliminary problem as to whether there is a constant human nature at all, a secondary issue which has to be decided before the answer to the main question can be sought.

The Jurisprudence Of Karl Llewellyn, Simon N. Verdun-Jones
The Jurisprudence Of Karl Llewellyn, Simon N. Verdun-Jones
Dalhousie Law Journal
Jurisprudence means to me: any careful and sustained thinking about any phase of things legal, if the thinking seeks to reach beyond the practical solution of an immediate problem in hand. Jurisprudence thus includes any type at all of honest and thoughtful generalization in the field of the legal.' Alongside Roscoe Pound, Karl Llewellyn dominated the American jurisprudential stage for more than thirty years. Indeed, his diverse interests, broadly-based achievements and colorful personality compel the attention of any serious student of modern jurisprudence. Furthermore, the very profusion of roles played by Llewellyn render him one of the most remarkable legal …

Kentucky Parole Officers: An Inquiry Into The Effect Of Residential Background On Their Works Styles, Virginia Cleveland
Kentucky Parole Officers: An Inquiry Into The Effect Of Residential Background On Their Works Styles, Virginia Cleveland
Masters Theses & Specialist Projects
Using the population of Kentucky state parole officers as the focus of this thesis, work styles were studied. The work styles of twenty-eight rural parole officers were compared with the work styles of twenty-two urban officers. The Fisher Exact Statistical Test was used to test differences between these groups. Rural officers were significantly more likely than urban officers to go out of their offices to meet with their parolees. Urban officers had had a significantly greater number of parolees waiting in their offices at one time, than the rural officers had. The length of the average meeting did not differ …

The Black Woman: The Pr E-Decisional Stage, Phyllis Jackson
The Black Woman: The Pr E-Decisional Stage, Phyllis Jackson
IUSTITIA
This discussion is leveled at all black people at all stages of awareness and committment. Essentially it proposes a view of a method of inquiry before making a decision. It asks that people move from molecular level questions to molar level questions. These molar level questions will form a basis of inquiry during the pre-decisional stage which has the triple function of relating ideas with ideas, ideas with experience, and experience with experience. Molecular questions, on the other hand, do not call for investigation but rather "yes" or "no" answers. The black woman, as a subject of unusual interest, provides …
