Judicial Overload: The Reasons And The Remedies , Maria Marcus Jan 1978

Judicial Overload: The Reasons And The Remedies , Maria Marcus

Faculty Scholarship

Animosity towards lawyers, perennial in our social history long before Watergate, parallels a contradictory and equally persistent belief in judges as problem-solvers for a variety of personal, economic, educational and political ills. An increasing number of litigants are bringing to the courts not only the class of disputes that has been the traditional fare of judicial decision-making, but also an array of issues that were formerly resolved in private meetings, at hospitals, in schools, or at home. The causes of this explosion of lawsuits and the possible buffers to an eventual implosion in our judicial system will be discussed below

Federal Antibias Legislation And Academic Freedom: Some Problems With Enforcement Procedures, Howard Hunter

Research Collection Yong Pung How School Of Law

Since World War II, changes and developments in various policies of the American government have given rise to a vast array of complex regulations applicable to institutions of higher learning that receive federal financial support.' Before World War II the federal government was not wholly divorced from matters of higher education, but financial support came principally from state or local governments and from private sources. The shift to a more active federal role has profoundly affected the nation's private colleges and universities.' While state schools have always had a close relationship with their supporting governments, the increased federal role has …

The Interaction Of Religion And Law--A Post-Vatican Ii Roman Catholic Perspective, James F. Bresnahan Jan 1978

The Interaction Of Religion And Law--A Post-Vatican Ii Roman Catholic Perspective, James F. Bresnahan

UC Law Journal

The work of the German theologian, Karl Roliner, cleared theological ground for the achievement of Vatican II and continues to have a significant intellectual influence on current Roman Catholic thought. In this Article, the author utilizes Roliner's thought as the basis for his own suggestion of a way of viewing the religion-law relationship from a contemporary Roman Catholic perspective.

Religion And Right In The Philosophia Christriana Of Erasmus From Rotterdam, Erik Wolf Jan 1978

Religion And Right In The Philosophia Christriana Of Erasmus From Rotterdam, Erik Wolf

UC Law Journal

Although the works of the great humanist, Erasmus, have had a profound effect upon modern discussions of social questions, his attempt to formulate a Christian theory of justice has been almost completely ignored. In this Article, the author examines Erasmus's Philosophia Christiana and discusses the elements of legal theology which it contains.

Republicanism And The Law Of Inheritance In The American Revolutionary Era, Stanley N. Katz Nov 1977

Republicanism And The Law Of Inheritance In The American Revolutionary Era, Stanley N. Katz

Michigan Law Review

This Article deals with the history of the law of inheritance during the era of the American Revolution, but its focus is actually more general, for it ultimately seeks to determine what sort of revolution we experienced. For the historian the problem is quite familiar, but a few observations seem pertinent. It is at least possible to argue that our colonial forefathers were not waging a revolution at all. Rather, one might say they were fighting what we should now call a colonial war of independence in which the overriding issue was "home rule." On this hypothesis, the main slogan …

Comparative Reflections Of The "New Matrimonial Jurisprudence" Of The Roman Catholic Church, Charles Donahue Jr. May 1977

Comparative Reflections Of The "New Matrimonial Jurisprudence" Of The Roman Catholic Church, Charles Donahue Jr.

Michigan Law Review

A recent review of some developments in the law of the Roman Catholic Church concerning the annulment of marriages suggested to me that these developments might be of interest to an audience wider than that composed of those professionally or religiously concerned with the activities of the Church's tribunals. In particular, these developments may reveal something about the problem of incorporating the findings of modern psychology and psychiatry into a legal system, about the ways courts behave when confronted with social change, and perhaps even about the problematic relationship between law and morality. What follows, then, is a series of …

Book Review, James R. Elkins May 1977

Book Review, James R. Elkins

Vanderbilt Law Review

Shaffer suggests a new paradigm for law practice that is not based on rigid control of clients in an impersonal attorney-client relationship. He argues forcefully that disregard for the client's emotions ignores important "facts" that can be used in the law office and the legal process. Shaffer's work suggests the possibility of gaining personal satisfaction and of providing more adequate legal services by actively counseling and understanding clients. Such a humanistic approach to the practice of law can be rooted only in an awareness of the psychological and social defenses erected against both the attorney's clients and the attorney's impact …

The Immigration And Nationality Act Amendments Of 1976: Implications For The Alien Professional, Beverly F. Harris Jan 1977

The Immigration And Nationality Act Amendments Of 1976: Implications For The Alien Professional, Beverly F. Harris

Cleveland State Law Review

Although each major amendment of the Immigration and Nationality Act of 1952, the nation's first comprehensive immigration law, has had the positive effect of enhancing broad national policies, the position of the alien professional within the statutory framework has changed with each amendment. The result is that the professional must today comply with more requirements in order to enter the United States for the purpose of employment. The purpose of this Note is to analyze the changes in the immigration laws effected by the 1976 Immigration Act Amendments and the impact of these changes upon the alien professional.
