As a long-time friend and admirer of legal education at Dalhousie, it is an honor and a pleasure for me to offer the Read lecture this year. It is particularly warming to have Mrs. Read and the next two generations of Reads here today, since Dean Read was the strongest proponent of the law library's development during his deanship here. One of the designated topics for these lectures has been legal education. With the dedication of the addition to the Weldon Building housing the restored Sir James Dunn Law Library, and the designation of a librarian, for the first time, …

Nomos And Thanatos (Part B). Feminism As Jurisgenerative Transformation, Or Resistance Through Partial Incorporation?, Richard F. Devlin
Dalhousie Law Journal
In Part A of this essay, "The Killing Fields", I developed a critique of the disciplinary impulses that underlie modern law and legal theory. Invoking a number of perspectives and a plurality of analyses, I proposed that male-stream legal theory and contemporary law both assume as inevitable, and legitimize as appropriate, the funnelling of violence through law. The problem with a funnel, however, is that it does not curtail or reduce that which is channelled through it. On the contrary, to funnel is to condense and to intensify. Viewed from this perspective, interpreted from the bottom up, law and legal …

Wittgenstein wrote nothing on legal theory or law, so there is no obvious textual basis on which to draw possible connections between Wittgenstein and legal theory. And Wittgenstein abhorred theorizing in philosophy. So the odds are slim that Wittgenstein would have accommodated himself or his work to similar activity in the law. Where does this leave us?
At sea, which is where we normally are in life and, thus, where Wittgenstein wants us to recognize ourselves as being when doing philosophy too. But theory can disguise this fact from us, as it also can make us think that we have …

Nonverbal Communication From The Other Side: Speaking Body Language, John L. Barkai
Nonverbal Communication From The Other Side: Speaking Body Language, John L. Barkai
San Diego Law Review
In this Article, Professor Barkai highlights the relationship between nonverbal communication and the legal profession. The author notes that lawyers are quickly realizing importance of nonverbal behavior in determining the nature of communication and the relationship between the communicators. As such, he sets out to define a broader and more universal role for conscious nonverbal communication in law. His analysis covers the mechanics of body language and the importance of nonverbal communication in the law office whether dealing with other attorneys, witnesses, or clients. Using research drawn from the social sciences, the author concludes that lawyers can consciously speak body …

The Contractual Reallocation Of Procreative Resources And Parental Rights: The Natural Endowment Critique, William J. Wagner
Scholarly Articles
This article inquires into the meaning and value of contract as a principle for ordering technologically assisted human reproduction. The article seeks to provide an analytically sound definition of this contractual option for ordering the new reproductive technologies, an accurate statement of its current legal status, and an assessment of its theoretical cogency and political and practical appeal. The purpose of the article is the clarification and critique of contract-based proposals for a new legal ordering of human reproduction. On a more general level, it seeks to contribute to a sound conceptual framework for the ongoing discussion of the legal …

The right to be free from extra-legal, arbitrary, or summary ex- ecutions is recognized in a number of international human rights in- struments. Such killings violate article 6 of the International Covenant on Civil and Political Rights,' which provides that "every human being has the inherent right to life. This right shall be protected by law. No one shall be arbitrarily deprived of his life."
